Dabei soll die Frage geklärt werden, ob sich bei diesen spezielle Risikofaktoren und/oder Mo-tive finden lassen und welche Konsequenzen man gegebenenfalls daraus ziehen könnte. Dem zugrunde liegen folgende Hypothesen: 1. Bei weiblichen Tätern existieren spezifische Risikofaktoren und Motive. 2. Das Wissen um Risikofaktoren kann zur früheren Erkennung und Aufdeckung von sexuellem Kindesmissbrauch durch Frauen beitragen und gleichzeitig für Präventionsansätze genutzt werden. Um die Forschungsfrage zu beantworten, erfolgt zunächst eine Literaturrecherche, mit der ein möglichst umfassendes und unvoreingenommenes Bild der Thematik erreicht werden soll. Anschließend werden anhand einer gründlichen Aktenauswertung Präze-denzfälle analysiert, um eventuelle Gemeinsamkeiten zwischen den Täterinnen zu iden-tifizieren und herauszufiltern. Ziel soll dabei sein, Erkenntnisse zu gewinnen, die zu ei-ner effektiveren Erhellung des bestehenden Dunkelfeldes beitragen und für Präventi-onsansätze nutzbar gemacht werden können. Auch soll diese Arbeit aufzeigen, dass es sich aktuell noch um ein unzureichend erforschtes und hoch tabuisiertes Phänomen han-delt, bei dem weitere Erkenntnisgewinnung und eine generelle Offenheit gegenüber der Thematik unerlässlich erscheinen, um effektiveren Opferschutz zielführend realisieren zu können.

Sexueller Missbrauch an Kindern und Jugendlichen ist ein Thema, dass fast täglich in unseren Medien auftaucht und an Brutalität nicht zu überbieten ist. Das war jedoch nicht immer so. Bis in die 80er Jahren war das Thema Missbrauch absolut tabu. Bis heute ist es so, dass viele Menschen wegschauen, nicht darüber reden. Sie meinen nicht davon betroffen zu sein und haben somit kein Bedürfnis sich mit diesem Thema zu beschäftigen. Ich selbst bin immer sehr betroffen, wenn ich von solchen Fällen höre. Es ist unglaublich, welches Leid und Trauma einem Kind zugefügt werden kann. Oft sind diese Missbrauchsopfer so traumatisiert, dass sie jahrelang ihr Schweigen nicht brechen können und der Missbrauch dann nach dem Gesetz „verjährt“ ist. Für die Opfer „verjährt“ die Tat nicht im geringsten. Die meisten haben mit schlimmen Langzeitfolgen zu kämpfen, die sie immer wieder daran erinnern, was mit ihnen gemacht wurde. Während meiner Ausarbeitung drängen sich immer wieder Fragen in meinen Kopf: Warum? Wie können Frauen oder Mütter zu solch einer Gewalt bereit sein? Gibt es auch nur einen Hauch von Erklärungen? In meiner Hausarbeit werde ich mich mit dem Thema „Frauen als Täterinnen“ beschäftigen.

Abschliessend wird die Aufschrift Im wirklichen Leben wurden sie ihre Kinder schutzen, dann machen sie es doch auch im Internet" eingeblendet. Der Grund, warum ich den Werbespot an dieser Stelle erwahne, ist ein anderer als der Praventionsgedanke. Mich interessiert das Bild des Mannes, der die kleine Anna mitnimmt, um ihr einen Hasen zu zeigen. Es handelt sich namlich um das gesellschaftliche Bild eines Taters, der Kinder sexuell missbraucht. Leicht korpulent, Glatze, Trenchcoat, Brille, Herrenhandtasche und womoglich alleinstehend. Spannenderweise ist gerade dieses Bild weit verbreitetet in unserem gesellschaftlichen Denken. So sieht er aus; der nette Onkel von nebenan. Schaut man sich Filme aus jungster oder vergangener Zeit an, die diese Thematik aufnehmen, mundet das Bild in die gleiche Richtung. Das gesellschaftliche Bild des klassischen Sexualstraftaters. An dieser Stelle muss ich zugeben, dass sich mein eigenes Bild vom beschriebenen zu Beginn dieser Arbeit nicht sonderlich unterschied. Bewusst bleibe ich bei meiner Beschreibung bei der mannlichen Form, weil auch dies zu dem gesellschaftlichen Bild dazugehort. It comprises country reports of all 15 EU Member States. Each country report provides essential definitional information regarding the various forms of sexual exploitation of children and types of missing children, outlines the way data collection on sexual exploited and missing children by various governmental (police, judicial, other) and non-governmental actors is organised, and deliver available data on the phenomena concerned. A final, comparative report bridges the country report information into a first Union-wide epidemiological state of the art, thus showing that current data collection is organised in a very chaotic and poor fashion. At the same time, the report identifies the main weaknesses and shortcomings of applied data collection methods. Book excerpt: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.
