Die Kriminalit tsbelastungsziffer, die die Anzahl der Straftaten pro 100 000 Einwohner mi t, ist im Zeitraum von 1963 bis 1993 um das Zweieinhalbfache gestiegen. Ein besonders schneller Anstieg ist vor allem seit dem Zeitpunkt der deutschen Wiedervereinigung zu verzeichnen. Auffallend dabei ist ein berproportional hoher Anteil von Jugendlichen und Heranwachsenden an der Gesamtkriminalit t, vor allem die Altersgruppe der 14- 20j hrigen ist davon betroffen. In den letzten Jahren wuchs zudem der Anteil der Kinder und Jugendlichen unter vierzehn Jahren, die durch Gewaktdelikte aufgefallen sind. Aus diesen Zahlen wird deutlich, wie stark sich Kriminalit t, insbesondere Gewaltkriminalit t, zum Jugendph nomem entwickelt hat. Aus diesem Sachverhalt heraus stellte sich f r uns anfangs die Frage, was unter Gewalt zu verstehen ist und warum gerade bei Jugendlichen die Schwelle zur Gewaltanwendung so niedrig ist und eine so hohe Gewaltbereitschaft besteht. ...9

Daraufhin schlugen die Jugendlichen brutal auf den Mann ein. Dieser starb noch am selben Abend an seinen schweren Kopfverletzungen. Die Medien reagieren auf solche Vorfälle immer sehr schnell mit verschiedenen Begründungen und Ursachen und stilisieren den Skandal in der Öffentlichkeit hoch. Doch hinter den ganzen gewalttätigen Angriffen und Ausbrüchen der Jugendlichen stecken immer tiefere Ursachen als nur ein Faktor. Auf den folgenden Seiten werden Jugendkriminalität und ihre Ursachen sowie Bekämpfungsmaßnahmen und Lösungsvorschläge erläutert. Anhand verschiedener Statistiken lässt sich die Entwicklung der Jugendkriminalität aufzeigen. Es wird deutlich, wie viele Ursachen wirklich hinter Jugendkriminalität stecken und was Jugendliche zu solchen Taten bringt.

Im Fokus der allgemeinen Aufmerksamkeit steht vorrangig die physisch angewendete Gewalt von Kindern und Jugendlichen, da diese für Außenstehende schnell ersichtlich wird. Im gesellschaftlichen Kontext wird hauptsächlich über die Folgen für die Täter diskutiert. Die Ursachen der Gewalttaten werden ausschließlich einzelfallspezifisch untersucht. Die vorliegende Studienarbeit wird sich vorrangig mit physischer Gewalt von Kindern und Jugendlichen auseinandersetzen. Unter Berücksichtigung spezieller biologischer, psychischer und soziologischer Umstände werden Risikofaktoren der Entstehung einer gewalttätigen Persönlichkeit erklärt und transparent gemacht. Zu Beginn werden Unterschiede bei dem Einsatz physischer Gewalt bei Jungen und Mädchen begründet, da statistische Erhebungen eine signifikant höhere Anzahl männlicher Gewalttäter belegen. Wissenschaftler versuchen seit Jahrzehnten, Theorien zur Entstehung von Gewalt zu entwickeln. Von zahlreichen Theorien werden zwei erläutert. Der anschließende Gliederungspunkt befasst sich mit biologischen Risikofaktoren. Im Mittelpunkt stehen dabei spezielle Bereiche des Gehirns, welche für die Entstehung und Steuerung von Emotionen essentiell sind. Anschließender Gliederungspunkt behandelt den Zusammenhang von Spiegelneuronen und Empathie als Grundlage prosozialen Verhaltens. Sowohl die Frage, inwieweit Spiegelneuronen menschliches Gewaltverhalten beeinflussen können, als auch die These „Empathie ist von signifikanter Relevanz für die Ausprägung einer prosozialen Persönlichkeit und der erheblichen Reduzierung gewalttätiger Verhaltensweisen“ stehen dabei im Mittelpunkt. Die folgenden sozialen Risikofaktoren stellen den wesentlichsten Abschnitt der Studienarbeit dar. Beginnend mit verschiedenen Erziehungsstilen, werden die bekanntesten sozialen Risikofaktoren als etwaige Auslöser von Kinder- und Jugendgewalt untersucht.

Book excerpt: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.

Book excerpt: Anthropologists have written a great deal about the coastal adaptations and seafaring traditions of Pacific Islanders, but have had much less to say about the significance of rivers for Pacific island culture, livelihood and identity. The authors of this collection seek to fill that gap in the ethnographic record by drawing attention to the deep historical attachments of island communities to rivers, and the ways in which those attachments are changing in response to various forms of economic development and social change. In addition to making a unique contribution to Pacific island ethnography, the authors of this volume speak to a global set of issues of immense importance to a world in which water scarcity, conflict, pollution and the degradation of riparian environments afflict growing numbers of people. Several authors take a political ecology approach to their topic, but the emphasis here is less on hydro-politics than on the cultural meaning of rivers to the communities we describe. How has the cultural significance of rivers shifted as a result of colonisation, development and nation-building? How do people whose identities are fundamentally rooted in their relationship to a particular river renegotiate that relationship when the river is dammed to generate hydro-power or polluted by mining activities? How do blockages in the flow of rivers and underground springs interrupt the intergenerational transmission of local ecological knowledge and hence the ability of local communities to construct collective identities rooted in a sense of place?

It focuses on four major areas of post-separation lives, namely (1) economic conditions, (2) parent-child relationships, (3) parent and child well-being, and (4) health. Through studies from several European countries, the book showcases how legal regulations and social policies influence parental and child well-being after divorce and separation. It also illustrates how social policies are interwoven with the normative fabric of a country. For example, it is shown that father-child contact after separation is more intense in those countries which have adopted policies that encourage shared parenting. Correspondingly, countries that have adopted these regulations are at the forefront of more egalitarian gender role attitudes. Apart from a strong emphasis on the legal and social policy context, the studies in this volume adopt a longitudinal perspective and situate post-separation behaviour and well-being in the life course. The longitudinal perspective opens up new avenues for research to understand how behaviour and conditions prior or at divorce and separation affect later behaviour and well-being. Book excerpt: In recent years, there has been an explosion of knowledge concerning the developmental processes that lead to persistent violent offending, and in particular, the neurobiological determinants. However, the field of violence has suffered from a divide between basic laboratory neuroscience and clinical science. Hence, this new knowledge has hithero had little impact on government policies, prevention programmes, and on the rehabilition of offenders. This book embraces a translational approach to treating the problem of violent offending. It highlights some of the key scientific challenges, as well as the dilemmas and difficulties in the translation of scientific findings (whether basic or clinical) into policy and practice applications. Using findings derived from studies in molecular genetics and brain imaging, it provides the latest field of knowledge about violent offending and how to treat and prevent this major problem. The book starts by examining what we know about the development of persistent violent offenders and the factors and mechanisms thought to underlie their pattern of aggressive behaviour. Subsequent chapters describe studies looking at the cognitive and neural functioning of persistent violent offenders and the kind of children at risk of becoming violent offenders. The chapters in the latter part of the volume review the effectiveness of rehabilitation programmes for adult violent offenders. The book ends by focusing on the estblishment of effective interventions for children at risk of becoming violent offenders and for mothers who are at risk of having at-risk children. Throuhgout, the volume emphasizes the need to consider both biological and non-biological factors as promoters of violence.
