Book excerpt: Laws governing the criminal justice system's response to domestic violence have changed through the passage of mandated arrest and prosecution policies. However, while arrest rates for domestic violence increased throughout the 1990s and 2000s, these cases continue to receive lenient treatment by our courts. Most are resolved with dismissals. Currel-Dykeman explores if the court community literature can offer a possible explanation to this problem. She analyzes the local legal culture of two courts, a traditional court and a specialized problem solving court to understand how they discuss and process domestic violence cases differently. Court workgroup members were interviewed and candidly spoke about these cases in a way that helped explain the problem.

Available in PDF, EPUB and Kindle. Book excerpt: This volume addresses the varied response to domestic violence in a comparative, international context. The chapters are laid out in a consistent format, to cover: the nature of the domestic violence problem, theoretical explanations, the criminal justice response, as well as health care and social service interventions in each country. The intent of the book is to provide an introduction to the attitudes and responses to domestic violence in various regions, to provide meaningful comparisons and share information on best practices for different populations and regions. There are considerable variations to domestic violence approaches across cultures and regions. In some places, it is considered a “private” or “family” matter, which can help it perpetuate. At the same time, the United States’ approach to domestic violence has been criticized by some as being too focused on the criminal justice system, rather than other types of interventions which aim to keep families intact. This comprehensive work aims to highlight innovative approaches from several regions, important cultural sensitivities and concerns, and provide analysis to identify the strengths and weakness of various approaches. This work will be of interest to researchers in criminology and criminal justice, as well as related fields who deal with domestic violence and violence against women, including sociology and social work, and international justice. Practitioners and policymakers will also find it informative.

Book excerpt: This comprehensive, two-volume work examines domestic abuse in the United States and worldwide, providing research, personal stories, and primary documents that reveal the extent of the problem. An estimated 1,300 to 1,800 Americans are murdered by intimate partners each year. Far from being a problem that only impacts women, domestic violence hurts society as a whole both socially as well as financially, with an estimated direct and indirect cost of nearly $6 billion annually in the United States. This book provides a timely and thorough reference for educators, students, scholars and activists seeking to better understand the global issue of domestic abuse. The entries document the history of the domestic violence prevention movement, provide explanations for abuse, identify warning signs of hidden abuse, describe types of victims and offenders, and supply information on interventions and prevention programs. Written by an array of experts in the field, the book also integrates the personal stories of survivors and addresses abuse as a global issue by covering topics such as acid attacks and female genital mutilation.

Book excerpt: A unique and comprehensive collection of sources including published appellate cases and law review articles but also selections from the fields of sociology, psychology, and anthropology. Samples of current legislation, Congressional memoranda, restraining order forms, and articles from the popular press, including newsletters and brochures from hard-to-obtain sources are included. Ms. Lemon has taught this course since 1988 and has written many pioneering pieces of legislation in this area. The materials are comprehensive in examining different points of view on the subject of domestic violence law. They help the student explore the tension between theory and practice, a critical point in teaching this subject. A historical perspective is given so that students can see both the ways the laws have changed over the past century and also the ways they have not changed. This reader lends itself to discussions of the role of the attorney in crafting the law, not simply following it.

Book excerpt: Based on a literature review, consultation with experts in the field, and onsite study of individual programs, this report outlines the roles which police, prosecutors, probation officers, and judges can perform to improve the handling of domestic assault cases. Following a discussion of the myths and assumptions associated with domestic violence, general recommendations cover the role of legislation and action steps for criminal justice agencies. Some action steps recommended are the designation of domestic violence cases as high priority, written policies for handling such cases, procedures to ensure employee compliance with written policies, the collection of separate data on domestic violence incidents, and interagency coordination in the handling of domestic violence cases. A chapter on the police role in domestic violence cases addresses written policies, the service call, arrest policy, the enforcement of protection orders, victim assistance, investigation, and training. A chapter with guidelines for prosecutors addresses the domestic violence unit, written policies, charge filing, pretrial release and diversion, plea bargaining, and victim support and protection. Another chapter covers trial procedures, sentencing options, and the role of probation officers following conviction. Other topics discussed are court-ordered counseling and education for batterers and community education and outreach. The casebook maintains its rich focus on examining domestic violence through a variety of theoretical, practical, and interdisciplinary lenses and remains the most comprehensive casebook on domestic violence. This book is widely used in law school courses and clinics on domestic violence, heavily adopted in undergraduate and graduate courses, and routinely relied upon by judges, attorneys, and other professionals who work in the field. The Second Edition captures the tremendous growth in domestic violence law and includes the many recent Supreme Court cases implicating domestic violence, including Crawford v. Washington, Davis v. Washington, Dixon v. United States, Georgia v. Randolph, Ayotte v. Planned Parenthood of Northern New England, and Castle Rock v. Gonzales. The new edition emphasizes the current expansion of case law and contains updated notes with practical problems. It adds three new chapters: sexual autonomy, reproductive rights and domestic violence; evidence in domestic violence cases and immigration, asylum and domestic violence. It streamlines the family law materials, highlights the most pressing issues in criminal law, and broadens the already significant integration of issues of diversity throughout the book including more materials on the impact of domestic violence on Native Americans, Muslims, teens, and the elderly.
