The Missouri question is prob ably not yet closed; the principle on which it turns is certainly not settled. Further attempts are to be made to wrest from the new States about to enter into the American Confederacy the power of regulating their own concerns. The tariff question is again to be agi tated. The usurpation of a Federal power over roads and canals is again to be attempted and again to be reprobated. That charter (of the Bank) has been justified by the Supreme Court, on principles so bold and alarming, that no man who loves the Con stitution can fold his arms in apathy principles calculated to give the tone to an acquiescent people, to change the Whole face of our Government, and to gen erate a thousand measures which the framers Of the Constitution never anticipated. The period bor rows new gloom from the apathy which seems to reign over SO many of our sister States. The very sound of state-rights is scarcely ever heard among them. In his Tyranny Unmasked, in 1822, Taylor denounced the judicial power, and set forth the doctrine that whenever the Constitution Operates upon collisions between individuals, it is to be construed by the Court; but when it operates upon collision between political departments, it is not to be construed by the Court. This is the first reported case in the United States where the nullity of an unconstitutional law was discussed before a judicial tribunal. It is the first great American precedent. Sec 4 Call's Virginia Reports, page 5. In 1803 the Supreme Court of the United States held that, "The powers of the legislature (Congress) are defined and limited; and, that those limits might not be mistaken or forgotten, the Constitution is written." This is the first instance in which an act of Congress was held unconstitutional, and the first in history wherein a court called in question an act of a national legislature. See Marbury vs. Madison, I Cranch, United States Reports, 162. The American people have since believed that the principles thus announced and since followed are essential to their rights and liberty. Diplomacy has been reinforced by a variety of agencies to accomplish this purpose, but between the breakdown of diplomacy with its various adjuncts and the outbreak of war an effective remedy must be interposed if the peace of the world is to be preserved. The framers of the more perfect union of the American States felt the failures of diplomacy and were unwilling to assume the risk of war in the settlement of their controversies. For about a century and a quarter the Supreme Court of the United States has been entrusted under the Federal Constitution with the decision of such controversies between the States of the American Union. Since it has worked under peculiar conditions and within a very restricted area the student will see that inferences drawn from its history can only be applied with considerable qualification to any Court of the Nations that may hereafter be set up. But a single additional Obser vation seems proper and necessary. I am aware that the review of judicial decisions, which I have given somewhat at length, is a wide departure from the ordinary course of biographical writing. 1 have not entered upon it, however, without due reﬂection and design. A main object in undertaking this work has been to trace something like a history of the United States Supreme Court, and to present a brief and succinct, but connected, view Of the Con stitutional jurisprudence of the United States; and I knew of no more agreeable and interesting mode of doing this than by combining it with sketches of the public and professional lives of those eminent men who have from time to time presided in the Supreme Federal tribunal. I have attempted thus to unite judicial and constitutional history with biography. This has enabled me to take a wider and more general view of the entire subject to embrace within these sketches not only those matters which are properly the subject of the memoirs of a life, but also to trace the history of the Federal judiciary from its earliest beginnings; to consider the facts and results con nected with the adoption of the Federal Constitution, and to review, or notice, more or less fully, most of the important Constitutional questions which have been discussed in the Supreme Court from the foundation of the government to the present time.
