Book excerpt: The right of EU citizens to move freely within the territory of the EU Member States is a fundamental freedom of the European Union. We examined the Commission's supervision of the internal Schengen border controls and travel restrictions imposed by the Member States during the COVID-19 pandemic, as well as the efforts undertaken at EU level to coordinate these restrictions until the end of June 2021. We conclude that the limitations of the legal framework hindered the Commission's supervision of free movement restrictions imposed by the Member States. Furthermore, the Commission did not exercise proper scrutiny to ensure that internal border controls complied with the Schengen legislation. Despite Commission's initiatives, the Member States' travel restrictions were mostly uncoordinated. ECA special report pursuant to Article 287(4), second subparagraph, TFEU.

Ensuring equitable access for all in the EU to an affordable (free) vaccine as early as possible is in line with the principle of non-discrimination in EU law. Equitable access to vaccines is crucial because the EU is adopting the EU COVID-19 Certificate. This certificate will be proof that a person has been vaccinated against COVID-19, received a recent negative test or recovered from COVID-19. The certificate aims to facilitate safe free movement inside the EU during the COVID-19 pandemic through the mutual recognition of national certificates. This is the seventh FRA Bulletin on how the COVID-19 pandemic affects fundamental rights.

This topic gained particular importance during the COVID-19 pandemic, when borders were closed and seasonal workers residing in other countries were hampered to get to or return from their places of work. The importance of such seasonal workers for certain economic sectors became quite visible, as well as the difficulties these seasonal workers are faced with. The report follows the commitment from the Commission Guidelines on Seasonal Workers in the EU in the Context of the COVID-19 Outbreak to collect data on intra-EU seasonal work and identify the main challenges faced including during the COVID-19 pandemic. Hence, it does not focus on the tools meant to support seasonal workers, since they are covered in the Commission Guidelines. The specific group of EU citizens living in one Member State and carrying out seasonal work in another Member State ('intra-EU seasonal workers' in the following) is not frequently studied. As these workers only stay in the country of work for a short period and there is little information about their work in the country of residence, there is little statistical information available about this group. This report seeks to fill this gap and presents the results of a first exercise to develop an operational definition and estimate approximate figures on this group.

Book excerpt: The interrelation between telework and the COVID-19 pandemic has offered a completely new insight into the traditional organisation of work and led to the development of the phenomenon referred to as the 'new normal.' By focusing on the EU workforce, this thesis investigates how TICTM (Telework and Information and Communication Technology-based Mobile Work) has shaped their behaviour during COVID-19 from the point of view of European trade unions. This research contributes to the existing literature by arguing that the preparedness of individual member states played a crucial role in workers' trust in national government and the extent to which the European workforce was able to benefit from the TICTM during a chaotic, precarious and unpredictable period. A semi-quantitative approach was adopted using the constructivist grounded theory methodology to explore workers' experiences with TICTM, generating a model of TICTM factors shaping their behaviour based on participant's accounts. Eleven virtual interviews were conducted with European trade unionists, one email interview with the European Trade Union Confederation's representative and sixty-five responses were obtained via survey. The model developed three theoretical codes: adaptation to the new normal, moral uncertainty, and digital movement.
