The Government will continue to reduce the deficit by taking difficult decisions to cut public spending and prioritise investment in infrastructure to deliver a stronger economy and fairer society. Because spending reductions since 2010 have been accompanied by reforms to how services are delivered, crime is at its lowest level in 30 years, school standards have risen and employment is at record levels. The Government will reduce current spending by £11.5 billion in 2015-16, allowing it to increase capital spending plans by £3 billion a year from 2015-16 and by £18 billion over the next Parliament. Without the £3.6 billion savings from the welfare budget in 2015-16 that were announced at Autumn Statement 2012, reductions in departmental spending would have been commensurately higher. The Government will protect spending on health, schools and overseas development - maintaining the vital public services that everyone relies on at home, and supporting the poorest overseas

Additionally, the current structure of the National Offender Management Service (NOMS), which continues to be driven by prison priorities, produces difficulties in reducing re-offending. Book excerpt: Before January 2012, the Ministry generally booked interpretation services directly with individual interpreters, many of whom were listed on the National Register of Public Service Interpreters (NRPSI). This approach was administratively inefficient and the Ministry decided to set up a new centralised procurement system. The Ministry awarded the contract to a company, ALS, that was clearly incapable of delivering. Despite having been warned that ALS was too small to shoulder a contract worth more than £1 million, it went ahead and handed them an annual £42 million national contract. The Ministry did not understand its own basic requirements and ignored the views of interpreters, who had serious concerns about the contract. Capita took over ALS in late 2011. The Ministry needed access to 1,200 interpreters when the contract went live but the company had only 280 properly assessed interpreters willing to work for it. The Ministry, though, still decided to go live nationally in one go. Many of the 'interpreters' it thought were available had simply registered an interest on the company's website and had been subject to no official checks. As a result, the company was able to meet only 58% of bookings causing a sharp rise in delayed, postponed and abandoned trials; individuals being kept on remand solely because no interpreter was available; and the quality of interpreters has at times been appalling. However Capita has only been fined £2,200 to date for failing to meet the terms of the contract. Capita-ALS is now fulfilling more bookings, but it is still struggling

Book excerpt: Evidence suggests that the MoJ did not have a sufficient understanding of the complexities of court interpreting work. Significant concern was revealed that quality standards could be diminished by the imposition of a tiered system to enable a wider pool of interpreters, and by the introduction of lower levels of pay. However, the Department pushed ahead with the contract and failed to properly anticipate or address the potential for problems with Applied Language Solutions' (ALS) capacity to deliver on its promises. ALS, and more recently Capita, has been unable to recruit qualified and experienced interpreters in sufficient numbers. Professional interpreters have largely boycotted the new arrangements and Capita-ALS clearly needed significantly more resources than it had at its disposal. It also only paid lip service to the regulatory duties accepted under the Framework Agreement, yet did not have the capacity to cope with complaints or to implement basic vetting procedures. The MoJ has had to monitor Capita-ALS very closely to secure the level of improvement necessary to make the Agreement workable, and continues to do so. The existing arrangements may not be financially sustainable as Capita is propping up the continuation of the Agreement, which mean that the Department's savings, originally projected to be £15million, are effectively being secured at the company's expense. Actions taken by MoJ also had the effect of hampering the inquiry when HMCTS issued an edict to its staff instructing them not to participate in the Committee's online consultation, established to invite direct observations from frontline staff of the performance of ALS

The strategy uses the framework developed for our counter-terrorist work and has four components: prosecuting and disrupting people engaged in serious and organised crime (Pursue); preventing people from engaging in this activity (Prevent); increasing protection against serious and organised crime (Protect); and reducing the impact of this criminality where it takes place (Prepare). The strategy lists strategic objectives under each of the four areas of work. Tactical operational objectives (e.g. priority crime groups) will be set by the NCA with law enforcement agency counterparts. Earlier this year, the Public Accounts Committee concluded that The Cup Trust had been set up as a tax avoidance scheme. The Cup Trust submitted claims for £46 million Gift Aid on £176 million of payments from participants to the scheme, but gave just £152,292 to charitable causes between April 2009 and March 2013. The Gift Aid claims have not been paid. The Charity Commission did not give sufficient consideration to issues which might have enabled it to open a statutory inquiry into the Cup Trust in March 2011, and that it was slow to appreciate the potential impact of the case on public confidence in charities, which it has a statutory duty to increase. The Charity Commission did not take sufficient account of the scale and nature of the tax avoidance scheme in its case strategy, was narrowly focused on the legal position and paid insufficient attention to the wider issues of public detriment, which it would have been appropriate to pursue further.

They deal with over a million cases a year, employ over 3500 people, and have become a substantial part of the system of justice. Yet, of the 70, only 20 each hear more than 500 cases a year; others are defunct; the quality of their work is variable; and cases take too long. The review has as its four main objectives: (1) to make the 70 tribunals into one Tribunals Service; (2) to make the tribunals independent of their sponsoring departments; (3) to improve the training of chairmen and members in the interpersonal skills required; (4) to enable unrepresented users to participate effectively and without apprehension in tribunal proceedings. The new Tribunals Service would provide a coherence essential if tribunals are to acquire a collective standing to match that of the court system. But there is also a basic need for a change in culture, with a greater focus on the users' needs, and swifter administration based on informality, simplicity, efficiency and proportionality. Without this culture change, the Review questions how tribunals can, as presently administered, find the independence, coherence, economies of scale, consistency, professionalism or IT, to which users are entitled.
