Le novità introdotte da tali disposizioni, ed in particolare dal «Codice del Terzo settore», nel ridisegnare questa disciplina, hanno prodotto effetti significativi con riferimento agli «enti religiosi civilmente riconosciuti», per le «attività di interesse generale» che essi svolgono. Il presente volume muove dunque dalla necessità di esaminare le norme espressamente dedicate a tali enti per ricostruirne il peso specifico rispetto all’impianto complessivo delineato dal legislatore. In particolare, esso è rivolto alla ricerca di un giusto equilibrio tra le disposizioni dettate dalla riforma ed una attenta applicazione dei principi costituzionali che concernono gli enti in questione, nel quadro di un corretto bilanciamento degli interessi coinvolti e della specialità propria di tali soggetti giuridici. Di qui, anche in considerazione delle difficoltà socio-economiche scaturite dall’emergenza epidemiologica Covid-19, si intende rilevare l’importanza, per questo peculiare ambito di azione, del progressivo imporsi di nuove dinamiche di relazione tra autorità civili, confessionali e collettività in generale.

I vari contributi affrontano il tema, quanto mai attuale e impegnativo, della disciplina degli enti ecclesiastici civilmente riconosciuti nella riforma del Terzo settore. Quest’ultima, come noto, è stata introdotta con il d.lgs. n. 117 del 2017, cui si accompagna il d.lgs. n. 112 del 2017 di riforma dell’impresa sociale, entrambe emanate in attuazione della legge delega n. 106 del 2016. Non occorre soffermarsi sull’importanza di tale complessiva riforma, che per la sua effettiva e piena attuazione attende peraltro l’emanazione di ulteriori provvedimenti e, soprattutto, il responso della Commissione Europea per le significative implicazioni di natura fiscale. Basti pensare che essa si pone come l’esito del faticoso e travagliato percorso, sollecitato dalla dottrina civilistica e iniziato già alla fine del secolo scorso, che avrebbe dovuto portare alla riforma del titolo II del Libro I del Codice civile, ancora prevista come oggetto della delega legislativa ma poi sostituita, per ragioni sistematiche e per l’acquisita complessità della materia degli enti non lucrativi, da un provvedimento autonomo e assai articolato, non a caso qualificato dallo stesso decreto legislativo come “Codice del Terzo settore”...
