Book excerpt: “Sharing economy” is an umbrella term that encompasses a wide range of digital platform-based activities that includes P2P lending and other forms of internet-based lending. The core aim of the sharing economy is to leverage the utilization of idle capacity. P2P lending can not only be used to leverage small amounts of money on the lender's side, but also be used to promote financial democracy and inclusion both on the lender and borrower's sides. P2P lending regulation, therefore, should place an emphasis on the utilization of dead money and promotion of financial democracy. This article scrutinizes the regulation of P2P lending in China. The existing regulatory system for P2P lending in China is built upon rules and regulations that have been designed solely with traditional brokers in mind. The article contends that the rigid rules placed on lending platforms limited their ability to maintain their roles as brokers and, in turn, heavily endangered the commercial sustainability of P2P platforms, thereby harming the sharing economy's openness and inclusivity. Additionally, the article argues that the fact that there is no limit on the amount a lender can invest poses a threat to the notions of leveraging idle money and financial inclusivity. The closed-ended P2P lending regime in China would cause some chilling effects to financial innovation in the P2P lending industry, and in a wider sense, the rising FinTech sector. Regulators in China need to cope with these challenges in a flexible but pragmatic manner, and particularly make use of the benefits the sharing economy may bring to the Chinese economy more broadly.

It stems partially from the platforms’ economic impact, which is felt most acutely in certain sectors: Uber drivers compete with taxi drivers; Airbnb hosts compete with hotels. Other consequences lie elsewhere: Uber is associated with a trend toward low-paying, precarious work, whereas Airbnb is accused of exacerbating real estate speculation and raising the cost of long-term rental housing. While governments in some jurisdictions have attempted to rein in the platforms, technology has enabled such companies to bypass conventional regulatory categories, generating accusations of “unfair competition” as well as debates about the merits of existing regulatory regimes. Indeed, the platforms blur a number of familiar distinctions, including personal versus commercial activity; infrastructure versus content; contractual autonomy versus hierarchical control. These ambiguities can stymie legal regimes that rely on these distinctions as organizing principles, including those relating to labour, competition, tax, insurance, information, the prohibition of discrimination, as well as specialized sectoral regulation. This book is organized around five themes: technologies of regulation; regulating technology; the sites of regulation (local to global); regulating markets; and regulating labour. The regulation of the sharing economy has been particularly challenging as regulators are being asked to balance the interests protected by longstanding regulations with the benefits of sharing economy platforms, their intrinsic laws and 'codes,' as well as the informal rules of an economic system originally based on collaboration rather than on profit-making.In a nutshell, this paper discusses the need to rethink local private transportation and zoning regulations, landlord-tenant law, labor law, competition law, and the liability of digital platforms as information society services in light of new developments in the sharing economy. This chapter also addresses the public policy challenges of the sharing economy, in particular the need to define limits for excessive sharing. I argue that future regulatory steps should be inspired by the distinction between sharing and quasi-sharing practices, that is, initiatives that are truly collaborative should benefit from regulatory exemptions and 'light licensing'. On the contrary, practices that may or may not promote the sustainable sharing of goods such as occasional 'car-pooling' (e.g., UberPool) should be regulated according to their sharing potential or as business-to-consumer platforms.

This “sharing economy” has already experienced tremendous growth and attracted considerable investment capital and talent. Yet, as is often the case with economic innovations, existing regulatory structures have hindered the growth of the sharing economy, reducing its popularity and slowing its development. This Article explores the tension between innovation and regulation, both in general and in a specific context: the intersection of the transportation sector of the sharing economy and the qualified transportation fringe benefit rules of Internal Revenue Code Section 132. We illustrate how regulators' legitimate concerns combine with the uncertainty surrounding new ways of doing business to create regulatory environments that place new industries at a disadvantage. We also argue that two of the most common approaches that regulators adopt to foster new industries - expanding regulation to encourage new industries and restricting regulation to spur innovation - are both flawed. In tax and other areas of law, these approaches tend to operate cyclically, with each coming into fashion for a time until its flaws are deemed unbearable and it gets replaced by the other. This cycle will continue until someone comes up with a better innovation.

Book excerpt: This thesis was motivated by the tremendous growth of the sharing economy platforms. I study several topics on the transportation sector of the sharing economy and their policy implications, using data from the City of Chicago. In the first chapter, I focus on the notion of sharing, which is the essence of the services in the sharing economy. I estimate how sharing affects social behavior by exploring tipping at the extensive and intensive margin, where the extensive margin shows whether the rider tipped or not and the intensive margin represents the tip amount. My empirical results suggest that sharing leads to a decrease in tip likelihood and tip amounts. As tipping is a private action in ridesharing, people tend to free ride, assuming that the other rider will tip on their behalf. In other words, this demonstrates that people are less likely to follow the social norm and feel less guilty not following it, if their actions are not revealed. In my other chapter, I examine the unintended consequences of price regulation in the context of ridesharing and taxi services. Taxis face strict fare regulations and a new congestion pricing policy for ridesharing was implemented to combat congestion. I find that taxi and ridesharing regulations have unintended heterogeneous effects by impacting low-income and minority-concentrated areas more severely. More specifically, the price increase, as well as the decrease in the number of pickups, were only significant for trips that start from Black-and-Hispanic-concentrated and low-income neighborhoods. Although none of this was intended, this can exacerbate the inequality and segregation among neighborhoods rather than solve the status quo.

However, savings from lower prices could lead to increased emissions from increased demand of the services (particularly transport) and increased spending on other goods and services. Depending on how consumers spend their savings, these changes could partly, wholly or more than offset the initial emission reductions. The impacts on overall CO2 emissions depend on whether the emissions are taxed, part of the emissions trading system EU ETS or not regulated at all.
