The President, without consulting Congress, early assumed the task of initiating measures for restoring the rebel States to their practical relations to the Government. On entering upon that work, the President assured hesitating political friends that he was entering upon an experiment; that if it failed, the power to correct errors and mistakes would remain in Congress. The policy inaugurated by the President placed the rebellious States, that were without civil governments when hostilities ceased, completely under the control of the active supporters of the rebellion. Instead of referring the whole matter to Congress, the President assumed that his policy was eminently successful. He resolved to adhere to it, leaving to Congress simply the question of passing upon the qualifications of Senators and Representatives. It was in the middle of an endless Ohio forest, a world away from civilization. Indians said a bird could fly from the Ohio River to Lake Erie never having to land on the ground. Mud Run was so deep into the forest that it seemed unlikely that anyone lost there could in a single lifetime win national fame and fortune. There were clues in Samuel Shellabargers early years that suggest he might surely rise above this wilderness. Shellabargers inspiration for a new America was a religious belief that "God had created of one blood all the peoples of the earth" and all were equal in God's sight, whether he or his father wanted it to be so or not. The nation, he believed, for its own sake, should embrace equality before the law or dire consequences would result. The nation's founders had declared that all men were equal but failed to achieve equality in practice. His generation was called upon to correct the mistake. But they let the opportunity slip from their grasp and created instead a new America he described as, "not fit to be." Samuel Shellabarger did not become famous, though he almost did. He became instead a footnote in a forgotten story that the nation should have remembered. And America, he believed, missed the only chance it might ever have to preserve democracy in the nation.

Among the figures involved in shaping this new start for the American republic, Lyman Trumbull played an instrumental role. As the chairman of the influential Senate Judiciary Committee, Trumbull advanced the most important legislation of both the Civil War and Reconstruction, including the First and Second Confiscation Acts, the Habeas Corpus Act of 1863, the 1866 Freedmen’s Bureau Act, and the Military Reconstruction Acts. Most significantly, he was the principal author and driver of the Thirteenth Amendment, which abolished slavery permanently throughout the United States. On the basis of the Thirteenth Amendment, he also authored the Civil Rights Act of 1866, the nation’s first civil rights law, which protected the fundamental rights of all Americans, regardless of race, color, or previous condition of servitude. Despite being arguably the greatest legislative architect of America’s second founding, Trumbull later turned his back on the Reconstruction that he helped initiate. Worried that Reconstruction was going too far and lasting too long, he eventually embraced a rigid and uncompromising view of states’ rights, rejecting his own previous defense of the national government’s ultimate power and responsibility to secure the privileges and immunities of US citizenship.
