This book was released on 2003-01-01 with total page 546 pages. Available in PDF, EPUB and Kindle. Book excerpt: A major step towards the comprehensive protection of the Antarctic environment is the adoption of the Protocol on Environmental Protection to the Antarctic Treaty in 1991. The Protocol entered into force in January 1998 and provides a comprehensive system of obligations and prohibitions addressing most types of activities in the region south of 60 degrees south latitude. However, because of the absence of undisputed sovereignty in Antarctica, the legal protection of the Antarctic environment depends on the collective efforts of the Contracting Parties to the Protocol. Have the Contracting Parties adequately incorporated the key provisions of the Protocol into their domestic legal systems? Will the complex of domestic legal systems of the Contracting Parties adequately ensure a 'comprehensive protection' of the 'natural reserve' of Antarctica, as specified by Article 2 of the Protocol? These questions are the subject of this book.

Book Synopsis Antarctica in International Law by : Ben Saul
Download or read book Antarctica in International Law written by Ben Saul and published by Bloomsbury Publishing. This book was released on 2015-04-30 with total page 1136 pages. Available in PDF, EPUB and Kindle. Book excerpt: Antarctica, one of the world's last great wildernesses, presents special challenges for international law. Fears that Antarctica would become a front in the Cold War catalysed agreement on the 1959 Antarctic Treaty which neither legitimised nor challenged the existing sovereign claims to the continent. The unique Antarctic Treaty System has provided the foundation for peaceful, harmonious and effective governance. There are, however, new anxieties about the frozen continent and the Southern Ocean. Antarctica already feels the effects of climate change and ocean acidification. Claimant states assert rights to the Antarctic continental shelf and interest in Antarctic resources grows. Tourism brings new environmental and safety risks. China and other powers are increasing their activities, with some questioning the consensus of the 'Antarctic club'. Security concerns are increasingly discussed, despite Antarctica's dedication to peaceful purposes. This book brings together the main primary international materials concerning the regulation and governance of Antarctica, including multilateral and bilateral treaties, United Nations materials, 'soft laws' and judicial decisions. It covers the spectrum of Antarctic issues from environmental protection to scientific cooperation to tourism. As it shows, Antarctic law has constantly adapted to meet new challenges and is a sophisticated, inclusive, dynamic and responsive regime.

Download or read book The Routledge Handbook of Polar Law written by Yoshifumi Tanaka and published by Taylor & Francis. This book was released on 2023-07-25 with total page 734 pages. Available in PDF, EPUB and Kindle. Book excerpt: Polar law describes the normative frameworks that govern the relationships between humans, States, Peoples, institutions, land and resources in the Arctic and the Antarctic. These two regions are superficially similar in terms of natural environmental conditions but the overarching frameworks that apply are fundamentally different. The Routledge Handbook of Polar Law explores the legal orders in the Arctic and Antarctic in a comparative perspective, identifying similarities as well as differences. It points to a distinct discipline of "Polar law" as the body of rules governing actors, spaces and institutions at the Poles. Four main features define the collection: the Arctic-Antarctic interface; the interaction between global, regional and domestic legal regimes; the rights of Indigenous Peoples; and the increasing importance of private law. While these broad themes have been addressed to varying extents elsewhere, the editors believe that this Handbook brings them together to create a comprehensive (if never exhaustive) account of what constitutes Polar law today. Leading scholars in public international and private law as well as experts in related fields come together to offer unique insights into polar law as a burgeoning discipline.
Book Synopsis Implementing the Environmental Protection Regime for the Antarctic by : D. Vidas
Download or read book Implementing the Environmental Protection Regime for the Antarctic written by D. Vidas and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the Protocol on Environmental Protection to the Antarctic Treaty entered into force on 14 January 1998, a new phase commenced for the Antarctic Treaty System. The parties to the Protocol are today confronting issues related to the implementation of a complex international environmental protection regime, both in international and domestic contexts. Several crucial implementation questions need to be solved in order to enhance and make possible the implementation of the Protocol. What would be the consequences for the parties of a possible failure in resolving the pending implementation issues, on what premises can the solutions be based, and what, then, are the options available? This book provides a systematic overview of the implementation issues in sections on jurisdiction, control and enforcement in the Antarctic (Part I), institutional support to the implementation of the Protocol (Part II), normative support to the implementation of the Protocol: an Antarctic liability regime (Part III), relationship with other international instruments and arrangements (Part IV), and, through a series of selected case-studies, issues involved in domestic implementation of the Protocol (Part V). This is a book that will appeal to Antarctic specialists and to all those interested in environmental law and policy.

Book excerpt: Despite the central role oceans play in the economic, environmental and social affairs of the planet's 6.7 billion inhabitants, significant gaps exist in our understanding and management of the complex processes at work from the global climate system, to the water cycle and circulation of nutrients, to changes affecting marine habitats. In addition, the vastness of the world's oceans have for far too long been perceived as impervious and indestructible to human impact. To deal with this situation, improved monitoring and observation practices, regular assessments to provide a deeper understanding of the status and trends of environmental changes, and the know-how and ability to prevent, mitigate and adapt to these changes are urgently required. The UN General Assembly in 2005 -- recommended that a regular process for the global reporting and assessment of the state of the marine environment, including its socio-economic aspects (Regular Process), be initiated. The UN Environment Programme (UNEP) and the Intergovernmental Oceanographic Commission of UNESCO (IOC-UNESCO) were asked to serve as the lead agencies in the start-up phase that came to be known as the "Assessment of Assessments" (AoA). Under the AoA, an Expert Group have developed options and a framework for such a Regular Process, which can serve as the mechanism to keep the world's oceans and seas under continuing review.
