Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this convenient volume provides comprehensive analysis of the law affecting the physician-patient relationship in India. Cutting across the traditional compartments with which lawyers are familiar, medical law is concerned with issues arising from this relationship, and not with the many wider juridical relations involved in the broader field of health care law. After a general introduction, the book systematically describes law related to the medical profession, proceeding from training, licensing, and other aspects of access to the profession, through disciplinary and professional liability and medical ethics considerations and quality assurance, to such aspects of the physician-patient relationship as rights and duties of physicians and patients, consent, privacy, and access to medical records. Also covered are specific issues such as organ transplants, human medical research, abortion, and euthanasia, as well as matters dealing with the physician in relation to other health care providers, health care insurance, and the health care system. Succinct and practical, this book will prove to be of great value to professional organizations of physicians, nurses, hospitals, and relevant government agencies. Lawyers representing parties with interests in India will welcome this very useful guide, and academics and researchers will appreciate its comparative value as a contribution to the study of medical law in the international context.

Book excerpt: This book comprehensively discusses the background to the passing of India's revolutionary Mental Healthcare Act, 2017, offering a detailed description of the Act itself and a rigorous analysis in the context of the CRPD and the World Health Organization (WHO) standards for mental health law. It examines the fine balance, between complying with the CRPD while still delivering practical, humane, and implementable legislation. It explores how this legislation was shaped by the WHO standards and provides insights into areas where the Indian legislators deviated from these guidelines and why. Taking India as an example, it highlights what is possible in other low- and middle-income countries. Further it covers key issues in mental health, identifying potential competing interests and exploring the difficulties and limitations of international guidelines. The book is a valuable resource for psychiatrists, nurses, social workers, non-governmental organizations and all mental healthcare workers in India and anyone studying human rights law.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents important fields of research in public healthcare in India from an interdisciplinary and health systems perspectives. Discussing how the exchange of power between the health justice triad, viz., the State (judiciary as the arm of the State), legal and medical professions, and civil society, cumulatively shapes the outcomes of health justice for citizens, it provides insights into India’s juridico-legal processes and of seeking justice in healthcare. It critically assesses civil society’s counter-hegemonic role in bolstering justice in health care and examines the potential of transforming health care jurisprudence into health justice. Repositioning the social right to healthcare as integral to social citizenship and social justice, and opening avenues for inter-professional and interdisciplinary power discourse in public health policy research, the book is of interest to academics, practitioners, students, researchers, and the wide academic community working in public health care issues broadly.

Book excerpt: Scientific Essay from the year 2006 in the subject Politics - International Politics - Topic: Public International Law and Human Rights, grade: 1,0, Ruhr-University of Bochum (Institute for International Law of Peace and Armed Conflict), course: European Master Programme, 19 entries in the bibliography, language: English, abstract: India stands today at a crucial crossroad in its path towards greater social progress and actualization of children's and women rights, both of which are inextricably linked to each other, and to which the Government - according to the Constitution and ratification of international treaties - is deeply committed. Still, the situation of India's women and children is marked by diversity and persistent disparities and nearly two centuries of colonialism and many more centuries of a rigid caste system, have "maintained a stubborn barrier to meaningful social transformation." International human rights law has been designed to protect the full range of human rights required for people to have a full, free, safe, secure and healthy life. Health care is seen as one of the fundamental principles of the global human rights system, and the right to live a dignified life can never be attained without it. Since women and children's health is strongly linked to their status in Indian society, a strong focus must lay on the foundation of women and children's right to health, as it is written down in several international agreements and treaties India has ratified. The primary basis of the United Nations activities to promote, protect and monitor human rights and fundamental freedoms is the International Bill of Human Rights, including the Universal Declaration of Human Rights (1948), the International Covenant on Economic, Social and Cultural Rights (1966), and the International Covenant on Civil and Political Rights (1966) and its two optional protocols. When a State ratifies one of the Covenants, it accepts a solemn responsibility to apply each of

This book was released on 2003 with total page 151 pages. Available in PDF, EPUB and Kindle. Book excerpt: Public health is a core element of governments' attempts to improve and promote the health and welfare of their citizens. Unfortunately, there is evidence that current public health systems and services are not able to cope well with the modern challenges - new technologies, globalization, migration, bioterrorism, etc. In view of this, the WHO Western Pacific Region initiated studies on essential public health functions (EPHFs) in Fiji, Malaysia, and Vietnam. By drawing on research in other parts of the world, a framework and nine EPHFs were derived for these case studies. These nine EPHFs define more clearly and systematically the core areas of public health work for which governments are ultimately responsible. These EPHFs are also considered appropriate for further consultation and use in the Western Pacific Region. This publication is aimed at providing EPHF concepts and ideas that will help countries ensure that they develop and sustain a comprehensive approach to public health. The case studies may also provide ideas for other countries on methods that could be used to examine the current functioning of EPHFs and on different approaches for strengthening these essential functions in different health systems.
