Il contesto in cui si sviluppa una transazione con l'estero è, infatti, caratterizzato dalla diversità di sistemi giuridici, dalla diversità di norme, di consuetudini, di significato attribuito a termini di uso comune che suggeriscono un esame attento delle diverse clausole contrattuali per ricercare quelle più idonee. Le componenti valutarie, finanziarie, creditizie, logistiche e commerciali, gli usi e le consuetudini, la scelta dei termini di consegna delle merci, le forme di pagamento in uso nei singoli Paesi possono, infatti, incidere in misura rilevante nella determinazione della natura e del contenuto del rapporto contrattuale. Nel volume sono approfondite le normative che interessano l'operatore italiano impegnato nel recupero di somme di denaro all'estero. Si esaminano il quadro normativo in vigore nell'Unione Europea, le norme italiane di diritto internazionale privato e processuale nonché le principali disposizioni di diritto uniforme relative alla vendita di beni mobili previste dalla Convenzione di Vienna. Si analizzano poi le disposizioni in essere in alcuni principali Paesi del mondo, ossia gli USA, la Cina, il Brasile, l'India, la Turchia e la Russia. Book excerpt: Italian banks are burdened with high levels of nonperforming loans, the cleanup of which depends in important part on the efficiency of insolvency and enforcement processes. Traditionally, these processes in Italy have taken very long, hampering the timely cleanup of balance sheets. In response, the authorities have legislated a number of measures. This paper explores the recent insolvency and enforcement reforms and the remaining challenges. These reforms introduce important positive changes that are expected to yield full benefits over the medium to long term. The efficacy of the reforms, including to deal with the current stock of high nonperforming loans, can be enhanced by introducing effective out-of-court enforcement mechanisms, supplemented by a more intensive use of informal and hybrid debt-restructuring solutions. Moreover, there is an urgent need to rationalize the system, which over the years has become very complex and intricate.

First, we estimate the direct firm-level impact of a substantial increase in domestic carbon prices under severe assumptions. Second, we map the impact of a drastic increase in global carbon prices on the domestic economy via the Norwegian oil sector. Third, we model the impact of a forced reduction in Norwegian oil firms’ output on shareholder portfolios. Results show that such a sharp increase in carbon prices would have a significant but manageable impact on banks. Finally, the paper discusses ways to advance the still evolving field of transition risk stress testing.

Book excerpt: Concentration risk is an important feature of many banking sectors, especially in emerging and small economies. Under the Basel Framework, Pillar 1 capital requirements for credit risk do not cover concentration risk, and those calculated under the Internal Ratings Based (IRB) approach explicitly exclude it. Banks are expected to compensate for this by autonomously estimating and setting aside appropriate capital buffers, which supervisors are required to assess and possibly challenge within the Pillar 2 process. Inadequate reflection of this risk can lead to insufficient capital levels even when the capital ratios seem high. We propose a flexible technique, based on a combination of “full” credit portfolio modeling and asymptotic results, to calculate capital requirements for name and sector concentration risk in banks’ portfolios. The proposed approach lends itself to be used in bilateral surveillance, as a potential area for technical assistance on banking supervision, and as a policy tool to gauge the degree of concentration risk in different banking systems.
