Book excerpt: "Decisions regarding the management of natural resources in the northern rangelands of Kenya have traditionally been made collectively through leadership offered by customary institutions. However, the evolution of Kenya as a flexible environmental state has had implications for natural resource management and institutions in arid and semi-arid rangeland (ASAL) ecosystems. As a result, the rise of collaborative natural resource management has been characterized by the growth of public-private conservation partnerships (PPPs). Ecotourism and payments for ecosystem services have thus evolved as flexible forms of environmental governance through which challenges in natural resources management can be addressed.This study was motivated by the lack of documented empirical research on the effects of PPPs as hybridized modes of natural resource management. Specifically, this study aims to characterize the partnerships in terms of their evolution, actors’ interactions and power dynamics, as well as examine their efficiency, effectiveness and equity implications of natural resource governance. Four conservancies under the umbrella of the Northern Rangelands Trust (NRT) in the ASALs of Samburu County were purposefully selected for study. Key informant interviews, focus group discussions, household interviews using a semi-structured questionnaire and researcher’s observation of field conditions were used to gather data. Data was analysed using the Statistical Package for the Social Sciences (SPSS) software. The findings show that the existence of wildlife on communal lands outside protected areas is the key condition for creating these partnerships. Furthermore, the partnerships are characterized by various kinds of exchanges between stakeholders, such as the provision of political support, physical security, legitimacy and finances. Additionally, the rolling back of the state under neoliberalism has led to the rise to power of the NRT whose influence has been magnified by ties with international organizations such as The Nature Conservancy. The results of financial cost-benefit analyses of the conservancies revealed their operational inefficiency. As a result, there exists an over-reliance on donor-funding, rendering the practice of conservation unsustainable in its current form. As support for conservation initiatives strongly hinges on a local community’s acceptance and collaboration, the PPPs undertake investments in communal projects, such as the provision of physical security which is critical to conservation initiative’s success. Considerable effort is also geared towards shrewd environmental stewardship. However, in working towards their objectives, conservation PPPs are characterized by inequities in access, decision-making and outcomes. This finding, I argue, is a result of the failure to fully acknowledge and incorporate the contextual aspects of equity. Overall, the implications of this thesis suggest that public-private conservation partnerships have the potential to be effective modes of natural resource governance if: (i) the devolved county system of government takes charge to empower local communities more, and, as a consequence avert tendencies to assert dominance within partnerships by other stakeholders; (ii) a renegotiation of favourable conservancy-investor partnership agreements occurs, as a way of financially empowering conservancies, thereby reducing the donor-dependency tendency; (iii) more effort is geared towards ensuring a fair distribution of benefits to individual households. This can be achieved, for instance, by linking communities directly to local and external markets in the framework of the NRT’s BeadWORKS and LivestockWORKS programs, and by shifting the perception of marginalized social groups such as women and morans"--

Under Section 148 of EMCA: "Any written law, in force immediately before the coming into force of this Act, relating to the management of the environment shall have effect subject to modification as may be necessary to give effect to this Act, and where the provisions of any such law conflict with any provisions of this Act, the provisions of this Act shall prevail". This book is an appraisal of the extent to which this provision has been implemented. It critically analyses environmental law in Kenya with a view to identifying the convergences and divergences between select sectoral laws and EMCA. Trees are key providers of biomass, which is critical for many livelihood needs. Wood from trees is the leading source of energy in many dryland countries and is an important construction material. Foliage and pods from trees and shrubs are the most important source of feed for camels and goats, which are the dominant livestock species in the more arid parts of the drylands. Trees and shrubs offer enhanced sources of the organic matter needed to improve the structure and raise the fertility of soils used for agriculture. Many parts of trees provide different medicinal products for people. And fruits and vegetable foliage harvested from trees are important seasonal food sources for people living in drylands, and for sale. The benefi ts from trees take on added value when one considers that they are relatively impervious to many of the shocks that affect other production systems, especially livestock keeping and agriculture. Trees, with their deep rooting systems, maintain their standing value and offer some production even in drought years. They are therefore a good buffer against climatic risk and are a critical element in a diversifi cation strategy designed to maintain levels of consumption and income in good times and bad. In addition, their value can be tapped when it is most needed: wood from trees can be harvested throughout the year, and many annual tree products are harvested at times different from the times when annual crops are harvested. Tree-Based Production Systems for Africa’s Drylands identifi es some of the most promising investment opportunities at the level of tree-based systems, species (products), and well-defi ned management practices for accelerating rural economic growth in the drylands.

The eastern part of the Mau Forest, the most important closed-canopy forest in East Africa, has come under severe threat since the 1990s. In this political ecology Lisa Fuchs exploring the failure of the government-led forest restoration and rehabilitation initiative to 'Save the Mau', launched in 2009, the author examines two of the most contentious issues in Kenya since colonial times: land and the environment. She sheds light on the structural factors and the role of individuals in the forest's destruction and of non-protection and traces the colonial legacy of post-independent environmental conservation policies and practices. In doing so, Fuchs demonstrates that the Mau crisis is more than an environmental crisis: it is also a political, an economic, and a socio-cultural crisis. Though a detailed empirical analysis, the author shows that the 'Mau crisis' led to the near collapse of landscapes and livelihoods in the Mau Forest ecosystem. She traces the implementation of insufficient conservation programmes, which resulted from historical path-dependency and the adoption of global environmental governance blueprints, forest allocation and benefits, and exposes a forest management system that prioritises commercial forest production over biodiversity conservation. Access and entitlements to the highly fertile forest land, and the amalgamation of forest rehabilitation with the reclamation of grabbed public forest are emphasised as a further core contributor to the crisis. The socio-cultural dynamics within and among various forest-dwelling communities, including the indigenous hunting and gathering Ogiek and 'in-migrant' groups, are also analysed. The book highlights that local types of environmentalism are caught between the 'invention of traditions' and 'perverse modernisation' and shows the contradictory effects of the celebrated, highly anticipated but poorly executed 'Save the Mau' initiative, and how the presence of political will to maintain the crisis conditioned its perseverance. Finally, the book proposes realistic alternatives to sustainable forest management in politicised environments, whose relevance and applicability are considerable in this age of anthropogenic 'environmental' crises and conflicts.
