Book excerpt: The third edition of California Legal Research continues to fill a unique niche in the literature available for California state law research, explaining both the sources of California law and the process of conducting research using those sources. After introductory chapters devoted to the basic research process and research techniques, California Legal Research explores judicial opinions, the state constitution, statutes and legislative history, and administrative law. The book then turns to updating research with Shepard's and KeyCite, using secondary sources and practice guides, and planning a research strategy. A final chapter explains legal citation, with information on the California Style Manual, the ALWD Citation Manual, and the Bluebook. The book should be valuable to a wide range of audiences--from first-year students to seasoned veterans. Outlines of the research process and excerpts from key state sources make the book easy to use. The text includes brief discussions of legal analysis throughout, recognizing the interplay between research and analysis. California Legal Research supplements its detailed discussion of state research with brief discussions of federal research. Thus, it can be used as the sole text in a research course or in conjunction with texts focusing on topical or federal research.

This book was released on 1989 with total page 266 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Huntington Library houses a wealth of material pertaining to legal history. The collections that deal with California law are predominantly from the nineteenth century and involve real estate, agriculture, and industries such as mining, oil, and commerce. For the lawyer of the period, these areas of activity generated a large property and contract law practice. Manuscripts relating to property law involve the acquisition, development, use, and transfer of real estate. Contract law documents in the collections pertain to the transactions of a dynamic era of entrepreneurialism in the nineteenth century. This guide provides access to the collections for scholars and attorneys researching California legal, social, and business history. Compiled by Gordon Bakken, under the direction of the Committee on History of Law in California of the State Bar of California, the guide has been published with the generous support of various foundations, law firms, and attorneys. It will encourage research in legal history and facilitate a deeper understanding of the development of American law. The guide has two main parts, each supporting a very different approach to historical research. The Subject Access Guide is essentially a subject index to relevant manuscript materials at the Huntington. The objective is to lead researchers to individual documents and to sets of documents by their subject. Using subject headings familiar to most attorneys, historians, and other researchers, the guide identifies the type of material, subject matter, and date as well as the location of manuscript sources. The second part of the guide is a description of collections of interest to legal historians. That part assesses the significance of each collection for research purposes.

Available in PDF, EPUB and Kindle. Book excerpt: It is essential to cover California administrative law in an administrative law course in California. First, the clients of California lawyers are much more likely to have disputes with California state and local agencies than with federal agencies. Second, California administrative law is very different from federal law. In virtually every instance, these differences lie in the direction of protecting private business and individual interests rather than favoring the agencies. California Administrative Law is designed as a supplement to be used in the basic administrative law course. It could also be used as the text for an advanced course or seminar in California administrative law.

Book excerpt: Explore the controversial legal history of the formation of the United States Prestatehood Legal Materials is your one-stop guide to the history and development of law in the U.S. and the change from territory to statehood. Unprecedented in its coverage of territorial government, this book identifies a wide range of available resources from each state to reveal the underlying legal principles that helped form the United States. In this unique publication, a state expert compiles each chapter using his or her own style, culminating in a diverse sourcebook that is interesting as well as informative. In Prestatehood Legal Materials, you will find bibliographies, references, and discussion on a varied list of source materials, including: state codes drafted by Congress county, state, and national archives journals and digests state and federal reports, citations, surveys, and studies books, manuscripts, papers, speeches, and theses town and city records and documents Web sites to help your search for more information and more Prestatehood Legal Materials provides you with brief overviews of state histories from colonization to acceptance into the United States. In this book, you will see how foreign countries controlled the laws of these territories and how these states eventually broke away to govern themselves. The text also covers the legal issues with Native Americans, inter-state and the Mexico and Canadian borders, and the development of the executive, legislative, and judicial branches of state government. This guide focuses on materials that are readily available to historians, political scientists, legal scholars, and researchers. Resources that assist in locating not-so-easily accessible materials are also covered. Special sections focus on the legal resources of colonial New York City and Washington, DC—which is still technically in its prestatehood stage. Due to the enormity of this project, the editor of Prestatehood Legal Materials created a Web page where updates, corrections, additions and more will be posted.

Book excerpt: The purpose of this new edition is to update the 8th edition, published by LexisNexis in 2006. Three points to highlight are: this edition is revised chapter by chapter; includes new contributors; and features new illustrations and appendices. This book is designed specifically for California legal research. It is not designed for a California lawyer who practices in Federal Courts or in other state jurisdictions. From the first edition this title has started out with a short overview of the legal research process and then carried that process into the different types of resources that are used in California research: constitutions, statutes, cases, regulations, local government sources, the attorney general, the state bar, law libraries, legal education, and all different types of secondary sources. The legal resources are addressed from both an historical and a current-use perspective. The resources are covered in their print and other alternative formats. The appendices have always given the user helpful bibliographies, charts, directories, and lists of governors, justices, law schools, law libraries, and vendors.--Publisher.
