Book excerpt: Wide-spread usage of peer-to-peer file-sharing began in the late 1990's with Napster-a network that allowed users to share digital music without going through legal channels to purchase the copyrighted material. Since Napster debuted, over forty file-sharing applications that allow users to trade music, movies and computer software with each other have been created, costing the copyright holders of these materials billions of dollars in royalties. Today, peer-to-peer networks allow movie file-sharing and free long-distance voice phone calls. Since these uses are still emerging, a close look at the music peer-to-peer market may provide a useful guide to the likely evolution of the newer peer-to-peer applications. Drawing on interviews, primary survey data and secondary sources, this paper tracks the growth of peer-to-peer file-sharing and responses to it from the music industry, regulators, and the public. The investigation begins with the factors responsible for the growth of a peer-to-peer network, the factors that limit the growth of such a network, and how the dynamics of a file-sharing network change due to outside influences. With this background, we look at the current policies of the Recording Industry Association of America (RIAA), Internet service providers (ISPs) that provide Internet connectivity to consumers, and peer-to-peer application/network developers. Finally, based on models of the peer-to-peer system, recommendations are presented for future policies of all actors.

Book excerpt: 'With a combination of acute observation, close analysis and clear-headed honesty, Rebecca Giblin leads the reader to share her conclusion that there is no legislative, judicial, commercial or technical panacea for copyright infringement which P2P software facilitates, but that even now it is not too late to improve the manner in which the rights-owning and distribution sectors address the challenges that P2P poses.' Jeremy Phillips, Olswang, and Intellectual Property Institute, UK Code Wars recounts the legal and technological history of the first decade of the P2P file sharing era, focusing on the innovative and anarchic ways in which P2P technologies evolved in response to decisions reached by courts with regard to their predecessors. With reference to US, UK, Canadian and Australian secondary liability regimes, this insightful book develops a compelling new theory to explain why a decade of ostensibly successful litigation failed to reduce the number, variety or availability of P2P file sharing applications and highlights ways the law might need to change if it is to have any meaningful effect in future. A genuine interdisciplinary study, spanning both the law and information technology fields, this book will appeal to intellectual property and technology academics and researchers internationally. Historians and sociologists studying this fascinating period, as well as undergraduate and graduate students who are working on research projects in related fields, will also find this book a stimulating read.

Available in PDF, EPUB and Kindle. Book excerpt: Americans are troubled by the growing incivility they see in public life and in their interpersonal relationships. The lack of civility is an increasing issue on college campuses, reflecting deep societal problems. "In Search of Civility: Confronting Incivility on the College Campus", explores the timely issue by weaving stories of four college freshmen at a large university with current research on civility issues. The four students encounter civility dilemmas ranging from cheating, plagiarism, and misuse of technology to alcohol, diversity, and peer pressure. They want to do the right thing, but distinguishing between right and wrong sometimes proves to be difficult particularly when their personal values conflict with campus norms. "In Search of Civility" provides relevant context for the complex civility challenges facing students, faculty, and administrators. Colleges can play an important role in instilling civility among their students in their academic and social lives. Civil conduct requires treating others the way one wishes to be treated as well as a sense of duty and responsibility to the community. By raising questions, "In Search of Civility" challenges students to make the connection between the morals and values they claim to hold and the practical implications of those values expressed through acts of civility in every part of their lives. Weeks draws on a wide range of experiences--as teacher of undergraduate and graduate students at George Peabody College, Vanderbilt University, and as legal advisor to colleges throughout the US.

Book excerpt: Today's economic system, premised on the sale of physical goods, does not fit the information age in which we live. The capitalist order requires the maintenance of an artificial scarcity in goods that have the potential for near infinite and almost free replication. The sharing of informational goods through distributed global networks – digital libraries, file–sharing, live–streaming, free software, free–access publishing, the free–sharing of scientific knowledge, and open-source pharmaceuticals – not only challenges the dominance of a scarcity–based economic system, but also enables a more efficient, innovative, just and free culture. In a series of seven explorations of contemporary sharing, Matthew David shows that in each case sharing surpasses markets, private ownership and intellectual property rights in fostering motivation, creativity, innovation, production, distribution and reward. In transforming the idea of an information economy into an information society, sharing connects struggles against inequality and poverty in developed and developing countries. Challenging taken-for-granted justifications of the status quo, Sharing debunks the 'tragedy of the commons' and makes the case for digital network sharing as a viable mode of economic counterpower, prefiguring a post–capitalist society.

This book examines the relations and interactions between hacking and the law with a view to understanding how hackers influence and are influenced by technology laws and policies. In our increasingly digital and connected world where hackers play a significant role in determining the structures, configurations and operations of the networked information society, this book delivers an interdisciplinary study of the practices, norms and values of hackers and how they conflict and correspond with the aims and aspirations of hacking-related laws. Describing and analyzing the legal and normative impact of hacking, as well as proposing new approaches to its regulation and governance, this book makes an essential contribution to understanding the socio-technical changes, and consequent legal challenges, faced by our contemporary connected society.
