Available in PDF, EPUB and Kindle. Book excerpt: George Mason (1725-92) is often omitted from the small circle of founding fathers celebrated today, but in his service to America he was, in the words of Thomas Jefferson, "of the first order of greatness." Jeff Broadwater provides a comprehensive account of Mason's life at the center of the momentous events of eighteenth-century America. Mason played a key role in the Stamp Act Crisis, the American Revolution, and the drafting of Virginia's first state constitution. He is perhaps best known as author of the Virginia Declaration of Rights, a document often hailed as the model for the Bill of Rights. As a Virginia delegate to the Constitutional Convention in Philadelphia, Mason influenced the emerging Constitution on point after point. Yet when he was rebuffed in his efforts to add a bill of rights and concluded the document did too little to protect the interests of the South, he refused to sign the final draft. Broadwater argues that Mason's recalcitrance was not the act of an isolated dissenter; rather, it emerged from the ideology of the American Revolution. Mason's concerns about the abuse of political power, Broadwater shows, went to the essence of the American experience.

Available in PDF, EPUB and Kindle. Book excerpt: Examines how the Supreme Court has banished free expression from shopping malls and other public spaces. In spite of their public attractions and millions of visitors, most shopping malls are now off-limits to free speech and expressive activity. The same may be said about many other public spaces and marketplaces in American cities and suburbs, leaving scholars and other observers to wonder where civic engagement is lawfully permitted in the United States. In Public Spaces, Marketplaces, and the Constitution, Anthony Maniscalco draws on key legal decisions, social theory, and urban history to demonstrate that public spaces have been split apart from First Amendment protections, while the expression of political ideas has been excluded from privately owned, publicly accessible malls. Today, the traditional indoor suburban shopping mall, that icon of modern American capitalism and culture, is being replaced by outdoor retail centers. Yet the law and courts have been slow to catch up. Maniscalco argues that scholars, students, and the public must confront these innovations in commercial design and consumer practices, as well as what they portend for contemporary metropolitan America and its civic spaces.

Book excerpt: George Mason was a short, bookish man who was a friend and neighbor of athletic, broad-shouldered George Washington. Unlike Washington, Mason has been virtually forgotton by history. But this new biography of forgotten patriot George Mason makes a convincing case that Mason belongs in the pantheon of honored Founding Fathers. Trained in the law, Mason was also a farmer, philosopher, botanist, and musician. He was one of the architects of the Declaration of Independence, an author of the Bill of Rights, and one of the strongest proponents of religious liberty in American history. In fact, both Thomas Jefferson and James Madison may have been given undue credit for George Mason's own contributions to American democracy.

Book excerpt: The introduction of self-assessment for income tax collection in the late 1990s marked a striking moment of cultural convergence between the UK and the US. This book analyses the socio-political factors leading to and resulting from this fundamental change in the relationship between taxpayers and the Inland Revenue, using perspectives in comparative law and the new outlooks of modern tax and cultural theory. It will be of interest to those studying theories of compliance, cultural legal studies, and law and society.

Available in PDF, EPUB and Kindle. Book excerpt: In the context of education, Church and State issues are of growing importance and appear to be increasingly divisive. This volume critically examines the developing jurisprudence relating to religion in the schools beginning with Everson v. Board of Education, where the US Supreme Court discussed the wall of separation between Church and State. The study traces both how the Court's views have evolved during this period and how, through recharacterizations of past opinions and the facts underlying them, the Court has appeared to interpret Establishment Clause guarantees in light of the past jurisprudence when in reality that jurisprudence has been turned on its head. The Court not only offers an unstable jurisprudence that is more likely to promote than avoid the problems that the Establishment Clause was designed to prevent, but approaches Establishment Clause issues in a way that decreases the likelihood that an acceptable compromise on these important issues can be reached. The study focuses on the situation in the US but the important issue of religion, education and the state has great relevance in many jurisdictions.

Available in PDF, EPUB and Kindle. Book excerpt: According to some commentators, forum shopping is an “evil” that must be eradicated. It has been suggested that the unification of substantive law through international conventions constitutes one way to achieve this outcome. This book shows that the drafting of uniform substantive law convention cannot prevent forum shopping. The reasons are classified into two main categories: convention-extrinsic and convention-intrinsic reasons. The former category comprises those reasons upon which uniform substantive law conventions do not have an impact at all. These reasons range from the costs of access to justice to the bias of potential adjudicators to the enforceability of judgments. The convention-intrinsic reasons, on the other hand, are reasons that relate to the nature and design of uniform substantive law conventions, and include their limited substantive and international spheres of application as well as their limited scope of application, the need to provide for reservations, etc. This book also focuses on another reason why forum shopping cannot be overcome: the impossibility of ensuring uniform applications and interpretations of the various uniform substantive law conventions.

Available in PDF, EPUB and Kindle. Book excerpt: Transnational merchant law, which is mistakenly regarded in purely technical and apolitical terms, is a central mediator of domestic and global political/legal orders. By engaging with literature in international law, international relations and international political economy, the author develops the conceptual and theoretical foundations for analyzing the political significance of international economic law. In doing so, she illustrates the private nature of the interests that this evolving legal order has served over time. The book makes a sustained and comprehensive analysis of transnational merchant law and offers a radical critique of global capitalism.
