Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook of the Law of Wills The first edition was so broad in scope that it has seemed unwise to deal with entirely new topics. In connection with the topics dealt with in the first edition, the editor has sought primarily to consider those cases which have been decided in the twelve years which have elapsed since the publication of that edition. Some changes and a large number of additions have been made, especially in the notes. Many cases in support of new text have been referred to, and a con siderable number of recent cases have been cited, because they con tain valuable discussions or deal with matters which are still in dis pute. Although realizing that defects in general statements are nu avoidable, the statements in the black-letter text have usually been re tained, but the fact that the authorities are in conflict has been made clear in many instances where this did not appear in the former edition. Book excerpt: Excerpt from The Law of Wills: For Students When asked some time ago to write a book on Wills for the Students' Series, I told my publishers, who are owners of the American copyright of Jarman on Wills, under the International Copyright Law, that I would try it if I could have free use of Jarman and my own notes to that work. How much the permission given has been used, the references to Jarman, scattered up and down the present volume, in part bear witness. But a word or two need now be said. This book agrees with those who find an important place for legal theory in education for the bar. Chapter I., largely on the theory of wills in relation to the State, and Chapter XIV., largely on the theory of construction, are only more express examples, because of their relative and intrinsic importance, of what more or less runs through the book. Whatever mode of instruction is pursued, whether the Harvard, which is powerfully modifying where it is not taking the place of other methods, or any other, the doctrines of the law should, I think, be taught in direct connection with and in the light of legal theory. Book excerpt: Excerpt from Principles of the Law of Wills: With Selected Cases It would be hardly justifiable to express a conviction that this book will prove as useful to practising lawyers as to the student. But it is believed that it will prove useful even to them as a com pact and careful review and summary of the important principles and doctrines in its field, and as a convenient means Of reference to the best and most telling authorities. The very wealth of material in the large treatises, -some Of which are beyond all need of praise for their great worth and practical value, - Often renders it difficult to determine which of the army Of 'cases cited are the best for reading or reference. Here the citations are, so to speak, few, but they are carefully chosen and important. For lawyers who have not convenient access to large libraries, the selected cases also constitute a reservoir of valuable original authorities. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Wills, Vol. 1: Embracing the Jurisprudence of Insanity, the Making and Construction of Wills, and the Effect of Extrinsic Evidence Upon Such Construction; With Forms and Instructions for Preparing Wills The Second Part of the work, which is confined to the practical detail of the Settlement of Estates, and the crea tion, construction, and administration of Testamentary Trusts, including Devises and Legacies, is nearly ready for the press, and may be expected in a few months. Some few of the topics discussed in Jarman will more naturally fall into this portion of the work. It is scarcely necessary for the author to say much of the character of his work, since that must depend more upon-the work itself, than upon any. Thing which may be said of it, even by the most disinterested. But it may not be improper to give an outline of what has been attempted. It has been the purpose of the writer to refer to all the leading or important English cases upon the several topics discussed, and to give the precise point determined, either in the text or the notes. And where there was any con ict in the decisions, it has been his purpose to give the history of the different classes of authorities, in such a manner, as to present the true principle to be ex tracted from all the cases bearing upon the point. And upon every point to bring the cases down to the latest moment, so as to give the true state of the English and American law at the time of publication. In this way, it is believed, the work will be found to present in a compact and perspicuous form, the elementary principles involved; and at the same time such a digest of the decided cases, as to become a useful commentary upon the subjects discussed, and a reliable guide, both for the student and the practitioner. All such volumes were clearly written and prepared from collated decisions few enough as compared with those of the present day. With health and favoring opportunity I have lately condensed and reduced to this new basis one after another of my law treatises, long known to the public If any of them ever grow protuberant or costly again it will be through the labors of some other annotator or reviser. For myself, I may consider that, with the issue of this final volume, I have rounded to a close a long and busy professional career, as practitioner at the bar. Book excerpt: Excerpt from Wills, Descent, and Administration Impressed by the excellence of the case system as a means of legal education, but convinced that no satisfactory adjustment of the con fliet between training and knowledge under existing time restrictions has yet been found, the General Editor takes pleasure in announcing a series of scholarly casebooks, prepared with special reference to the needs and limitations of the class - room, on the fundamental sub jects of legal education, which, through a judicious rearrangement of emphasis, shall provide adequate training combined with a thor ough knowledge of the general principles of the subject. The collee tion will develop the law historically and scientifically; English cases will give the origin and development of the law in England; Ameri can cases will trace its expansion and modification in America; note.c and annotations will suggest phases omitted in the printed case Cumulative references will be avoided, for the footnote may not hope to rival the digest. The 'law will thus be presented as an organic growth, and the necas sary connection between the past and the present will be obvious. Book excerpt: Excerpt from The Law of Wills and the Administration of Estates This volume is a revision and an enlargement of Notes on the Law of Wills and the Administration of the Estates of Deceased Persons published by me seven years ago. That work was the publication in book form of lectures on the sub ject which I had delivered yearly to the senior class of the Kansas City School of Law. It was confined in its citations mainly to the law of Missouri and Kansas. It proved a very useful book both for students and practitioners. The present volume is an enlargement of that work by in cluding all of the leading cases in this country and in Eng land on the subject. It is intended to make this the best one volume work on the subject. It contains a concise statement of all the principles, in language supported by authority. It contains also an exposition of the reason and relative bearing of the rules. In other words, it is designed to be what the lawyer and student need - a text book which places them in possession of the subject, and not a running digest of ill assorted cases. It will be found of especial value to the Western lawyer and student, as it cites every case and discusses every rule em bodied in the common or statute law of the following group of states: Missouri, Arkansas, Nebraska, Kansas, Oklahoma, Texas, Wyoming, Colorado, New Mexico, Arizona, Utah, Ne vada, and California. It cites, also, every case bearing upon the subject decided in the Federal Courts, including the Su preme Court of the United States, the Circuit Courts of Ap peals, the Circuit and District Courts, the territorial courts, and the courts of the District of Columbia. Book excerpt: Excerpt from The Principles of the Interpretation of Wills and Settlements Lastly, we desire to point out that this Book is not intended to be a compendium of case law on the subject. The works of the late Mr. Jarman, Mr. Theobald, k.c., and Mr. Norton, k.c., leave no room for such a work. All that we have sought to do is to extract from the mass of authorities a set of broad general principles, and to illustrate these principles by a selection of cases. Where no general principle can be gathered (as in the construction of par ticular words) we have not endeavoured to trace an imaginary road through the Wilderness of single instances, believing that too often such labours are the result of intellectual mirage. In these cases we have, therefore, contented our selves with giving in the glossary a reference to the more modern decisions.
