Book excerpt: Il volume aggiorna “Tipologie contrattuali e disciplina delle mansioni” in relazione alle sole discipline sui contratti di lavoro subordinati, arricchendosi di una ragionata analisi sui contratti di lavoro autonomo. Il primo capitolo è dedicato alla disciplina del lavoro a tempo parziale, analizzata con particolare attenzione alle flessibilità temporali, nell’intreccio tra disciplina legale e collettiva, e al part-time ‘scelto’; questioni che incidono sul delicato equilibrio tra le esigenze di flessibilità delle imprese e la garanzia, per le lavoratrici e i lavoratori, di posizioni soggettive di rilevanza costituzionale. Il capitolo secondo analizza il lavoro intermittente, soffermandosi sulle numerose questioni dibattute: l’esistenza di una duplice tipologia; la natura del rapporto di lavoro in assenza di obbligo di disponibilità; l’incertezza della tutela di carattere lavoristico costretta a modellarsi in base all’alternanza tra periodi di lavoro e periodi di non lavoro. Il terzo capitolo è incentrato sulle regole che governano l’utilizzo del contratto a tempo determinato, frutto di modifiche legali contraddittorie, evidenziandone criticità e prospettive evolutive anche in chiave applicativa e si conclude con l’esame della disciplina vigente nel lavoro pubblico contrattualizzato. Il capitolo quarto ha ad oggetto la somministrazione di lavoro che è stata più volte modificata con interventi normativi anche di segno opposto: dalla liberalizzazione varata con il Jobs Act del 2015 ai vincoli introdotti con il c.d. decreto dignità del 2018 che rendono la disciplina vigente complessa e densa di numerose questioni teoriche ed applicative. Il quinto capitolo analizza la disciplina del contratto di apprendistato, approfondendo le molteplici questioni interpretative esistenti, anche in considerazione delle molteplici fonti regolative legittimate ad operare. La limitata diffusione dell’istituto induce a dedicare cenni pure ai limiti della regolamentazione: quella che concerne il contratto di apprendistato, come quella invece rivolta all’insieme dei contratti di lavoro flessibili. Il sesto capitolo affronta la vicenda del lavoro occasionale, attraversata da una serie di riforme nell’arco di un decennio, sino all’abrogazione e alla sua successiva re-introduzione con un nuovo assetto normativo, che ne evidenzia uno sviluppo tutt’altro che trascurabile nel mercato del lavoro italiano e nella realtà economica. Il settimo ed ultimo capitolo, esamina la disciplina delle collaborazioni autonome che, nelle diverse forme delle collaborazioni etero-organizzate e delle collaborazioni coordinate e continuative, ha posto rilevanti questioni interpretative ed applicative. Il contributo fornisce una sistemazione concettuale delle diverse categorie del lavoro autonomo, identificandone le caratteristiche tipologiche e le relative discipline.

Book excerpt: Platform work – in which work activities are channelled through web platforms or apps – has emerged as one of the major transformations in the world of work over the past decade. Although platform work presents many of the labour law issues related to casual work – often linked to insecure or precarious working conditions – until this book, no in-depth research has been conducted on specifically positioning platform work in the context of casual work arrangements. The author systematically evaluates how strategies aimed at regulating casual work can be extended to enhance the employment relationships and working conditions of platform workers. The analysis proceeds through a detailed comparative legal analysis of casual work in four industrialized countries – the United Kingdom, the Netherlands, Belgium, and Italy – shedding light on the divergent regulatory approaches to this work typology. Then, it moves on to EU legislators’ efforts to develop a regulatory matrix on casual work, focusing on directives such as those on fixed-term work, working time, and transparent and predictable working conditions. The author concludes with recommendations for redefining the EU legal initiative on platform work, in light of the national and EU legal instruments examined in this contribution. Issues, such as the insecure nature of work, unpaid stand-by time, and work insecurity, come to the fore. The purpose of this book is to assist policymakers and social partners in finding viable legal solutions to tackle some of the labour protection challenges posed by platform work. At the same time, it serves as a reminder to EU policymakers, that existing legal instruments on casual work constitute an available blueprint which could be beneficial in dealing with such regulatory problems. Issues and topics covered, in a nutshell, include the following: what is captured under the label of casual work arrangements; the shared features between casual work and platform work, with a focus on their insecure working conditions; the employment status insecurity; the insecurity of working hours; the uncertainty of the continuity of employment; the income insecurity; peculiar traits of platform work; the development of the EU regulatory matrix on casual work; the relevance of the directives on working time, fixed-term work, and transparent and predictable working conditions, for the protection of platform workers; and the improvement of the proposal for a Platform Work Directive in light of the above instruments.

Barbara Furlotti presents a dynamic interpretation of the early modern market for antiquities, relying on the innovative notion of archaeological finds as mobile items. She reconstructs the journey of ancient objects from digging sites to venues where they were sold, such as Roman marketplaces and antiquarians’ storage spaces; to sculptors’ workshops, where they were restored; and to Italian and other European collections, where they arrived after complicated and costly travel over land and sea. She shifts the attention away from collectors to peasants with shovels, dealers and middlemen, and restorers who unearthed, cleaned up, and repaired or remade objects, recuperating the role these actors played in Rome’s socioeconomic structure. Furlotti also examines the changes in economic value, meaning, and appearance that antiquities underwent as they moved trhoughout their journeys and as they reached the locations in which they were displayed. Drawing on vast unpublished archival material, she offers answers to novel questions: How were antiquities excavated? How and where were they traded? How were laws about the ownership of ancient finds made, followed, and evaded?
