Book excerpt: Gerhard (sociology, Johann Wolfgang Goethe University, Germany) examines equality as a principle and practice of law in history, and legal theory from a feminist perspective. She reviews the history of the women's movement in the 19th and 20th centuries, with a focus on Germany, and examines three major legal issues: women's rights in the public sphere, women's legal capacities in private law, and women's human rights. This work was first published in German in 1990 (C.H. Beck'sche Verlagsbuchhandlung); this American edition, somewhat revised, was translated by Allison Brown and Belinder Cooper and includes a new foreword. c. Book News Inc.

Available in PDF, EPUB and Kindle. Book excerpt: Until the eighteenth century, Western societies were hierarchical ones. Since then, they have transformed themselves into societies dominated by two features: participatory democracy and the protection of human rights. In Modern Isonomy, distinguished political theorist Gerald Stourzh unites these ideas as “isonomy.” The ideal, Stourzh argues, is a state, and indeed a world, in which individual rights, including the right to participate in politics equally, are clearly defined and possessed by all. Stourzh begins with ancient Greek thought contrasting isonomy—which is associated with the rule of the many—with “gradated societies,” oligarchies, and monarchies. He then discusses the American experiment with the development of representative democracy as well as the French Revolution, which proclaimed that all people are born and remain free and with equal rights. But progress on the creation and protection of rights for all has been uneven. Stourzh discusses specifically the equalization of slaves, peasants, women, Jews, and indigenous people. He demonstrates how deeply intertwined the protection of equal rights is with the development of democracy and gives particular attention to the development of constitutional adjudication, notably the constitutional complaint of individuals. He also discusses the international protection human rights. Timely and thought-provoking, Modern Isonomy is an erudite exploration of political and human rights.

Book excerpt: The result of extensive collaboration among leading scholars from across Europe, Conceptual History in the European Space represents a landmark intervention in the historiography of concepts. It brings together ambitious thematic studies that combine the pioneering methods of historian Reinhart Koselleck with contemporary insights and debates, each one illuminating a key feature of the European conceptual landscape. With clarifying overviews of such contested theoretical terrain as translatability, spatiality, and center-periphery dynamics, it also provides indispensable contextualization for an era of widespread disenchantment with and misunderstanding of the European project.

This book was released on 2017-02-23 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: This important new book seeks to widen the understanding of the principle of equality within European law. Firstly, it deconstructs the European Court of Justice's adjudication of cases in the field. It then explores how the Member States' courts decide on the question of equality. This detailed rigorous research allows the author to argue for a reconceptualised equality doctrine. Such an adaptation, the author argues, will provide judges, practitioners and academics with the tools to balance institutional considerations against substantive interpretation. Theoretically ambitious, while grounded in practical application, this is a significant restatement of one of the key principles of European law: the equality doctrine.
