Book excerpt: Although the vast majority of persons applying for and using identity and travel documents do so for lawful purposes, they are also used by terrorists, for whom they constitute an important tool. Genuine identity documents in particular, obtained through lawful procedures, are vital to terrorists' operational success. Recommendation Rec(2005)7 of the Committee of Ministers to member states concerning identity and travel documents and the fight against terrorism therefore aims to ensure the proper, rapid and reliable identification of individuals, in particular as regards the issuing of such documents. It calls on member states to take measures to strengthen the security of identity and travel documents and indicates the appropriate course of action to take when such documents are lost stolen. The recommendation also contains provisions dealing with proof of identity as well as registration of birth and issuance of births certificates, which are necessary to obtain identity and travel documents. Finally, the recommendation contains provisions dealing with international co-operation calling for the exchange of information with other member states and with international law enforcement bodies, in particular regarding lost or stolen identity and travel documents, whether issued or blank.

Book excerpt: Volume 108 of Terrorism: Commentary on Security Documents tackles the contentious issue that appears in the volume's title: "Extraordinary Rendition". Although many commentators and publications have focused on the U.S. policy of such troubling transfers, little focus has been devoted to the reaction to this policy by the rest of the world. In this volume, new General Co-Editor Aziz Huq both presents the key documents demonstrating that reaction and comments authoritatively on what those documents mean for the future of torture-based international transfers. For ease of research, Huq has divided the volume into two sections: the first deals with U.N. and E.U. responses to the U.S. policy, including a case before the U.N. Committee Against Torture, and the second section tours the reports and cases on rendition that have arisen from national jurisdictions, specifically Italy, Sweden, the U.K., ireland, and Canada.

Book excerpt: International anti-terrorism measures existed long before 11 September 2001 but have increased markedly since. A myriad of norms in different branches of law are now deployed to confront transnational and domestic terrorism. There is also a proliferating body of 'soft law' addressing terrorism, stemming from United Nations organs, specialised international bodies and regional organisations. It is timely to draw together these diverse legal developments over time into a single reference work. Bringing the original documents together provides for ease of reference and enables scholars, practitioners and students to more easily compare and contrast various sources. The book's coverage is comprehensive (thematically, organisationally, geographically and temporally) and open to a balance of sources (hard and soft), but is judicious in its selection and prioritisation of the most significant and representative documents - in a field where there are many repetitive or insubstantial documents. Importantly, the book looks beyond the traditional trans-Atlantic bias towards European, British and American sources in this area to include materials from Asia, Africa, Latin America and the Middle East. Taken as a whole, the book aids in evidencing the emerging field of international anti-terrorism law.

Book excerpt: Two investigations by the Parliamentary Assembly into the High Value Detainee (HVD) program set up by the U.S. administration after the attacks of September 11 revealed numerous serious human rights violations. It was only able to function through the cooperation of certain Council of Europe member states, despite the fact that they are bound by European human rights onventions. The European Commission for Democracy through Law includes its expert legal opinion on general international legal principles and the responsibility that Council of Europe member states would incur if they, either deliberately or by negligence, failed to meet their obligations.--Publisher's description.

The work assesses the role of the United Nations and its various organs, particularly the General Assembly and the Security Council, and discusses the key legal issues. The second part of the book examines the activity of regional organizations both in their own right as well as their interaction with the UN. The volume concludes with a discussion of whether, to what extent and how the fight against terrorism has encroached upon fundamental rules of international law such as the international protection of human rights or the use of force among states. The volume is the latest in a series drawing on the presentations of high ranking scholars, diplomats and representatives of international organizations. The result is a stimulating and thought-provoking book which will be of interest to researchers and policy-makers alike.

Available in PDF, EPUB and Kindle. Book excerpt: This book includes the proceedings of the North Atlantic Treaty Organization’s (NATO) 2008 Advanced Research Workshop (ARW). The goal of the meeting was to explore methods to involve the community in the fight against terrorism in an effort to enhance its protection from terrorist attacks and to establish a network between the participants for future collaborations. The two main topics of this book are: (1) Defining the problem of terrorism and collective community protection; why does terrorism exists and why do people join and/or support extremist groups? (2) Counter-terrorism practices and their relation to the community; focused on developing non-orthodox methods to combat terrorism. In other words, why communities should be included in the fight against terrorism. This book should be seen as a guide for policy makers and practitioners to gain a better understanding of how counter terrorism, as well as many other applications, requires community support and involvement to the fullest extent possible. Because the existing threat of terrorism is proof of the failed classical militaristic approaches, the time has come to integrate our communities into the practice of fighting the threat together.

Opportunities have developed during the pre- and post-9/11 periods in Africa for the recruitment of terrorists, attainment of bases of operations and sources of funding for Al Qaeda or its affiliated terror groups. This comprehensive volume provides an extensive examination of major terrorist events in Africa. It highlights internal and external indices to illustrate why Africa is so ripe for terrorism, ostensibly in terms of recruitment as well as attainment and sources of funding due to the continent's continuing poverty and corruption. The volume will prove indispensable reading for anyone researching security issues, political sociology and African studies.

Available in PDF, EPUB and Kindle. Book excerpt: This volume of essays, situated at the interface between legal doctrine and legal and political philosophy, discusses the conceptual and normative issues posed by the right to inclusion and exclusion the EU claims for itself when enacting and enforcing immigration and asylum policy under the Area of Freedom, Security and Justice. In particular, the essays probe how this alleged right acquires institutional form; how the enactment and enforcement of the EU's external borders render possible and undermine the claim to such a right; and how the fundamental distinctions that underpin this alleged right, such as inside/outside and citizen/alien, are being disrupted and reconfigured in ways that might render the EU's civic and territorial boundaries more porous. The volume is divided into three parts. A first set of essays delves into the empirical aspects that define the institutional context of the EU's alleged jus includendi et excludendi. A second set of essays is theoretical in character, and critically scrutinizes the basic distinctions that govern this alleged right. The third set of essays discusses politico-legal alternatives, exploring how the conceptual and normative problems to which this alleged right gives rise might be dealt with, both legally and politically. The contributors to the volume are Peter Fitzpatrick, Bonnie Honig, Dora Kostakopoulou, Hans Lindahl, Valsamis Mitsilegas, Helen Oosterom-Staples, Bert van Roermund, Jo Shaw, Bernhard Waldenfels, Neil Walker and Ricard Zapata Barrero. The volume also includes a comprehensive introduction by the editor, highlighting systematic connections between the three parts and individual essays which comprise it.

Book excerpt: The Oklahoma City bombing, intentional crashing of airliners on September 11, 2001, and anthrax attacks in the fall of 2001 have made Americans acutely aware of the impacts of terrorism. These events and continued threats of terrorism have raised questions about the impact on the psychological health of the nation and how well the public health infrastructure is able to meet the psychological needs that will likely result. Preparing for the Psychological Consequences of Terrorism highlights some of the critical issues in responding to the psychological needs that result from terrorism and provides possible options for intervention. The committee offers an example for a public health strategy that may serve as a base from which plans to prevent and respond to the psychological consequences of a variety of terrorism events can be formulated. The report includes recommendations for the training and education of service providers, ensuring appropriate guidelines for the protection of service providers, and developing public health surveillance for preevent, event, and postevent factors related to psychological consequences.
