It is a practical guide that provides templates, tools, best practices, and lessons learned for planning and execution at the theater-of-operations level and below. Its primary purpose is to aid US military commanders and planners to more fully understand their roles and tasks in establishing ROL in fragile states during stability operations, in failed states, or in occupied territory in the immediate post-conflict period. Planning and executing ROL efforts to support military missions and giving legal advice to the commander on those missions are two different functions. While legal professionals are critical participants in ROL activities to support joint operations, planning for operations which include tasks to restore or strengthen ROL is a commander and operational planner responsibility. For purposes of operational awareness and understanding, this handbook addresses many of the linkages between ROL and the legal issues that impact ROL considerations for planning and operations. This handbook supports operational planning that integrates the elements of operational law and other legal issues covered authoritatively in doctrine and discussed in other non-doctrinal publications. This handbook does not answer every question regarding ROL or SSR that may arise in military operations. Strengthening ROL can mean different things to different stakeholders, and the requirements vary depending on the specific operation and the political, geographic, and cultural context in which an operation takes place. This handbook provides JFCs and their staffs with ways to conduct mission analysis, assessments, and interagency coordination that will lead to more comprehensive approaches to build sustainable host nation capacity. ROL and SSR are not exclusively or even primarily military responsibilities; in most cases, these tasks require whole-of government engagement by multiple US Government (USG) agencies, as well as intergovernmental organizations (IGO) and other international stakeholders. This handbook complements other ROL and SSR guidance, including the relevant joint and Service military doctrinal publications, systems governing interagency processes, and civilian guides published by the Department of State (DOS), US Agency for International Development (USAID), and other USG agencies. Additionally, this handbook incorporates the interagency-accepted principles of SSR contained in the Organization for Economic Cooperation and Development (OECD) Development Assistance Committee (DAC) Handbook on Security System Reform.

This handbook is not intended to stand alone as a planning guide, but instead to complement the planning that would be required to better integrate all elements of national capacity in response to an overseas contingency or in support of military engagement, security cooperation, and deterrence activities. Its primary purpose is to aid US joint military planners on a joint force staff to more fully understand their roles and tasks in building or restoring a failed government in the immediate post-conflict period. It is designed to help lay the groundwork for a successful transition between military and civilian authorities in situations where the armed forces for whatever reason find themselves as the de facto governing authority responsible for providing or establishing governance. This handbook describes the nature of situations that will be faced and provides both general guidance on addressing governance problems and contact references to obtain specialized assistance. It stresses that civilians are generally the supported entity for governance-related operations. It does not address the military roles in longer-term democracy and governance development in state-building missions. It also does not detail military support to security sector reform (SSR) or security force assistance (SFA), although both SSR and SFA have important institution-building and governance components. Joint force support to SSR is substantially discussed in the Handbook for Military Support to Rule of Law and Security Sector Reform. The major civilian United States Government (USG), intergovernmental organizations (IGOs), and nongovernmental organizations (NGOs) that play key roles as donors and implementing partners are discussed in the handbook. Understanding the complexity of the "state reconstruction" environment will assist planners in achieving a more unified effort with major stakeholders. This handbook also includes assessment and evaluation tools, lists of crucial planning considerations, military tasks matrices, and principles of practice. Vignettes and case studies, informed from on-the-ground experiences, illustrate key concepts and best practices. A special topics section discusses the strategic relationships between governance operations and counterinsurgency, political reconciliation, SFA, SSR, and ungoverned areas. This handbook does not address specific military tasks in the rare cases where a transitional military authority assumes governing responsibilities. Joint publication (JP) 3-57, Civil Military Operations, and Army field manual (FM) 3-07, Stability Operations, stand as the authoritative references for military governance. Although no longer officially Service doctrine, FM 25-5, the 1943 Army-Navy manual, Military Government and Civil Affairs, provides proven methods to conduct transitional military authority. While this handbook defines and discusses potential military roles related to governance, it does not suggest that US forces will always undertake any or all of these activities in any given operation. Furthermore, the handbook does not advocate military governance but simply seeks to identify the governance-support roles and tasks that military forces have performed in numerous missions. With a more robust task inventory, the planner can anticipate and plan for the full range of possible tasks and the concomitant capabilities required in the post-conflict period.
