Available in PDF, EPUB and Kindle. Book excerpt: 'Regulating Aged Care is a significant achievement and addresses areas of personal caring which do not usually receive attention. [It] is an important book which draws attention to the central problems of providing care for large numbers of vulnerable people. . . [it] should be required reading on undergraduate and postgraduate courses relating to applied social science, health and medical sociology.' Alison M. Ball, Sociology 'This book provides an impressive evidence base for both theory development and reassessment of policy and practitioner responses in the field.' International Social Security Review 'They have given us a fascinating case study here, rich in detail, and masterfully interpreted against the backdrop of evolving regulatory strategy. It is rare indeed to find this depth of analysis made accessible, laced throughout with humanity, compassion, and humor.' Malcolm Sparrow, Harvard University, US 'This book offers an intelligent and insightful account of the development of nursing home regulation in three countries England, the USA and Australia. But, more than that, it intertwines theory and more than a decade of empirical work to provide a telling and sophisticated explanation of why and how good regulatory intentions often go awry, and what can be done to create systems of regulation which really work to produce improvement.' Kieran Walshe, University of Manchester, UK This book is a major contribution to regulatory theory from three members of the world-class regulatory research group based in Australia. It marks a new development in responsive regulatory theory in which a strengths-based pyramid complements the regulatory pyramid. The authors compare the accomplishments of nursing home regulation in the US, the UK and Australia during the last 20 years and in a longer historical perspective. They find that gaming and ritualism, rather than defiance of regulators, are the greatest challenges for improving safety and quality of life for the elderly in care homes. Regulating Aged Care shows how good regulation and caring professionalism can transcend ritualism. Better regulation is found to be as much about encouragement to expand strengths as incentives to fix problems. The book is underpinned by one of the most ambitious, sustained qualitative and quantitative data collections in both the regulatory literature and the aged care literature. This study provides an impressive evidence base for both theory development and reassessment of policy and practitioner responses in the field. The book will find its readership amongst regulatory scholars in political science, law, socio-legal studies, sociology, economics and public policy. Gerontology and health care scholars and professionals will also find much to reflect upon in the book.

Available in PDF, EPUB and Kindle. Book excerpt: This ground-breaking book takes a fresh look at potential non-litigation solutions to providing personal injury compensation. It is the first systematic comparative study of such a large number – over forty – of personal injury compensation schemes. It covers the drivers for their creation, the frameworks under which they operate, the criteria and thresholds used, the compensation offered, the claims process, statistics on throughput and costs, and analysis of financial costings. It also considers and compares the successes and failings of these schemes. Many different types of redress providers are studied. These include the comprehensive no-blame coverage offered by the New Zealand Accident Compensation Corporation; the widely used Patient, Pharmaceutical, Motor Accident and Workers Compensation Insurance systems of the Nordic states; the far smaller issue-focused schemes like the UK Thalidomide and vCJD Trusts; vaccine damage schemes that exist in many countries; as well as motor vehicle schemes from the USA. Conclusions are drawn about the functions, essential requirements, architecture, scope, operation and performance of personal injury compensation systems. The relationships between such schemes, the courts and regulators are also discussed, and both calls and need for reforms are noted. Noting the wide calls for reform of NHS medical negligence litigation within the UK, and its replacement with a no blame approach, the authors' findings outline options for future policy in this area. This major contribution builds on general shifts from courts to ADR, and from blame to no blame in regulation, and is a work that has the potential to have a major impact on the field of personal injury redress. With contributions by Raymond Byrne, Claire Bright, Shuna Mason, Magdalena Tulibacka, Matti Urho, Mary Walker and Herbert Woopen.

Available in PDF, EPUB and Kindle. Book excerpt: The main purpose of this study is to determine the extent to which, through the performance of (indirect) normative functions and the application of principles of good governance as assessment standards, the ombudsman institution can contribute to improving the legal quality of the government while enhancing the legitimacy of the administration and the democratic system as a whole. The study is conducted from a comparative perspective, exploring the performance of the Dutch, UK, Spanish and Peruvian Ombudsmen. They are analysed with the aim to determine how far these ombudsmen, although of different types and belonging to different legal traditions, share the same values and apply similar normative standards that can be traced back to principles of good governance. The Peruvian ombudsman is examined as a case study of the institutions evolving role in new democracies in Latin America. This reflects the wider process of the ombudsman 's hybridisation worldwide, and how its functions and assessment standards have been adapted to the evolution of the constitutional state, not least through application of the principles of good governance, which operate at the constitutional level, as a new source of legitimacy.By primarily focusing on the steering function regarding the promotion of good administration rather than the protective function of the institution, the study concludes that the ombudsmans activities result in changed and improved public administration, which are often underappreciated in the legal literature. The legal approach to good governance provides the conceptual framework for evaluating the performance of the institution.
