The elaborate retrieval mechanisms that support such access are a product of technology. But technology is not enough. The effectiveness of a system for accessing information is a direct function of the intelligence put into organizing it. Just as the practical field of engineering has theoretical physics as its underlying base, the design of systems for organizing information rests on an intellectual foundation. The subject of this book is the systematized body of knowledge that constitutes this foundation. Integrating the disparate disciplines of descriptive cataloging, subject cataloging, indexing, and classification, the book adopts a conceptual framework that views the process of organizing information as the use of a special language of description called a bibliographic language. As the informational state replaces the bureaucratic welfare state, control over information creation, processing, flows, and use has become the most effective form of power. In Change of State Sandra Braman examines the theoretical and practical ramifications of this "change of state." She looks at the ways in which governments are deliberate, explicit, and consistent in their use of information policy to exercise power, exploring not only such familiar topics as intellectual property rights and privacy but also areas in which policy is highly effective but little understood. Such lesser-known issues include hybrid citizenship, the use of "functionally equivalent borders" internally to allow exceptions to U.S. law, research funding, census methods, and network interconnection. Formed as a result of the changes that give birth to the modern state, public law establishes the authority and legitimacy of modern governmental ordering. Public law today is a universal phenomenon, but its origins are European. Part I of the book examines the conditions of its formation, showing how much the concept borrowed from the refined debates of medieval jurists. Part II then examines the nature of public law. Drawing on a line of juristic inquiry that developed from the late sixteenth to the early nineteenth centuries-extending from Bodin, Althusius, Lipsius, Grotius, Hobbes, Spinoza, Locke and Pufendorf to the later works of Montesquieu, Rousseau, Kant, Fichte, Smith and Hegel-it presents an account of public law as a special type of political reason. The remaining three Parts unpack the core elements of this concept: state, constitution, and government. By taking this broad approach to the subject, Professor Loughlin shows how, rather than being viewed as a limitation on power, law is better conceived as a means by which public power is generated.
