Available in PDF, EPUB and Kindle. Book excerpt: Examining the powerful idea of the return, reconstitution and redeployment of the public domain in a post-Seattle and post-Washington consensus world order, this innovative book is the most forward-looking and comprehensive examination of the need to rethink the tenants of global free trade. In the past two decades, countries have focused on broadening and guaranteeing market access, and as the pendulum swings back for the market, the issue of investing in the public domain becomes a priority. The authors believe that devising new institutions of governance for a globalizing world requires fundamental change nationally and internationally. They argue that new public spaces, places and services are required to strengthen democracy and create sanctuaries in society where the market mechanism cannot reach. The public domain is an incipient concept that enables states to reduce the intrusiveness of markets and at the same time develop a strong national performance to reduce the inequality and social exclusion in an increasingly volatile global economy. This original volume boasts an impressive list of international contributors who have demonstrated innovation and leadership in their fields. It will strongly appeal to advanced students, academics and policy makers involved in the field of global governance and international political economy.

Available in PDF, EPUB and Kindle. Book excerpt: Digital technology has made culture more accessible than ever before. Texts, audio, pictures and video can easily be produced, disseminated, used and remixed using devices that are increasingly user-friendly and affordable. However, along with this technological democratization comes a paradoxical flipside: the norms regulating culture's use - copyright and related rights - have become increasingly restrictive. This book brings together essays by academics, librarians, entrepreneurs, activists and policy makers, who were all part of the EU-funded Communia project. Together the authors argue that the Public Domain - that is, the informational works owned by all of us, be that literature, music, the output of scientific research, educational material or public sector information - is fundamental to a healthy society. The essays range from more theoretical papers on the history of copyright and the Public Domain, to practical examples and case studies of recent projects that have engaged with the principles of Open Access and Creative Commons licensing. The book is essential reading for anyone interested in the current debate about copyright and the Internet. It opens up discussion and offers practical solutions to the difficult question of the regulation of culture at the digital age.

Book excerpt: Conflicts between sportsmen and landowners over the issue of access to public domain lands result primarily from economic factors associated with recreational uses of these lands. This report describes the problems experienced in its management of the Piceance Creek area in Colorado and the Caliente Mountain area in California. All access roads to both areas pass over privately owned land; the owners restrict access over these private roads. Alternative arrangements that would more fairly apportion costs and benefits to landowners and sportsmen alike are evaluated.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first comprehensive review of the Intergovernmental Committee (IGC) of the World Intellectual Property Organization (WIPO) established in 2000. It provides an in-depth consideration of the key thematic areas within WIPO discussions – genetic resources (GRs), traditional knowledge (TK) and traditional cultural expressions (TCEs) through the perspectives of a broad range of experts and stakeholders, including indigenous peoples and local communities. It also looks at how these areas have been treated in a number of forums and settings (including national systems and experiences, and also in trade agreements) and the interface with WIPO discussions. Furthermore, the book analyses the process and the negotiation dynamics since the IGC received a mandate from WIPO members, in 2009, to undertake formal text-based negotiations towards legal instruments for the protection of GR, TK and TCEs. While there has been some progress in these negotiations, important disagreements persist. If these are to be resolved, the adoption of these legal instruments would be a significant development towards resolving key gaps in the modern intellectual property system. In this regard, the book considers the future of the IGC and suggests options which could contribute towards achieving a consensual outcome.

Book excerpt: In this enlightening book James Boyle describes what he calls the range wars of the information age--today's heated battles over intellectual property. Boyle argues that just as every informed citizen needs to know at least something about the environment or civil rights, every citizen should also understand intellectual property law. Why? Because intellectual property rights mark out the ground rules of the information society, and today's policies are unbalanced, unsupported by evidence, and often detrimental to cultural access, free speech, digital creativity, and scientific innovation.Boyle identifies as a major problem the widespread failure to understand the importance of the public domain--the realm of material that everyone is free to use and share without permission or fee. The public domain is as vital to innovation and culture as the realm of material protected by intellectual property rights, he asserts, and he calls for a movement akin to the environmental movement to preserve it. With a clear analysis of issues ranging from Jefferson's philosophy of innovation to musical sampling, synthetic biology and Internet file sharing, this timely book brings a positive new perspective to important cultural and legal debates. If we continue to enclose the "commons of the mind," Boyle argues, we will all be the poorer.
