Book excerpt: Every morning for the last thirty years, C. K. Stead has written fiction and poetry. Shelf Life collects the best of his afternoon work: reviews and essays, interviews and diaries, lectures and opinion pieces. In this latest collection, a sequel to the successful Answering to the Language, The Writer at Work, and Book Self, Stead takes the reader through nine essays in ‘the Mansfield file', collects works of criticism and review in ‘book talk', writes in the ‘first person' about everything from David Bain to Parnell, and finally offers some recent reflections on poetic laurels from his time as New Zealand poet laureate. Throughout, Stead is vintage Stead: clear, direct, intelligent, decisive, personal. This is a sequel to the successful Answering to the Language, The Writer at Work, and Book Self. It includes every kind of literary journalism, including politics, education, and reflections on language and some of Stead's laureate blogs which sit between criticism and autobiography. These are further perspectives on New Zealand's literature and culture from the country's leading critic.

Available in PDF, EPUB and Kindle. Book excerpt: Analytical jurisprudence has been mostly silent on the role of precedent in legal adjudication. What is the content of a judge's precedent ideology,or the rule of precedent-recognition, by means of which the ratio of a case is to be distinguished from mere dicta? In this study, the author identifies six types of judicial precedent-ideology, among them judicial legislation, systemic construction of the underlying reasons of law in the Dworkinian sense, and a radical re-evaluation of the merits of a prior case in later adjudication, as envisioned by the American Realists. These competing models are tested against judicial experiences in the UK, US, France, Italy, Germany and Finland. By this means Lon Fuller's famous 'internal morality of law' is shown to function rather poorly in the context of precedents, and the author therefore suggests a redefinition of the rule which makes it work for precedent. This, in turn leads the author to confront fundamental questions about the normative nature of law. Is Kelsen's grundnorm or Hart's ultimate rule of recognition a valid rule, in the image of legal rules proper, or is it merely a social fact, observable only in the practices and behaviour of judges and other officials? The author claims that Hart is caught between Kelsen and J.L. Borges, the late Argentinian fabulist, in so far as the ontology and epistemology of the rule of recognition are concerned. This leads the author to the conclusion that the two predicaments affecting analytical positivism, namely the threat of endless self-referentiality, or infinite regress, can only be accounted for by means of recourse to the philosophy of deconstruction as posited by Jacques Derrida.

Available in PDF, EPUB and Kindle. Book excerpt: "The most thorough examination we have of how early Americans wrestled with what types of political dissent should be permitted, even promoted, in the new republic they were forming.Martin shows the modern relevance of their debates in ways that all will find valuable—even those who dissent from his views!"—Rogers M. Smith, Christopher H. Browne Distinguished Professor of Political Science, University of Pennsylvania We generally think of democracy as government by consent; a government of, by, and for the people. We commonly downplay or even denigrate the role of dissent in democratic governments. But in Government by Dissent, Robert W.T. Martin explores the idea that the people most important in a flourishing democracy are those who challenge the status quo. The American political radicals of the 1790s understood, articulated, and defended the crucial necessity of dissent to democracy. Dissent has rarely been the mainstream of democratic politics. But the figures explored here—forgotten farmers as well as revered framers—understood that dissent is always the essential undercurrent of democracy and is often the critical crosscurrent. Only by returning to their political insights can we hope to reinvigorate our own popular politics. Robert W.T. Martin is Professor of Government and Chair of the Government Department at Hamilton College. His works include The Free and Open Press: The Founding of American Democratic Press Liberty, 1640-1800 (2001), and The Many Faces of Alexander Hamilton (co-edited with Douglas Ambrose, 2006), both from NYU Press.
