The proposed action in Regulatory Amendment 11 is the elimination of a possession prohibition for six deepwater snapper-grouper species (snowy grouper, blueline tilefish, yellowedge grouper, misty grouper, queen snapper, and silk snapper) harvested in depths greater than 240 feet (40 fathoms) in the South Atlantic EEZ. The closure was implemented on January 31, 2011, through Amendment 17B to the Fishery Management Plan for the Snapper-Grouper Fishery of the South Atlantic Region (Amendment 17B). The purpose of the harvest prohibition approved in Amendment 17B is to reduce discards of speckled hind and warsaw grouper. However, there is evidence, from both public comments and new analysis of data, that the prohibition is not effective at its stated purpose and comes at a higher economic cost to fishermen than originally anticipated. A new analysis of landings data following the implementation of the prohibition indicates that different measures would be more appropriate to reduce discards of speckled hind and warsaw grouper than those implemented through Amendment 17B. Therefore, the Council has developed Regulatory Amendment 11 to remove the harvest prohibition implemented through Amendment 178. When a stock is undergoing overfishing, fishery managers must implement management measures to end overfishing. In cases where stocks are overfished, the Councils and NOAA Fisheries Service must implement rebuilding plans. NOAA Fisheries Service notified the South Atlantic Fishery Management Council (South Atlantic Council) of the status of the red grouper stock on June 9, 2010. The Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) requires the implementation of measures within two years of notification. Therefore, a rebuilding plan for red grouper in the South Atlantic must be in place by June 2012 to end overfishing and rebuild the stock. Besides establishing a rebuilding plan, the South Atlantic Council is proposing the implementation or revision of the following items through this amendment: (1) maximum sustainable yield (2) minimum stock size threshold (3) rebuilding schedule (4) rebuilding strategy and acceptable biological catch (5) allocations (6) annual catch limits and optimum yield (7) annual catch targets (8) accountability measures"--Executive summary.

The Gulf of Mexico is an open and dynamic marine ecosystem rich in natural resources but heavily impacted by human activities, including agricultural, industrial, commercial and coastal development. The Gulf of Mexico has been continuously exposed to petroleum hydrocarbons for millions of years from natural oil and gas seeps on the sea floor, and more recently from oil drilling and production activities located in the water near and far from shore. Major accidental oil spills in the Gulf are infrequent; two of the most significant include the Ixtoc I blowout in the Bay of Campeche in 1979 and the Deepwater Horizon Oil Spill in 2010. Unfortunately, baseline assessments of the status of habitats and biota in the Gulf of Mexico before these spills either were not available, or the data had not been systematically compiled in a way that would help scientists assess the potential short-term and long-term effects of such events. This 2-volume series compiles and summarizes thousands of data sets showing the status of habitats and biota in the Gulf of Mexico before the Deepwater Horizon Oil Spill. Amendment 20A addresses the commercial sector of the wreckfish component of the snapper-grouper fishery, which is managed under individual transferable quota program. The current total allowable catch for wreckfish for the commercial sector is 2 million pounds. In November 2011, the Council's Scientific and Statistical Committee (SSC) reviewed new data analysis regarding wreckfish, and revised their acceptable biological catch (ABC) recommendation from 250,000 pounds whole weight (ww) to 235,000 pounds ww. The Council reviewed the recommended ABC in December 2011, and passed a motion to concur with the process of adjusting the wreckfish annual catch limit (ACL) to reflect the revised ABC. NOAA Fisheries Service approved the Comprehensive ACL Amendment on January 18, 2012. This revised ACL for wreckfish will be implemented through the final rule for the Comprehensive ACL Amendment on April 16, 2012. Furthermore, 95 percent of the ACL (223,250 pounds ww) will be allocated to the commercial sector for wreckfish. With this reduction in the commercial sector's allowable catch, the annual allocation each wreckfish shareholder will receive under the revised ACL will also be reduced by approximately 89 percent. Thus, active shareholders, captains, crew, and dealers who depend on a certain level of wreckfish production to maintain their operations will be particularly affected by the reduction in the amount of wreckfish the sector may harvest. The actions contained in Amendment 20A would: (1) Define and revoke inactive wreckfish shares; (2) redistribute revoked shares to "active shareholders; (3) define a cap on the number of shares one entity may own; and (4) establish an appeals process for determinations of share status and redistribution.
