Book excerpt: This is a study of the legal framework on criminal measures on trafficking and/or smuggling and facilitating illegal entry in six Member States: France, Germany, Italy, the Netherlands, Spain and the UK, and the European Union. This issue is at the nexus of migration and criminal law. The system of criminal law in the Member States is a central part of the balance of the powers of the authorities and the rights of the citizen. The way in which civil liberties of the individual are weighed in comparison with public protection duties by the authorities is in essence a constitutional issue. The treatment of foreigners, in particular as regards their entry onto the territory and residence is not part of the constitutional settlements, but a field governed by state discretion and exceptionalism. The rules and administrative measures regarding entry, residence and expulsion of foreigners is not subject to the same civil liberties guarantees of due process as apply in criminal law. This comparative study examines how, in each Member State, the insertion of immigration into criminal law takes place. Do the rules of criminal law in respect of due process take precedence over the lower evidential and procedural requirements which are applied in the field of immigration? How does the criminal justice system deal with this new field where central constitutional issues are not present? There are two levels on which the insertion of immigration into criminal law takes place – the legal and the social. This book deals with both. On the one hand it looks at the laws and the court decisions on criminal trials in respect of immigrants for immigration related offences, on the other hand it looks at how the society (political actors, media, interest groups etc) discuss and develop this issue. This book is designed for policymakers, academics, students and activists concerned about the European Union.

It is generally agreed that the performance of the Macchi was superior to both the Hawker Hurricane and the Curtiss P-40 Kittyhawk and on a par with the Supermarine Spitfire Mk. V. It is not by chance that virtually all the Italian top scoring aces flew this plane either with the Regia Aeronautica or the Aeronautica Nazionale Repubblicana. At the same time, the Mc.202 is the symbol of the dysfunctions in the Italian military-industrial complex: the lack of sound industrial planning resulting in orders from the Regia Aeronautica for an exaggerated number of different aircraft; the lack of the development of adequate engines limiting aircraft performance and reducing capacity to house weapons with a proper punch; the corruption of politics and the culpable connivance of the high military spheres. The Mc.202 was therefore produced in limited numbers, while there is consensus that air war, especially in the African theatre, would have been different had the aircraft been adopted before.

The Hungarian Marxist critic Georg Lukács is primarily known as a literary theorist, but he also wrote extensively on the cinema. These writings have remained little known in the English-speaking world because the great majority of them have never actually been translated into English – until now. Aitken has gathered together the most important essays and the translations appear here, often for the first time. This book thus makes a decisive contribution to understandings of Lukács within the field of film studies, and, in doing so, also challenges many existing preconceptions concerning his theoretical position. For example, whilst Lukács’ literary theory is well known for its repudiation of naturalism, in his writings on film Lukács appears to advance a theory and practice of film that can best be described as naturalist. Lukácsian film theory and cinema is divided into two parts. In part one, Lukács’ writings on film are explored, and placed within relevant historical and intellectual contexts, whilst part two consists of the essays themselves.
