Book excerpt: Text and Interpretation: Imam Ja'far al-Sadiq and his Legacy in Islamic Law examines the main characteristics of the legal thought of Imam Ja'far al-Sadiq, a preeminent religious scholar and jurist of Medina in the first half of the second centuty of the Islamic calendar (mid-eighth century CE), Numerous works in different languages have appeared over the past half century to introduce this school of Islamic law and its history, legal theory, and substance in contexts of Shi'i law. While previous literature has focused on the later stages of the school in its developed and expanded form, this book presents an intellectual history of how the school began. The Ja'fari school emerged within the general legal discourse of late Umayyad and early Abbasid periods, but it was known to differ in certain approaches from the other main legal schools of that time. In addition to sketching the origins of the school, this book examines Ja'far al-Sadiq's interpretive approach through detailing his position on a number of specific questions, as well as the legal canons, presumptions, and other interpretive tools he adopted. Book excerpt: This work is an authoritative compilation of Islamic law based on the jurisprudence of the Shiite Imam, Ja`far al-Sadiq. In volume 1, the laws dealing with matters of worship (prayers, fasting, alms, hajj, etc...) are presented in concise, clear narrative. Volume 2 provides a summary of the laws dealing with civil (transactional) matters, generally known in Islamic law as, mu`amalat, which includes contract, inheritance, bequest, public trusts, marriage, and divorce laws.Together the two volumes provide Muslims and non-Muslims who are interested in learning about Islamic law (shari`ah) an account of formal legal opinions and rulings concerning nearly 3000 legal cases.Imam Ja`far al-Sadiq is the scholar who systematized Shiite jurisprudence followed by millions of Muslims around the world. He is seen as the founder of Imami (or Twelver or Ja`fari) Shiite school of jurisprudence. The Iranian constitution of 1980 enshrined this school of jurisprudence as the official source of law.

Book excerpt: The Islamic regime that came to power after the 1978-79 Iranian revolution justified the rule of the Ayatollah Khomeini, and the Shi'ite imams in general, on the basis of the doctrine that the Islamic jurist is best suited to rule with justice in an Islamic country. Arguing that this concept has no apparent parallel in Sunni Islam, this study explores its origins in the Sunni/Shi'ite schism, which took place after the death of the Prophet, and traces its evolution to the present day. Drawing on exhaustive research in the Islamic libraries of Iran and Jordan, as well as discussions with leading jurors and scholars in Iran, Sachedina presents the first in-depth analysis of an Islamic phenomenon of vital contemporary social and political significance.

Book excerpt: After the demise of Prophet Muhammad (PBUH), the Muslims were divided regarding whom they should follow as their political and religious leader. The Sunnis followed the Prophet’s companions whilst the Shias followed the 12 Holy Imams chosen by God. The Shia Imams were from the lineage of Prophet Muhammad (PBUH) from his only surviving daughter, Lady Fatimah (SA). Successive Shia Imams lived amongst the Muslims for generations and guided them to the true Islamic teachings of the Prophet. All of the Shia Imams were respected by the Muslims for their spirituality, divine knowledge, and being the progeny of the Prophet. The Imams were a symbol of resistance against the injustice and oppression of the Umayyads and the Abbasids. As a result, the Imams endured many calamities and hardships. They were harassed, imprisoned, and martyred by the Umayyad and the Abbasid caliphs. This book reviews the lives of these 12 Holy Imams and provides an overview of their religious, social, and political achievements. Book excerpt: According to Fiqh E Jaferia..... Islamic Medical Wisdom - The Tibb al-A'imma by Imam Ali ibn Abu Talib (as) (Author), Andrew J. Newman (Editor), Batool Ispahany (Translator) The present is the first English translation of a text in the Twelver Shi'i prophetic medical tradition. As such it will prove of both interest and importance to specialists and non-specialists alike. The former include those pursuing study of various aspects of Islamic history and civilization in general and especially students of the history of Islamic medicine. The latter include both those wishing greater awareness of the Twelver Shi'i faith and heritage in general, and those desirous of greater familiarity with practical dimensions of the faith in particular. For these audiences a fuller appreciation of this text is perhaps best achieved by some discussion of the place of the prophetic medical tradition within the context of the history of Islamic medicine. Western-language scholars have generally defined Islamic medicine as composed of two distinct and dichotomous traditions, pre-Islamic Galenic medicine and prophetic medicine. Galenic medicine is understood to have become available to Islamic medical writers and practitioners as Greek scientific texts were translated into Arabic, beginning especially in Baghdad In the early 3rd/9th century. Supported by the Abbasid caliphs and other wealthy benefactors, over the next two hundred years the translation movement made much of Greek philosophy and science available in Arabic, the lingua franca of Islamic civilization. The Imams of the Ahl al-Bayt, peace be upon them, were as concerned with treating the body as they were with treating the soul, and their regard for the soundness of the body was similar to their regard for the refinement of the soul. They were physicians of the soul and the body, and Muslims would consult them for their physical illnesses as they would for curing their spiritual sicknesses. This collection of Hadith is ample evidence of that. The Imams, peace be upon them, were not merely conveyors of religious regulations and legislation, but were leaders committed to caring for the Muslims, equally concerned-if such a term is correct-with the health of their bodies and their beliefs, such that they encouraged the learning of medicine (al-.tibb). In his comprehensive statement on the divisions of knowledge, 'Ali b. Abu Talib (d. 40/661) Amir al-Mu'minin, peace be upon him, combined it [medicine] with the knowledge of jurisprudence (al-fiqh), saying: 'There are four kinds of knowledge: jurisprudence for religions, medicine for bodies, grammar for languages, and [study of] the stars to recognize the seasons. Much has been related from the Imams in collections [of Hadith] on medicine and preserving good health, just as there are more descriptions of various remedies related from them. Here for the reader are a small number of their sayings which are general rules for preserving health and physical well-being.

Book excerpt: Unfairly demonized by its adversaries—including the Sunni Arab countries, along with the US and EU—Iran is wary of the world's powers, after having been preyed upon to achieve other countries' political aims. Iranians are Shia Muslims, a minority sect comprising only 10 to 15% of the billion-plus Muslims in the world. Shias’ persecution and marginalization began in ancient times after the demise of the Prophet of Islam in 632, and has continued ever since. In modern times, their worldwide oppression has been spearheaded by Saudi Arabia—whose religion considers Shias to be apostates who deserve to be killed—and its allies, a persecution that began with the 1979 Iranian Revolution, which was followed by the unprovoked invasion of Iran by Iraq in 1980, and the successful defence of this invasion by Iran's revolutionary forces. Building upon this history, Iran, the Citadel of Shia Imams details the alarming aggression of the Sunni countries of the Middle East against the Shia-led regimes of Iraq, Syria, and Yemen—a relentless persecution of Shia Muslims and extreme injustice and aggression towards them, the details of which need to be brought to light. The unfortunate and reckless support of Saudi Arabia and its allies by the US and many other Western nations has perpetuated a blatant infringement upon the human rights of Iranians and Shia Muslims elsewhere. The oppression of Iranians continues in the form of toughened US sanctions, contrary to international law.

Book excerpt: Islam’s Sacred Law is one of the most complex, detailed and comprehensive legal theories that Islam, as a Western religion, has produced in its capacity as a doctrine of social justice. However, few available texts have dealt with the treatment of women under the actual system of justice that adheres to Islam’s Sacred Law. This book fills this void by providing a much needed comprehensive study of the application of the Sacred Law to women under the Islamic Republic of Iran’s justice system. It will be a fascinating guide to all those interested in comparative law, criminal justice and the sociology of law.
