Book Synopsis European Labour Law and the EU Charter of Fundamental Rights by : Brian Bercusson
Download or read book European Labour Law and the EU Charter of Fundamental Rights written by Brian Bercusson and published by Nomos Verlagsgesellschaft. This book was released on 2006 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: What role will the EU Charter of Fundamental Rights play in the future for labour law in the European Union Member States? How could it affect industrial relations in these states? These are crucial questions to which a group of eminent European labour law professors and researchers seek to offer some answers in their new book European Labour Law and the EU Charter of Fundamental Rights. To recall the story behind the Charter: in December 2000, this text was not enshrined as an integral part of the new EU Nice treaty, but was merely "proclaimed", to the disappointment of many, so that its legal status remained ambiguous. The draft future Treaty establishing a Constitution for Europe is clearer, insofar as it incorporates the Charter as its Part II, thereby giving it a binding character - but nobody knows whether, or when, this Treaty-Constitution will actually see the light of day and, if it does, in what shape. Yet now, as the discussions about a future EU constitution are regaining momentum, the European Court of Justice has also had its word on the role of the Charter. It has declared that "the principal aim of the Charter is to reaffirm rights" which are legally binding due to their provenance from other sources recognised by EU law (Case 540/03, European Parliament v. Council, decided 27 June 2006). The thus strengthened Charter includes core labour law and industrial relations provisions, covering matters such as freedom of association, collective bargaining and collective action, information and consultation within the undertaking, fair and just working conditions and protection in the event of unjustified dismissal. The book European Labour Law and the EU Charter of Fundamental Rights is a detailed commentary on the provisions of the Charter which guarantee these and other fundamental rights that are binding upon the EU institutions and the Member States. The commentary throws light on the potential of the EU Charter to shape the future labour law of Europe, an understanding of which is important for labour lawyers and industrial relations professionals, as well as for academics and policy makers in the Member States and in the EU institutions.

Book Synopsis Historical Dictionary of Organized Labor by : James C. Docherty
Download or read book Historical Dictionary of Organized Labor written by James C. Docherty and published by Scarecrow Press. This book was released on 2012-06-14 with total page 497 pages. Available in PDF, EPUB and Kindle. Book excerpt: Organized labor is about the collective efforts of employees to improve their economic, social, and political position. It can be studied from many different points of view—historical, economic, sociological, or legal—but it is fundamentally about the struggle for human rights and social justice. As a rule, organized labor has tried to make the world a fairer place. Even though it has only ever covered a minority of employees in most countries, its effects on their political, economic, and social systems have been generally positive. History shows that when organized labor is repressed, the whole society suffers and is made less just. The Historical Dictionary of Organized Labor looks at the history of organized labor to see where it came from and where it has been. This is done through a chronology, an introductory essay, appendixes, a glossary of terms, and an extensive bibliography. The dictionary section has over 400 cross-referenced entries on most countries, international as well as national labor organizations, major labor unions, leaders, and other aspects of organized labor such as changes in the composition of its membership. This book is an excellent access point for students, researchers, and anyone wanting to know more about organized labor.
Book Synopsis Employee Relations in the Periphery of Europe by : E. O'Hagan
Download or read book Employee Relations in the Periphery of Europe written by E. O'Hagan and published by Springer. This book was released on 2002-09-23 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the manner in which the EU affects employee relations systems in economically peripheral European countries, specifically Ireland and Hungary. It asks whether the EU offers peripheral countries the opportunity to modernise their industrial relations. The EU dynamically promotes core-like employee practices, and national actors energetically attempt to implement the prescribed initiatives, yet little success has been achieved in modernising production techniques in peripheral economies. O'Hagan argues that the EU implements an unofficial development policy which it pressurises States to adopt. These initiatives amount to the frequently referred to European Social Model (ESM), which, she argues, can cause difficulty for policy makers because it is ill-defined, vague and contradictory.
Book Synopsis Historical Dictionary of Organized Labor by : Sjaak van der Velden
Download or read book Historical Dictionary of Organized Labor written by Sjaak van der Velden and published by Rowman & Littlefield. This book was released on 2021-04-22 with total page 603 pages. Available in PDF, EPUB and Kindle. Book excerpt: From the start of its existence organized labor has been the voice of workers to improve their economic, social, and political positions. Beginning with small and very often illegal groups of involved workers it grew to the million member organizations that now exist around the globe. It is studied from many different perspectives – historical, economic, sociological, and legal – but it fundamentally involves the struggle for workers’ rights, human rights and social justice. In an often hostile environment, organized labor has tried to make the world a fairer place. Even though it has only ever covered a minority of employees in most countries, its effects on their political, economic, and social systems have been generally positive. Despite growing repression of organized labor in recent years, membership numbers are still growing for the benefit of all employees, including the non-members. Historical Dictionary of Organized Labor: Fourth Edition makes the history of this important feature of life easily accessible. The reader is guided through a chronology, an introductory essay, 600 entries on the subject, appendixes with statistical material, and an extensive bibliography including Internet sites. This book gives a thorough introduction into past and present for historians, economists, sociologists, journalists, activists, labor union leaders, and anyone interested in the development of this important issue.

Available in PDF, EPUB and Kindle. Book excerpt: This book is part of a series which sets out a restatement of labour law in Europe. Its second volume looks at atypical employment relationships in Europe. Opening with a restatement, the book provides comparative commentary on the question of how fixed-term employment relationships, part-time employment relationships and temporary agency work is regulated by law in the individual states, which case law of the courts must be observed in this respect and which possibilities exist for shaping such relationships on the basis of collective bargaining agreements. The book goes on to systematically explore the national regulatory framework of: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Montenegro, Netherlands, North Macedonia, Norway, Poland, Portugal, Romania, Russia, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey and the United Kingdom. In this area, which is largely shaped by EU law in many countries, the commonalities and differences with regard to the relevant regulatory issues are examined. This important new project provides the definitive survey of labour law in Europe today.

Book Synopsis Deakin and Morris’ Labour Law by : Zoe Adams
Download or read book Deakin and Morris’ Labour Law written by Zoe Adams and published by Bloomsbury Publishing. This book was released on 2021-07-15 with total page 1321 pages. Available in PDF, EPUB and Kindle. Book excerpt: Deakin and Morris' Labour Law, a work cited as authoritative in the higher appellate courts of several jurisdictions, provides a comprehensive analysis of current British labour law which explains the role of different legal and extra-legal sources in its evolution, including collective bargaining, international labour standards, and human rights. The new edition, while following the broad pattern of previous ones, highlights important new developments in the content of the law, and in its wider social, economic and policy context. Thus the consequences of Brexit are considered along with the emerging effects of the Covid-19 crisis, the increasing digitisation of work, and the implications for policy of debates over the role of the law in constituting and regulating the labour market. The book examines in detail the law governing individual employment relations, with chapters covering the definition of the employment relationship; the sources and regulation of terms and conditions of employment; discipline and termination of employment; and equality of treatment. This is followed by an analysis of the elements of collective labour law, including the forms of collective organisation, freedom of association, employee representation, internal trade union government, and the law relating to industrial action. The seventh edition of Deakin and Morris' Labour Law is an essential text for students of law and of disciplines related to management and industrial relations, for barristers and solicitors working in the field of labour law, and for all those with a serious interest in the subject.
