Book excerpt: This volume represents a historical comparison of the American and the EU European constitutional experiences and lessons to be derived therefrom for the present time. It is designed to deepen the understanding of the historical and political dimensions of constitutional designs and practises on two continents. Hopefully, such historical depth charts will expand the horizon of debates among experts and decision-makers. The first part concentrates on the historical dimension. It deals with the experiences and perceptions of basic American political principles, developments of international and humanitarian law, and the historical dimension of constitutional debates. The second part of the book aims at culling potential lessons from the American constitutional experience and the remarkable longevity of the U.S. constitution. Additional chapters concentrate on specific aspects and elements of the European constitutional debate (courts of law, human rights, minority protections, as well as gender equality). Still other contributions focus on the historical context of the recent European Constitutional Convention. Chapters on writing a European 'bill of rights', the EU reform debates of the 1990s, and finally an analysis of the Brussels Constitutional Summit of June 2004 are also included. Although Denmark, in 1973, and Sweden and Finland, in 1995, joined the European Union, the entry of Norway into the Union was rejected in the plebiscites of 1972 and 1994. Furthermore, Nordic EU members enjoy permanent exceptions to their integration into the EU: Denmark and Sweden, like the U.K., have declined to become part of the monetary union. Finland is essentially the only Nordic country that entered the EU without substantial exceptions. A membership bid from Iceland was unthinkable; after the fi nancial crisis - which is not the topic of this book - Iceland applied for membership in 2010 and has been in discussions with the European Commission ever since. In other words: the European Union divides Nordic societies, which has resulted in a series of national exceptions to the integration process. Taken together, these exceptions have created an integration process whose overall geometry is contradictory and paradoxical. The Court stands virtually unchallenged as the most trusted institution of the German state. Written as a complete history of the German Federal Constitutional Court from its founding in 1951 up into the twenty-first century, this book explores how the court became so powerful, and why so few can resist its strength. Founded in 1951, the Court took root in a pre-democratic political culture. The Court's earliest contributions were to help establish liberal values and fundamental rights protection in the young Federal Republic. The early Court also helped democratize West German politics by reinforcing rights of speech and information, affirming the legitimacy of parliamentary opposition, and checking executive power.
