Although you may have a manual you purchased from the society, this manual must be personalized, updated and followed. If they are relying on their "IT Guy" without vetting him, they may be setting themselves up for a violation or a data breach. A Risk analysis must be redone at a minimum of every year. Because the risk analysis has many technical questions, typically a Dentist will just pass this task to their "IT Guy" believing the "IT Guy" has HIPAA under control. According to HIPAA, not only does your "IT Guy" have to understand HIPAA, he is a Business Associate. Because most requests to access ePHI involve the computer network, he should help regulate your other Business Associates. Because Business Associates often will have access to your ePHI, it is imperative that you analyze each request for network access. When it comes to the technical part of HIPAA, if a person you choose to safeguard your computer network ( in addition to your practice's privacy policy) does not understand HIPAA, you run the risk of not being ready for a HIPAA audit. If you are relying on their "IT Guy" without screening him, you may be setting yourselves up for a HIPAA violation or a data breach. Most IT guys do not know HIPAA Risk analyses must be redone at a minimum of every year. More often when there are major network changes.
