Book excerpt: The right to social security, found in international law and in the constitutions of many nations, contributes to the alleviation of poverty globally. Social security and its articulation as a human right have received increased attention in recent years both in response to austerity cuts to welfare in developed countries and as a means of lifting millions out of poverty in developing countries. Women, disproportionately affected by poverty in all parts of the world, stand to gain from a right to social security that takes cognisance of gender discrimination and disadvantage. This book interprets and redefines the right to social security from a gender perspective. Drawing on feminist theory, the book formulates a conceptual approach and a set of principles for a substantively equal, gendered right to social security. In so doing, it challenges the relationship between the right to social security and traditional conceptions of work that exclude women’s labour including their caring roles. It argues that the right must have application at the transnational level if it is to address the changing nature of women’s work due to globalisation. The book applies the framework and principles it develops to a study of international law focusing on the work of key United Nations human rights bodies. It also demonstrates the value of this framework in its analysis of three countries’ social security programmes - South Africa, Australia and India. In combining feminist thought on the nature of work and care with equality theories in developing the right to social security from a gender perspective this book expands the capacity of the right to advance gender equality and address gendered poverty.

Available in PDF, EPUB and Kindle. Book excerpt: Although a sophisticated body of international social security law is active and growing, a number of States still appear unable to honour it. This thorough, well-researched survey and analysis of existing international social security law – its sources, its content, its historical development – is thus especially valuable for its informed consideration of the barriers to the law’s full effectiveness. Part of the renowned multi-volume Encyclopaedia of Laws, the book focuses on the analysis of the International Labour Organization (ILO) Conventions and Recommendations on Social Security. It examines the most recent public debates on social protection (dealing with health insurance, unemployment benefits, pension age, minimum income, social security benefits in case of expatriation, parental leave, and much more), includes an updated bibliography, and opens some perspectives for the future work of the global institutions. It integrates the latest instruments, in particular ILO Recommendation No. 202 concerning national floors of social protection. Even in the absence of ratification and therefore of legal force, international social security standards are invaluable benchmarks in comparative law. Indeed, ILO standards are both useful instruments of analysis and excellent yardsticks for identifying common denominators among national systems. For these reasons this book will be welcomed by legislators, government officials, employers’ organizations, trade unions, and the judiciary, as well as by human resources managers and academics.

Book excerpt: This collection examines the human rights to social security and social protection from a women's rights perspective. The contributors stress the need to address women's poverty and exclusion within a human rights framework that takes account of gender. The chapters unpack the rights to social security and protection and their relationship to human rights principles such as gender equality, participation and dignity. Alongside conceptual insights across the field of women's social security rights, the collection analyses recent developments in international law and in a range of national settings. It considers the ILO's Social Protection Floors Recommendation and the work of UN treaty bodies. It explores the different approaches to expansion of social protection in developing countries (China, Chile and Bolivia). It also discusses conditionality in cash transfer programmes, a central debate in social policy and development, through a gender lens. Contributors consider the position of poor women, particularly single mothers, in developed countries (Australia, Canada, the United States, Ireland and Spain) facing the damaging consequences of welfare cuts. The collection engages with shifts in global discourse on the role of social policy and the way in which ideas of crisis and austerity have been used to undermine rights with harsh impacts on women.

This book was released on 2016-04-24 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite the international community’s recognition of social protection as a human right, the vast majority of the world’s population still has no access to social protection. In a major effort to address this situation, the International Labour Conference unanimously adopted the Social Protection Floors Recommendation 202 of 2012. However, because of the wide variety of possible schemes (and techniques that can be employed to administer them), there is a genuine risk that important values relating to social protection will be overlooked in implementing the Recommendation. This collection of expert essays contains an in-depth clarification and analysis of the Recommendation and sets forth a clear and practicable set of principles that can be used both as a policy tool and as an assessment framework for the creation, maintenance, and supervision of a national social protection floor. This book pays detailed attention to each of the Recommendation’s key principles, including the following: – state responsibility; – universality of protection; – entitlement based in law; – adequacy and predictability of benefits; – non-discrimination; – financial solidarity; – good governance; – coherence of policies; and – social participation. A special feature of the book is its inclusion of case studies that display innovative social protection schemes focusing on children and families, persons of working age (particularly informal sector workers), and elderly persons. A concluding section offers useful insights on measures that can be taken and lessons learned. As a deeply informed and practical guide to ways in which states can (and do) establish and maintain a social protection floor as a fundamental element of their national social protection systems, this book has no peers. It will be warmly welcomed by jurists concerned with social protection throughout the world, by pertinent government agencies at all levels, by non-governmental organizations, and by academics in the field.

Book excerpt: The Universal Declaration of Human Rights establishes that everyone’s dignity and freedom to develop as a person are secured through economic, social and cultural rights. This volume examines the origins of the article of the Declaration that introduced the purpose of economic, social and cultural rights in this way and recognized that every member of society is entitled to their realization through national effort and international cooperation. The article’s concepts have been the subject of significant articulation and interpretation. Accordingly, the book analyzes the meaning and application of economic, social and cultural rights and the nature of the related obligations developed in the International Covenant on Economic, Social, and Cultural Rights and other international instruments. The book also explores the contribution of the article's legal concepts to philosophical theories of social justice and increasingly to the practice expected of States, individually and in cooperation with international organizations and non-state actors in development and other activities. This volume should provide a convenient tool for human rights advocates, practitioners, lawyers, scholars, and others involved with and interested in the role of human rights in seeking economic, social and cultural security for all.

Book excerpt: In addition to long-term demographic trends, European social security systems face new challenges as a result of increased global competition and an international banking system focused on short-term financial gain. This report therefore explores new ways for European policy makers and institutions to make social security systems more sustainable. It investigates ways to achieve short and long-term financial viability. It also identifies key mechanisms that work to achieve social cohesion, such as greater emphasis on social rights and social dialogue. It then examines the main policy issues in sustaining major individual social security programmes, such as health care, social assistance and family benefits, pensions, unemployment and work incapacity benefits, as well as long-term care.

Book excerpt: The human rights enunciated in Articles 23 and 24 of the UDHR concern aspects of rights related to work. This part of international human rights law is often neglected in human rights textbooks and teaching, and indeed is often omitted from the work done by national human rights institutes and by NGOs concerned with human rights, as though it were a separate discipline that did not fall properly into the human rights field. This volume addresses this commonly held, but erroneous, misconception.

Book excerpt: All over the world countries face the challenge of inadequate social security coverage for workers without an employment contact. In countries of the global south, this phenomenon is a natural consequence of large informal economies. Countries in the global north increasingly witness the same issue, due to growing labour market flexibility (flex contracts, dependent self-employment, digitization of labour). In this book authors from both hemispheres exchange insights, experiments and practices with the intention of finding better ways to deal with the social security challenges facing workers.

Available in PDF, EPUB and Kindle. Book excerpt: Over time there has been a miscommunication between mainstream economics and human rights that has paved the way to a justificatory ideology that validates the submission of human rights to the logic of market capitalism. This book shows how the discourse of mainstream economics is intrinsically opposed to the strengthening of human rights and outlines the principles upon which a human rights-based political economy can be built. Considering a variety of recognized human rights, such as the right to water and sanitation, the right to social security, the right to work, cultural freedom and democracy, this book describes how mainstream economics theory conflicts with these rights and explores alternative modes of thinking that incorporate human rights concerns into economics. Moreover, the book also reflects on the teaching of political economy for human rights. It sets out that a political economy favourable to human rights must be pluralist, interdisciplinary, participatory, de-commodified, non-utilitarian and non-consequentialist. The author proposes that it must not only assume the performative character of economics but also, and especially, its transformative purpose. Political Economy for Human Rights will offer students, academics, activists and policy makers useful tools to understand some of the main contradictions of contemporary societies and new paths leading to a more just and fraternal world. It will also be of great interest to the general public concerned with human rights and economic issues.

Available in PDF, EPUB and Kindle. Book excerpt: Chile's constitutional moment began as a popular demand in late 2019. This collection seizes the opportunity of this unique moment to unpack the context, difficulties, opportunities, and merits to enhance the status of environmental and social rights (health, housing, education and social security) in a country's constitution. Learning from Chilean and international experiences from the Global South and North, and drawing on the analysis of both academics and practitioners, the book provides rigorous answers to the fundamental questions raised by the construction of a new constitutional bill of rights that embraces climate and social justice. With an international and comparative perspective, chapters look at issues such as political economy, the judicial enforceability of social rights, implications of the privatisation of public services, and the importance of active participation of most vulnerable groups in a constitutional drafting process. Ahead of the referendum on a new constitution for Chile in the second half of 2022, this collection is timely and relevant and will have direct impact on how best to legislate effectively for social rights in Chile and beyond.
