Available in PDF, EPUB and Kindle. Book excerpt: Historically Canadians have considered themselves to be more or less free of racial prejudice. Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' From thousands of possibilities, Backhouse has selected studies that constitute central moments in the legal history of race in Canada. Her selection also considers a wide range of legal forums, including administrative rulings by municipal councils, criminal trials before police magistrates, and criminal and civil cases heard by the highest courts in the provinces and by the Supreme Court of Canada. The extensive and detailed documentation presented here leaves no doubt that the Canadian legal system played a dominant role in creating and preserving racial discrimination. A central message of this book is that racism is deeply embedded in Canadian history despite Canada's reputation as a raceless society. Winner of the Joseph Brant Award, presented by the Ontario Historical Society

Available in PDF, EPUB and Kindle. Book excerpt: First Conquer Thyself: Socialization of violence and abuse is often highly structured through the Munchausen Complex. Munchausen Syndrome occurs when an individual harms themselves for attention and self-glorification. Munchausen Syndrome by Proxy is when an individual harms another, usually under their care. Attention and self-glorification are achieved through their victim's subsequent medical treatment. Munchausen Syndrome by Proxy is a crime with a victim. Violence and abuse are often common in families, passed down from one generation to the next and may be termed Transgenerational Munchausen Syndrome as these families expand and their habits are introduced into society. Munchausen Syndrome in Collective Transmission occurs when such practices become an acceptable part of society often eventuating into full acculturation. In this way societies attach themselves to self-glorification with various explanations of justification. A Mandated Report is required to be filed by health care, legal, social service and educational professionals who suspect child abuse, as well as developers of film. As socialized beings, we are often unaware why we think what we think and why we do what we do. Exploring beneath the surface, we may discover we are not who we imagine we are. Are our subtle perversions and aberrations so different from those of the ancients, or other cultures we label primitive? The author was under military orders not to discuss the subjects presented in this part's Mandated Report on child abuse to the social body for the last six years of his U.S. Navy career. Censorship is strong when one questions social norms, folkways and rituals that address issues of identity. Internal, interpersonal and professional conflicts arise.

Book excerpt: Drawing on historical records of women’s varying experiences as litigants, accused criminals, or witnesses, this book offers critical insight into women’s legal status in nineteenth-century Canada. In an effort to recover the social and political conditions under which women lobbied, rebelled, and in some cases influenced change, Petticoats and Prejudice weaves together forgotten stories of achievement and defeat in the Canadian legal system. Expanding the concept of “heroism” beyond its traditional limitations, this text gives life to some of Canada’s lost heroines. Euphemia Rabbitt, who resisted an attempted rape, and Clara Brett Martin, who valiantly secured entry into the all-male legal profession, were admired by their contemporaries for their successful pursuits of justice. But Ellen Rogers, a prostitute who believed all women should be legally protected against sexual assault, and Nellie Armstrong, a battered wife and mother who sought child custody, were ostracized for their ideas and demands. Well aware of the limitations placed upon women advocating for reform in a patriarchal legal system, Constance Backhouse recreates vivid and textured snapshots of these and other women’s courageous struggles against gender discrimination and oppression. Employing social history to illuminate the reproductive, sexual, racial, and occupational inequalities that continue to shape women’s encounters with the law, Petticoats and Prejudice is an essential entry point into the gendered treatment of feminized bodies in Canadian legal institutions. This book was co-published with The Osgoode Society for Canadian Legal History.

Book excerpt: The summer of 1840, and Boston Harbor is thrumming with politicians, business people, civic leaders, members of the judiciary, and the public. The city is ready for a celebration, and its citizens are waiting impatiently for the arrival of a new age. The elegant Britannia finally enters the harbour loaded with mail from England ushering in the Age of Steam to the Atlantic. This event crystallises Samuel Cunard's vision and the world will never be the same. This is the story of a man born and raised in Halifax, Nova Scotia, whose father and mother fled colonial New York after the American Revolution, and became one the most powerful forces of international trade in the nineteenth century. His innovative steamship Britannia was the first reliable, timely link between the Old World and the New, and the transatlantic transportation of mail, goods, and passengers was revolutionised. The continued success of the Cunard Line is a testament to Samuel Cunard's brilliance as both a mariner and a businessman. The first full-length biography of one of the most fascinating figures in mercantile history, "Steam Lion" is an important and engaging record of a man, his business, and his times.

Available in PDF, EPUB and Kindle. Book excerpt: Long recognized as the standard work on the topic, The Oil and Gas Lease in Canada discusses the legal document that determines the process by which a freehold mineral owner may grant oil companies the right to search for and produce minerals. Subjected to ongoing litigation and governmental regulation, the Lease continues to evolve as the body of common law surrounding it grows and develops. The substances covered by the Lease are unique in that their occurrence is uncertain until discovery, and they are capable of moving from place to place within a reservoir. These qualities have led to the development of new legal concepts, basically creating a separate and distinct branch of the law. This fourth edition of The Oil and Gas Lease in Canada guides the reader through the complexities of the Lease and the legal issues attached to it. John Bishop Ballem brings the text up to date on recent developments, including changes and additions to the terms of the Lease, the effect of recent court decisions, and the growth of coal bed methane as an energy source. Of particular interest is his examination of what takes place following a Lease's involuntary termination. Ballem deals with specific examples of this situation, detailing its consequences for both individual mineral owners and companies, as well as for future judicial pronouncements. The fourth edition of The Oil and Gas Lease in Canada is indispensable for mineral owners, oil companies, land agents, lawyers, and legal institutions.
