Book excerpt: Final Rule - Standard for the Flammability (Open Flame) of Mattress Sets (US Consumer Product Safety Commission Regulation) (CPSC) (2018 Edition) The Law Library presents the complete text of the Final Rule - Standard for the Flammability (Open Flame) of Mattress Sets (US Consumer Product Safety Commission Regulation) (CPSC) (2018 Edition). Updated as of May 29, 2018 The Consumer Product Safety Commission ("Commission") is issuing a flammability standard under the authority of the Flammable Fabrics Act. This new standard establishes performance requirements based on research conducted by the National Institute of Standards and Technology ("NIST"). Mattresses and mattress and foundation sets ("mattress sets") that comply with the requirements will generate a smaller size fire with a slower growth rate, thus reducing the possibility of flashover occurring. These improved mattresses should result in significant reductions in deaths and injuries associated with the risk of mattress fires. The Commission estimates that the standard could limit the size of mattress fires to the extent that 240 to 270 deaths and 1,150 to 1,330 injuries could potentially be eliminated annually. As discussed in the preamble, this means that the standard could yield lifetime net benefits of $23 to $50 per mattress or aggregate lifetime net benefits for all mattresses produced in the first year of the standard of $514 million to $1,132 million. The Commission is requiring a standard reference material cigarette, which was developed by the National Institute of Standards and Technology, as the ignition source for testing to the mattress standard. These standards are to be "substantially the same as" applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product. Book excerpt: An in-depth analysis of U.S. residential fire statistics shows that although the total number of fires and deaths due to mattress fires has dropped as a result of several regulatory approaches, the number of deaths per 1000 mattress/bedding fires has increased over past 3 decades. To address the increasing number of deaths due to mattress fires, the open flame mattress flammability regulation (16 CFR 1633) was recently introduced in the U.S. The 16 CFR 1633 prescribes performance standards rather than design standards; this allows manufacturers the flexibility to meet the needs of the consumer without sacrificing fire safety. This flammability regulation for residential mattress has generated much interest in understanding the burning behavior of mattresses as well as in developing new materials for mattress construction. To comply with this regulation, it is essential to understand mattress construction, fire performance testing, factors affecting mattress flammability, and compliance solutions. This report reviews the impact of current mattress flammability standards, examines factors affecting mattress flammability, and reviews full-scale and bench-scale test methods that are being developed for mattresses. The soft materials used in the mattress set, including cushioning materials, fire blocking materials, and tickings, act both individually and collectively to affect the fire performance. The performance of fire barrier materials designed to protect the inner cushioning material from heat and flame is largely dependent on the choice of cushioning material and ticking. When used with an incompatible combination of filling material and ticking, a fire barrier may fail to protect thermal degradation and subsequent burning of filling material. Some of the challenges in designing mattresses have been identified and reported here.

The focus is on development and application of a reproducible means of simulating the thermal impact which burning bedclothes materials impose on a mattress. Twelve dtfferent sets of bedclothes were burned on top of an inert mattress to obtain data on heat release rate, flame spread rates and, to a lesser degree, heat flux to nearby objects. Six of these sets were selected for characterization of the heat flux patterns they impose on an inert mattress surface. A unique, infrared imaging technique was developed for this purpose. The results, in terms of peak heat flux, duration and area, were used to develop a pair of propane burners which impose on the side and top of a mattress heat flux patterns which mimic those imposed at a typical, fixed location by burning bedclothes. These burners were applied to a set of five mattress designs, including one typical of current residential mattresses; the four other designs included potentially less flammable design elements to permit a wide range of fire behaviors. This facilitated a broad assessment of the ability of the gas burners to predict the fire behavior of mattresses. The duration of the burner application was varied. Also, as a check on the burner-induced behavior, the same mattress designs were tested with one bedclothes combination. All of the altered designs offered some modification in fire behavior but they differed strongly in overall effect. The effects ranged from a delay in the time to reach an undiminished heat release rate peak to greatly reduced mattress involvement in the fire. The burners successfully predicted the behavior of four of the mattress designs. They failed to predict the fire behavior (with burning bedclothes) of one design since the bedclothes produced a phenomenon (internal overpressurization and seam rupture) which the burners did not produce.

Book excerpt: The Consumer Product Safety Commission has broad regulatory authority over thousands of consumer products. Mandatory safety standards for matchbooks, aluminum wire systems, and television receivers are being developed or planned under the Consumer Product Safety Act, and two other standards will have significant fire safety aspects. Regulation under the Flammable Fabrics Act has resulted in mandatory standards for children's sleepwear, clothing, carpets and rugs, and mattresses.

Book excerpt: Effective July 1, 2007, the U.S. Consumer Product Safety Commission promulgated a Standard that would severely reduce the heat release rate and the early heat output from mattresses and foundations that had been ignited by a flaming ignition source. Mattresses complying with this Standard have now been sold for more than a decade. This study establishes a methodology for evaluating the effect of this Standard on the number of bed fires and the extent of their fire spread, fatalities, and injuries, and then estimates the Standard's success over its first decade. Because it is possible there were changes other than the Standard that affected the outcome of bed fires, the study normalized the changes to the numbers of residential upholstered furniture (RUF) fires, all residential fires, and all bed fires. The Standard is accomplishing its purpose, resulting in considerable reductions in fatalities and injuries from bed fires ignited by flaming sources. Approximately 65 fatalities were prevented annually during the two-year period 2015-2016. Relative to RUF fires, flaming ignitions of beds led to decreases in the numbers of fires by 12 %, injuries by 34 %, and deaths by 82 % between 2005-2006 and 2015-2016. Per bed fire, injuries decreased by 25 % and fatalities decreased by 67 %. The decreases in injuries and, especially, fatalities are larger than the decrease in the number of fires, suggesting that the most severe fires are being prevented by the Standard. There was no systematic evidence that the calculations were significantly affected by (1) the calculation method for calculating the replacement rate of pre-Standard mattresses, (2) variability in fire reporting among fire departments, (3) whether the initial combustible was reported as the mattress or bedding, or (4) whether the mattress or bedding was reported as the item most contributing to flame spread.
