Book excerpt: This is the first full-length study in English of Peng Zhen (1902-97), a revolutionary comrade of Mao Zedong and Deng Xiaoping, and an influential legal policymaker in China during both men’s regimes. As one of the chief architects of PRC law and legal institutions during the 1950s and again in the 1980s, Peng left an indelible mark on the present legal system of China. This book analyzes the evolution of Peng’s legal views from his days as a revolutionary in the 1930s and 1940s, through his participation in Communist rule during the 1950s, to his conflicts with Mao and his purge in 1966, and finally to his rehabilitation and resumption of legal reform activities in the 1980s and 1990s. Initially, Peng embraced Leninist notions of law and political authority. These ideas gradually evolved so that in the 1980s Peng advocated increased reliance on formal rules and procedures as mechanisms of governance.

China’s Development Model (CDM) is examined with a view to answering a central question: given China’s peculiar matrix of a socialist party-state juxtaposed with economic internationalization and marketization, what are the underlying dynamics and the distinctive features of the economic and political/legal/social dimensions of the CDM, and how do we properly characterize their interrelations? The chapters further analyse to what extent and under what circumstances is China's development model sustainable, and to what degree is it readily applicable to other developing countries. Based on their findings in this volume, the authors conclude that the defining feature of the CDM’s economic dimension is "Janus-faced state-led growth," and the political/legal/social dimension of the CDM is best characterized as "adaptive post-totalitarianism." The contributors illustrate that the CDM’s parameters are shown to be much less sustainable than the CDM’s outcome in developmental performance and the extent to which the CDM can be applied to other late-developers is subject to more qualifications than its sustainability.

Scholars have argued that China, like the former USSR, promulgated constitutions to enhance its domestic and international legitimacy by opening up the constitution-making process to ordinary people, and by granting its citizens political and socioeconomic rights. But what did ordinary officials and people say about their constitutions and rights? Did constitutions contribute to state legitimacy? Over the course of four decades, the PRC government encouraged millions of citizens to pose questions about, and suggest revisions to, the draft of a new constitution. Seizing this opportunity, people asked both straightforward questions like "what is a state?", but also others that, through implication, harshly criticized the document and the government that sponsored it. They pressed officials to clarify the meaning of words, phrases, and ideas in the constitution, proposing numerous revisions. Despite many considering the document "bullshit," successive PRC governments have promulgated it, amending the constitution, debating it at length, and even inaugurating a "Constitution Day." Drawing upon a wealth of archival sources from the Maoist and reform eras, Diamant deals with all facets of this constitutional discussion, as well as its afterlives in the late '50s, the Cultural Revolution, and the post-Mao era. In addition to this descriptive project, the book advances a more general argument about the rule of law phenomenon, insisting that many arguments about the rule of law are better understood in terms of their intended and actual effects rather than as analytic propositions or descriptive statements. To illustrate this argument, the book demonstrates that various paradoxical, contradictory and otherwise implausible arguments about the rule of law play an important role in Chinese debates about the rule of law. Paradoxical statements about the rule of law, in particular, can be useful for an ideological project.
