Este impuesto local, de exigencia potestativa para los municipios, ha dado lugar a una abundante jurisprudencia derivada de los problemas que presenta la aplicación práctica del comúnmente llamado «impuesto sobre plusvalías». Se ha analizado por completo su régimen legal, con atención especial a los aspectos más conflictivos: fundamentalmente, en el ámbito del hecho imponible, la fijación de la naturaleza del bien como inmueble a los efectos de su gravamen, el análisis de los negocios jurídicos que generan transmisiones gravadas por el IIVTNU, la determinación del momento temporal en que deben darse estas circunstancias; la delimitación del sentido de las normas de no sujeción y de exención, cuya interpretación restrictiva produce efectos indeseables; o su complejo régimen de cuantificación, excesivamente vinculado al valor catastral. En este estudio se ha pretendido ofrecer respuestas a estas cuestiones, pensando sobre todo en el profesional que debe aplicar el derecho y necesita conocer las soluciones jurisprudenciales y doctrinales más actuales, sin olvidar alguna mención crítica a aquellos aspectos de la regulación legal que en opinión de los autores requieren una urgente reforma.
