El título del libro Filosofía del Derecho y Constitución nos señala la tesis que en él se mantiene: La insuficiencia del solo texto de la Constitución para dar cuenta de la constitución viva, con lo que para interpretar la Constitución habrá que atender no solo a su texto sino a lo que hay por encima, por detrás y por delante de ella, lo que la posibilita, la condiciona y la continúa. De esta forma, el autor concibe la Constitución como norma fruto de la concurrencia de valores, prácticas, instituciones, relaciones y afectos. Lo que hoy se denomina constitución invisible que ilumina el texto visible. Esto es, desde los sobreentendidos de cada concepto cobijados en los términos lingüísticos de cada constitución y de ahí la importancia de la lengua original y de los géneros lingüísticos utilizados por el constituyente, hasta las influencias doctrinales y las fuentes de la Constitución. Según sostiene el autor, el jurista, por tanto, debe conocer las cosas que el derecho regula. El constitucionalista no puede ignorar la realidad política que la Constitución trata de racionalizar. A eso se referían los antiguos al definir la jurisprudencia como el conocimiento de todas las cosas divinas y humanas. Pero, además, no puede prescindir de una concepción del hombre que tome como referente su dignidad.
