This action is intended to immediately reduce overfishing on certain stocks managed by the Northeast (NE) Multispecies Fishery Management Plan (FMP), without jeopardizing the likelihood that overfished stocks can achieve rebuilding objectives until long-term measures can be implemented under Amendment 16 to the FMP. Measures for the commercial fishery include an expanded differential days-at-sea (DAS) area in Southern New England (SNE), where a vessel will be charged 2 days for every day fished, and modified groundfish trip limits. In addition, this action maintains the scheduled fishing year (FY) 2009 DAS reduction included in the FMP, which results in an approximate 18-percent reduction in Category A DAS. For private recreational vessels fishing in the Exclusive Economic Zone (EEZ), and for federally permitted charter/party vessels, this action extends in time a seasonal prohibition on the possession of Gulf of Maine (GOM) cod, and prohibits the possession of SNE/Mid-Atlantic (MA) winter flounder. For federally permitted charter/party vessels, this action implements a trip limit for Georges Bank (GB) cod. In addition, this action implements measures to mitigate some of the negative, short-term economic impacts of the FMP by expanding the Closed Area I (CA I) Hook Gear Haddock Special Access Program (SAP); modifying the DAS Leasing Program, the Regular B DAS Program, and the DAS Transfer Program; continuing the Eastern U.S./Canada Haddock SAP; and implementing a reduction in the haddock minimum size to 18 inches (45 cm) for both commercial and recreational vessels. This action also specifies management measures for the U.S./Canada Management Area for FY 2009. NMFS anticipates that the interim measures will need to be renewed upon the rule's expiration for an additional 185 days. Therefore, NMFS is requesting public comments on these measures; comments received will be considered during any subsequent action to extend this final interim rule. Due to the impact of these proposed measures on the monkfish fishery, this emergency action also limits participation of monkfish Category C, D, or F permits in the Regular B DAS Program and revises the method of calculating available monkfish-only DAS for Category C, D, F, G, or H monkfish vessels. Further, this action eliminates the daily and maximum trip limits for haddock for FY 2006. Also, because of the substantive nature of this emergency rule and the necessary shortened comment period on the proposed rule for this action, this rule is being implemented as an emergency interim action and seeks additional public comment. This action is intended to prevent overfishing while maintaining specific programs designed to help mitigate the economic and social impacts of effort reductions under the FMP until more permanent management measures can be implemented through Framework Adjustment (FW) 42 to the FMP. Book excerpt: "NOAA's National Marine Fisheries Service (NMFS) has prepared a Secretarial Amendment, under the authority of Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) section 304(c)1)(A), for the small-mesh multispecies component of the Northeast Multispecies Fishery Management Plan (FMP). The Secretarial Amendment is intended to establish a mechanism for specifying annual catch limits (ACLs) and accountability measures (AMs) for silver hake, red hake, and offshore hake, collectively known as 'small-mesh multispecies.' There are two stocks each of silver and red hake (northern and southern), and one stock of offshore hake. Offshore hake are primarily caught incidentally in the southern silver hake fishery and they are marketed together as 'whiting.' The New England Fishery Management Council (Council) is responsible for managing the small-mesh multispecies fishery through the Northeast Multispecies FMP and initiated the development of an amendment in 2009 (Amendment 19) to that management plan to implement ACLs and AMs for the small-mesh multispecies. However, development of Amendment 19 was delayed in order to incorporate the results from a stock assessment of all three species that occurred in November 2010 (Stock Assessment Workshop (SAW) 51.) The Magnuson-Stevens Act requires the establishment of the ACL and AM framework by 2011. NMFS is developing this action to meet that deadline and bring the small-mesh multispecies fishery into compliance with the Magnuson-Stevens Act. While the Secretarial Amendment does not have an expiration date, and would be in effect until Amendment 19, if approved, replaces it, NMFS intends for this amendment to act as a bridge for the small-mesh multispecies fishery and does not address the full suite of measures that the Council is developing for Amendment 19. In order to minimize confusion and ease the transition between the two amendments, NMFS chose as the preferred alternatives the most general and flexible from the Council's preliminary list of alternatives for Amendment 19. The Secretarial Amendment also proposes the same ACL framework mechanism that the Council is analyzing for Amendment 19, which is based on recommendations from the Council's Scientific and Statistical Committee (SCC)"--Executive summary (page i).

Book excerpt: "In this action, the National Marine Fisheries Service (NMFS) would adjust regulations governing the U.S. BFT fishery to : (1) Increase the General category maximum BFT daily retention limit from three to five fish (with limit adjustments to be executed via inseason actions when and if appropriate): (2) Allow the BFT General category season to remain open until the January subquota is reached or March 31 (whichever happens first): and (3) Increase the Harpoon category daily retention limit of BFT measuring 73 to 81 inches from two to four fish. This action is intended to enable more thorough utilization of the available U.S. BFT quota for the General and Harpoon permit categories: minimize bycatch and bycatch mortality to the extent practicable: expand fishing opportunities for participants in the commercial winter General category fishery: and increase NMFS' flexibility for selling the General category retention limit depending on available quota. This action would be consistent with the Magnuson-Stevens Fishery Conservation and Management Act, the Atlantic Tunas Convention Act, and the 2006 Consolidated Atlantic Highly Migratory Species Fishery Management Plan.
