Available in PDF, EPUB and Kindle. Book excerpt: In 1986, the Supreme Court's leading conservative, William H. Rehnquist, labeled by Newsweek as "The Court's Mr. Right," was made Chief Justice. Almost immediately, legal scholars, practitioners, and pundits began questioning what his influence would be, and whether he would remake our constitutional corpus in his own image. Would the center hold, or fold? This collected volume, edited by Martin H. Belsky, is the third in a series which includes The Warren Court and The Burger Court, both edited by Bernard Schwartz. It gathers together a distinguished group of scholars, journalists, judges, and practitioners to reflect on the fifteen-year impact of the Rehnquist Court. The work provides an overview of the Rehnquist Court's influence to date, examines in detail the seminal issues confronted by the Court, and places the Court in broad historical perspective. Subjects discussed include First Amendment rights and cyberspace, criminal justice reform, the Court's pattern of constitutional interpretation, the international impact of the Rehnquist Court, and the Supreme Court's increasing interaction with state constitutional law. A comprehensive look at the significant shifts in constitutional jurisprudence under Rehnquist's leadership, this volume illustrates how the Rehnquist Court has brought us almost full-circle from the judge-made revolution of the Warren Court. A must-have for all students of the Court and legal history, this book contains fascinating insights into one of the century's most controversial courts and a legacy still in the making.

Available in PDF, EPUB and Kindle. Book excerpt: Economic analysis rarely appears on the judicial horizon in intellectual property litigation. In competition cases, by contrast, economists are familiar figures in the courtroom and the language of economics is scattered throughout the judgments of even the highest courts. One might expect, therefore, that refusals to license intellectual property would generate the same fruitful symbiosis between law and economics when those refusals surface in competition proceedings. This however, has not been how the law on this subject has developed in most jurisdictions. Courts and enforcement agencies faced with a unilateral refusal to license have instead tended to retreat into sketchily articulated black letter rules and presumptions which then have to be fenced off from the rest of competition law by economically irrelevant qualifications and distinctions based on private law categorisations of, and rationales for, individual intellectual property rights. This bypassing of case-by-case analysis in favour of more traditional modes of legal reasoning is not entirely the fault of lawyers. Economists have contributed to this state of affairs by urging judges and regulators to convert empirically undernourished theories about the proper role of intellectual property in a market economy into rules of law and evidentiary presumptions intended to be binding in future cases. How this came about and what it means for the future of effective competition enforcement globally are the twin concerns of this book.

Book excerpt: The second edition of Illinois Legal Research shows how to find and stay current with Illinois cases, statutes, regulations, and local court rules. Focusing on state materials, it can be used as a supplement to national research texts or on its own to learn legal research. This book also explains how to locate secondary materials specific to Illinois law. Although the text was designed primarily for law students, seasoned attorneys will also appreciate the many secrets of Illinois legal research disclosed in this text. Wojcik's book includes materials on citing Illinois law sources under the Bluebook (for both law review formats and practice documents), the ALWD Manual, and local court rules. It is an essential book for any Illinois law library. This book is part of the Legal Research Series, edited by Suzanne E. Rowe, Director of Legal Research and Writing, University of Oregon School of Law. "The time was ripe for someone to step up and produce another great legal research book for Illinois. Professor Mark E. Wojcik has done just that... [He] has provided what should be a very useful tool for anyone conducting state-specific research in Illinois. Professor Wojcik has taken great pains to avoid glossing over the special sources commonly used in Illinois. In fact, legal researchers can use this book in conjunction with a standard national legal research text to suit all their needs." -- Phill Johnson, Illinois Bar Journal, on the first edition "Not only is it perfect for law students, new lawyers, paralegals and lawyers new to Illinois, but it is also ideal for experienced practitioners who may have forgotten about basic research tools--or those who may never have learned about them. [Wojcik] is witty, and he is thorough; he is creative, and he is careful. He teaches without being a bore--or a boor." -- Bonnie McGrath, CBA Record, on the first edition "A second helping is even more satisfying. When John Marshall Law School professor Mark Wojcik published his first [edition] in 2003, this magazine reviewed it and gave it a big thumbs up. With the Second Edition, Wojcik's winning ways continue... Wojcik knows all the sources of Illinois law, it seems. The latest edition shows why a state-specific research book earns its space on a practitioner's bookshelf." -- Kathleen Dillon Narko, CBA Record

This book was released on 2019-01-29 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: Award-winning author Philip K. Howard lays out the blueprint for a new American society. In this brief and powerful book, Philip K. Howard attacks the failed ideologies of both parties and proposes a radical simplification of government to re-empower Americans in their daily choices. Nothing will make sense until people are free to roll up their sleeves and make things work. The first steps are to abandon the philosophy of correctness and our devotion to mindless compliance. Americans are a practical people. They want government to be practical. Washington can’t do anything practically. Worse, its bureaucracy prevents Americans from doing what’s sensible. Conservative bluster won’t fix this problem. Liberal hand-wringing won’t work either. Frustrated voters reach for extremist leaders, but they too get bogged down in the bureaucracy that has accumulated over the past century. Howard shows how America can push the reset button and create simpler frameworks focused on public goals where officials—prepare for the shock—are actually accountable for getting the job done.
