Available in PDF, EPUB and Kindle. Book excerpt: This paper examines the IMF’s concepts of convertibility and gives some impression of their purposes. The central concept of convertibility in the Articles is the convertibility of Article VIII, Sections 2, 3, and 4. Under it, the basic rule is that members must avoid restrictions on the making of payments and transfers for current international transactions, multiple currency practices, and discriminatory currency arrangements. In addition, a member that has accepted the obligations of Article VIII must convert balances of its currency in certain circumstances when those balances are presented for conversion by the monetary authorities of another member.

Book excerpt: This is the first volume to comprehensively and systematically study, describe, and theorize the financial obligation created and governed by public international law. Legal globalization has given rise to a number of financial issues in international law in areas as diverse as development financing, investment protection, compensation of human rights victims, and sovereign debt crises. The claims resulting from the proliferation of financial activity are not limited to those primarily involving financial obligation (e.g. loans and grants) but include secondary obligation resulting from the law on international responsibility. Among the many instances of financial obligation covered in this study, the reader will find inter-State financial transactions, inter-State sale of goods, transnational services such as telecommunications and post, the financial operations of multilateral institutions, loans, grants and guarantees provided by the various international financial institutions, certain financial relations between non-State actors (including natural persons) and States, intergovernmental organizations or other international legal actors, and government loans to international organizations. Rich in historical detail and systematic in its coverage of contemporary law, this book will be valued by all practitioners and scholars with an interest in the nature of international financial obligation.

Book excerpt: Bretton Woods constituted the first formal international agreement on a code of conduct applicable for economic transactions among countries that had subscribed to it. This pamphlet focuses on only one aspect of that code of conduct: the norms that have guided the conduct of financial and exchange transactions among countries, as they have been presented in the original Articles of Agreement of the IMF and their subsequent amendments. The paper outlines the fundamental characteristics of the IMF, examines the direct link between surveillance and conditionalilty, explores potential risks and dangers that might compromise certain fundamental features of the institution, and presents a set of ideas and proposals to ensure the activities of the IMF maintain continuity of its institutional uniqueness.

Available in PDF, EPUB and Kindle. Book excerpt: Enhance your understanding of the economic impact of rapid political changes in Eastern Europe with the valuable insights in this provocative book. Wealth Creation in Eastern Europe examines the difficulties faced by Eastern European nations converting from economic systems based on public ownership and non-market mechanisms for allocating goods and capital, to systems based on private ownership and reliance on market prices for allocating resources. Authoritative contributors bring to light a variety of perspectives to financial management in this rapidly changing environment. Important topics covered by this useful book include a macroeconomic view of the problems created by German unification, difficulties caused by applying standard valuation models and techniques to Eastern European enterprises, and the reaction of Western financial markets when companies announce joint venture investments in Eastern Europe. Readers will find valuable insights into critical financial concerns in Eastern European countries on such subjects such as the difficulty of ascertaining the value of state enterprises and determining whether their continued existence makes economic sense the problems created by the absence of clear titles to property and business for reorganizing economic activity under private ownership the need for a legal system that recognizes rights by ownership and enforces contract law the difficulties caused by the virtually complete absence of accounting-based information and information systems needed to evaluate organizations’economic efficiency problems encountered when conferring social legitimacy on a capitalist private enterprise system after decades of indoctrination about the evils of capitalism
