Book Synopsis The principle of non-discrimination in international and European tax law by : Niels Bammens
Download or read book The principle of non-discrimination in international and European tax law written by Niels Bammens and published by IBFD. This book was released on 2012 with total page 1151 pages. Available in PDF, EPUB and Kindle. Book excerpt: The principle of non-discrimination plays a vital role in international and European tax law. This dissertation analyses the interpretation given to that principle in tax treaty practice and in the direct tax case law of the Court of Justice of the European Union (ECJ) on the fundamental freedoms. The objective of this analysis is twofold: to give a clear and thorough overview of both standards and to determine whether they share a common, underlying principle of non-discrimination. In order to achieve these objectives, a comprehensive selection of case law is discussed from the perspective of the two constitutive elements of discrimination, comparability and the existence of different treatment. Moreover, attention is drawn to the question whether a domestic measure that is found to be discriminatory may nevertheless be justified on the basis of reasons of public interest. Finally, the possible interplay between both standards is addressed.

Book Synopsis Trial Technique and Evidence by : Michael R. Fontham
Download or read book Trial Technique and Evidence written by Michael R. Fontham and published by Aspen Publishing. This book was released on 2013-06-28 with total page 868 pages. Available in PDF, EPUB and Kindle. Book excerpt: Evidence and Trial Advocacy are often taught as if in practice; the topics are not related. The original edition of this title pioneered the concept that instruction on trial technique and evidence rules in the same volume is an effective way to teach either an evidence or trial advocacy course. This combination provides students with the foundation for becoming skilled trial advocates within the boundaries of the rules of evidence. Trial Technique and Evidence explains the purpose and application of each evidence rule. The practical methods of presenting evidence are balanced against the requirements of the rules. Indeed, many evidence rules are "practice" rules, either not covered in the formal rules of evidence or not addressed in detail. The basis for introducing demonstrative exhibits, for example, is not included in the federal rules, and impeaching witnesses in trial requires knowledge of practical technique. Trial Technique and Evidence allows a professor to incorporate practical requirements with evidence theory. The text also includes practical steps for compliance with the rules, with examples to facilitate the student's understanding, and addresses recent developments such as: • Jury persuasion • Application of rules to electronic evidence • Trends in applying the Daubert factors for assessing expert testimony • Amendments to the Federal Rules of Evidence

Book Synopsis A MESSAGE FOR THE HUMAN RACE by : A. Christian
Download or read book A MESSAGE FOR THE HUMAN RACE written by A. Christian and published by Christian Faith Publishing, Inc.. This book was released on 2022-08-01 with total page 638 pages. Available in PDF, EPUB and Kindle. Book excerpt: A Message for the Human Race According to God's word: "For the invisible things of Him, both the external power and divine characteristics, have been clearly seen since the creation of the world, being perceived by the things made, so that they would be without excuse." This implicitly means that there is no discrepancy between invisible spiritual matters (and their written documentation, i.e., the Bible), and the visible things of the physical universe. It is therefore possible to use logic and scientific reasoning, and historical and archeological evidence to correlate, substantiate, explain, and confirm spiritual reality. A note of caution: "Set the mind on the spirit." Knowledge that does not result in a human being's experience of God is vanity. Too much objective knowledge ABOUT God can easily interfere with subjective experience of Christ. You, the reader, by using your free will to seek after God to have Him reveal His eternal purpose in order for you to participate by your cooperation, can hasten the coming of the day of the Lord Christ's return to this earth.
Download or read book Images of Projects written by Mark Winter and published by Routledge. This book was released on 2017-03-02 with total page 370 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this very distinctive book, Images of Projects challenges how we think about projects in the most fundamental way: it rejects outright the idea of a one 'best way' to view all projects and also the idea of following a prescriptive approach. In contrast, Images of Projects seeks to encourage a more pragmatic and reflective approach, based on deliberately seeing projects from multiple perspectives, exploring the insights and implications which flow from these, and crafting appropriate action strategies in complex situations. Based on real examples and the authors' work over the last ten years, Images of Projects presents seven pragmatic images for making sense of the complex realities of projects. Illustrated using various models, these images are presented in ways that allow the reader to reflect upon their own mental models in relation to the different perspectives in this book.

Book Synopsis The Needed Balances in EU Criminal Law by : Chloé Brière
Download or read book The Needed Balances in EU Criminal Law written by Chloé Brière and published by Bloomsbury Publishing. This book was released on 2017-12-28 with total page 467 pages. Available in PDF, EPUB and Kindle. Book excerpt: This important volume provides an up-to-date overview of the main questions currently discussed in the field of EU criminal law. It makes a stimulating addition to literature in the field, while offering its own distinctive features. It takes a four-part approach: firstly, it addresses issues of a constitutional nature, such as the EU competence in the field of criminal law, the importance of the principle of subsidiarity and the role played by the different EU institutions. Secondly, it looks at issues linked to the quest of the right balance between diversity and unity, and focuses in particular on the special relationship between approximation and mutual recognition. Thirdly, it focuses on the balance between security and freedom, or, in other words, between the shield and sword functions of EU criminal law. Special attention is given here to transatlantic cooperation, data protection, terrorism, the European Arrest Warrant and the European Investigation Order. Finally, it examines the importance of balanced relations between criminal justice actors.
Book Synopsis The Political Economy of Corruption by : Chandan Kumar Jha
Download or read book The Political Economy of Corruption written by Chandan Kumar Jha and published by Taylor & Francis. This book was released on 2023-05-04 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: Corruption, commonly defined as the misuse of public office for private gains, is multifaceted, multidimensional and ubiquitous. This edited collection, featuring contributions from leading scholars in the field of corruption, goes beyond the standard enforcement framework wherein individuals only compare the expected costs and benefits of a corrupt act. These chapters explore the political-cultural contexts, legal and regulatory process and, above all, moral and psychological factors in attempts to understand and explain corruption. The book explores a broad canvas where gender, technology, culture and institutional structures influence attitudes towards corruption. Design and implementation of anti-corruption strategies benefit from suitable identification of these factors contributing to the prevalence and persistence of corruption. Combining theoretical and empirical studies with evidence from experiments as well as case studies, the book provides crucial state of the art in corruption research in a highly accessible manner. This book serves as a vital reference to students and scholars in economics, politics and development studies. Additionally, policymakers and development practitioners can use the insights from this book in successful design and implementation of anti-corruption policies.

Book Synopsis Transatlantic Jurisdictional Conflicts in Data Protection Law by : Mistale Taylor
Download or read book Transatlantic Jurisdictional Conflicts in Data Protection Law written by Mistale Taylor and published by Cambridge University Press. This book was released on 2023-04-13 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book looks at transatlantic jurisdictional conflicts in data protection law and how the fundamental right to data protection conditions the EU's exercise of extraterritorial jurisdiction. Governments, companies and individuals are handling ever more digitised personal data, so it is increasingly important to ensure this data is protected. Meanwhile, the Internet is changing how territory and jurisdiction are realised online. The EU promotes personal data protection as a fundamental right. Especially since the EU's General Data Protection Regulation started applying in 2018, its data protection laws have had strong effects beyond its territory. In contrast, similar US information privacy laws are rooted in the marketplace and carry less normative heft. This has provoked clashes with the EU when their values, interests and laws conflict. This research uses three case studies to suggest ways to mitigate transatlantic jurisdictional tensions over data protection and security, the free flow of information and trade.
Book Synopsis Legal Consequences of Peremptory Norms in International Law by : Daniel Costelloe
Download or read book Legal Consequences of Peremptory Norms in International Law written by Daniel Costelloe and published by Cambridge University Press. This book was released on 2017-09-07 with total page 381 pages. Available in PDF, EPUB and Kindle. Book excerpt: When is a norm peremptory? This is a question that has troubled legal scholars throughout the development of modern international law. In this work, Daniel Costelloe suggests - through an examination of State practice and international materials - that it is the legal consequences of a norm which distinguish it as peremptory. This book sheds light on the legal consequences that peremptory norms have, for instance, in the law of treaties, international responsibility and state immunity. Unlike their substance or identification, the consequences of peremptory norms have remained under-studied. This book is the first specifically on this topic and is essential reading for all scholars and practitioners of public international law.
Book Synopsis Sacred Natural Sites by : Bas Verschuuren
Download or read book Sacred Natural Sites written by Bas Verschuuren and published by Routledge. This book was released on 2012-06-25 with total page 338 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sacred Natural Sites are the world's oldest protected places. This book focuses on a wide spread of both iconic and lesser known examples such as sacred groves of the Western Ghats (India), Sagarmatha /Chomolongma (Mt Everest, Nepal, Tibet - and China), the Golden Mountains of Altai (Russia), Holy Island of Lindisfarne (UK) and the sacred lakes of the Niger Delta (Nigeria). The book illustrates that sacred natural sites, although often under threat, exist within and outside formally recognised protected areas, heritage sites. Sacred natural sites may well be some of the last strongholds for building resilient networks of connected landscapes. They also form important nodes for maintaining a dynamic socio-cultural fabric in the face of global change. The diverse authors bridge the gap between approaches to the conservation of cultural and biological diversity by taking into account cultural and spiritual values together with the socio-economic interests of the custodian communities and other relevant stakeholders.
