This book was released on 2017-02-07 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: Native title involves an interface between the Australian legal system and Indigenous legal, cultural and political systems. The assertion and management of native title rights involves collective action by sometimes large and disparate groups of Indigenous people. Contentious politics makes such collective action difficult and the courts will often be asked to decide whether group decisions have been validly made. In the last two decades a vast and complex body of law and practice has developed to address this challenge. Authorisation law is a set of principles about how the views and intentions of native title claimants or holders are translated into legally effective decisions. This book sets out the legal rules and their application in various situations: native title claims, native title agreement-making, decision-making by native title corporations, and compensation applications. It also addresses key practical, ethical and political dimensions of native title decision-making. This book will be useful for native title practitioners including lawyers, judges and native title holders. It will also be relevant to academic research into the ethical, political and anthropological dimensions of Indigenous governance.

Book excerpt: This paper attempts to define and assess the various institutional and mechanical elements which constitute a land management system and which have a significant impact on the functioning of land markets. The assumption of this report is that the accumulation over time of different institutions and instruments, which have relfected different priorities and policies, has inhibited the efficient and equitalbe operation of land markets and that reforms of institutions and policies are now urgently needed. Book excerpt: This Commentary provides the reader with a review of international standards and practice relating to the political participation of minorities. Political participation has been increasingly recognized as a foundational issue in the debate about minority rights. It is argued that minorities are more likely to feel co-ownership in the state if they have the opportunity to participate freely and effectively in all aspects of its governance, and that sustained and meaningful engagement will guard against the sense of alienation and exclusion among minorities that often emerges in ethnically divided societies. Taking as its starting point the two most important standard-setting documents in the field - the Lund Recommendations on the Effective Participation of National Minorities in Public Life, developed by the Organization for Security and Cooperation in Europe, and the Council of Europe's Thematic Commentary on the Issue of Political Participation of Minorities - the Commentary locates the international legal entitlement to political participation within the wider context of the right to democratic governance. It also considers effective participation in relation to the right to full and effective equality, as well as the legal entrenchment of these provisions and implementation mechanisms. Individual chapters then consider each of the principal mechanisms aimed at enhancing political participation, ranging from procedures covering minority representation in political institutions to consultative mechanisms and autonomy solutions. The Commentary draws on a team of experts, all of whom are recognized authorities in this specialized area of minority issues.

Book excerpt: FAO and the Global Alliance of Geographical Indications (oriGin) have been collaborating since 2016 to develop the Sustainability Strategy for Geographical Indications (SSGI). This strategy for sustainable GIs aims to highlight and strengthen the relationship between GI systems and sustainability, raise stakeholders’ awareness of their role in GI sustainability and boost the sustainability performance of GI systems. Geographical indications (GIs) are signs used on products that originate from a specific territory and possess qualities or a reputation related to that origin. Through their establishment and management, GIs can stimulate endogenous development when ensuring leadership by local producers, product specifications that are tailored to local conditions and recognition by buyers of products’ origin-linked qualities. This guide provides a practical step-by-step roadmap for GI organizations that wish to engage on their own sustainability journey. The roadmap consists of three key stages: 1. prioritize sustainability topics for the GI system and engage with public and private stakeholders; 2. assess needs and establish a baseline for each priority topic; and 3. monitor and improve the GI system’s sustainability performances, and regularly review the roadmap in collaboration with allies. Communication is the fourth crucial and transversal component of the roadmap; it improves efficiency during the process and allows stakeholders to share and celebrate the results. By following the eight steps outlined in this guide, with detailed guidance, examples and models, GI practitioners will be able to design a sustainability roadmap for their GI system, together with stakeholders.
