Book excerpt: George Mason (1725-92) is often omitted from the small circle of founding fathers celebrated today, but in his service to America he was, in the words of Thomas Jefferson, "of the first order of greatness." Jeff Broadwater provides a comprehensive account of Mason's life at the center of the momentous events of eighteenth-century America. Mason played a key role in the Stamp Act Crisis, the American Revolution, and the drafting of Virginia's first state constitution. He is perhaps best known as author of the Virginia Declaration of Rights, a document often hailed as the model for the Bill of Rights. As a Virginia delegate to the Constitutional Convention in Philadelphia, Mason influenced the emerging Constitution on point after point. Yet when he was rebuffed in his efforts to add a bill of rights and concluded the document did too little to protect the interests of the South, he refused to sign the final draft. Broadwater argues that Mason's recalcitrance was not the act of an isolated dissenter; rather, it emerged from the ideology of the American Revolution. Mason's concerns about the abuse of political power, Broadwater shows, went to the essence of the American experience.

The study traces both how the Court's views have evolved during this period and how, through recharacterizations of past opinions and the facts underlying them, the Court has appeared to interpret Establishment Clause guarantees in light of the past jurisprudence when in reality that jurisprudence has been turned on its head. The Court not only offers an unstable jurisprudence that is more likely to promote than avoid the problems that the Establishment Clause was designed to prevent, but approaches Establishment Clause issues in a way that decreases the likelihood that an acceptable compromise on these important issues can be reached. It has been suggested that the unification of substantive law through international conventions constitutes one way to achieve this outcome. This book shows that the drafting of uniform substantive law convention cannot prevent forum shopping. The reasons are classified into two main categories: convention-extrinsic and convention-intrinsic reasons. The former category comprises those reasons upon which uniform substantive law conventions do not have an impact at all. These reasons range from the costs of access to justice to the bias of potential adjudicators to the enforceability of judgments. The convention-intrinsic reasons, on the other hand, are reasons that relate to the nature and design of uniform substantive law conventions, and include their limited substantive and international spheres of application as well as their limited scope of application, the need to provide for reservations, etc. This book also focuses on another reason why forum shopping cannot be overcome: the impossibility of ensuring uniform applications and interpretations of the various uniform substantive law conventions.
