Book excerpt: The Romans depicted the civil law as a body of rules crafted through communal deliberation for the purpose of self-government. Yet, as Clifford Ando demonstrates in Law, Language, and Empire in the Roman Tradition, the civil law was also an instrument of empire: many of its most characteristic features developed in response to the challenges posed when the legal system of Rome was deployed to embrace, incorporate, and govern people and cultures far afield. Ando studies the processes through which lawyers at Rome grappled with the legal pluralism resulting from imperial conquests. He focuses primarily on the tools—most prominently analogy and fiction—used to extend the system and enable it to regulate the lives of persons far from the minds of the original legislators, and he traces the central place that philosophy of language came to occupy in Roman legal thought. In the second part of the book Ando examines the relationship between civil, public, and international law. Despite the prominence accorded public and international law in legal theory, it was civil law that provided conceptual resources to those other fields in the Roman tradition. Ultimately it was the civil law's implication in systems of domination outside its own narrow sphere that opened the door to its own subversion. When political turmoil at Rome upended the institutions of political and legislative authority and effectively ended Roman democracy, the concepts and language that the civil law supplied to the project of Republican empire saw their meanings transformed. As a result, forms of domination once exercised by Romans over others were inscribed in the workings of law at Rome, henceforth to be exercised by the Romans over themselves.

Book excerpt: Thessaly was a region of great importance in the ancient Greek world, possessing both agricultural abundance and a strategic position between north and south. It presents historians with the challenge of seeing beyond traditional stereotypes (wealth and witches, horses and hospitality) that have coloured perceptions of its people from antiquity to the present day. It also presents a complex and illuminating interaction between polis and ethnos identity. In daily life, most Thessalians primarily operated within, and identified with, their specific polis; at the same time, the regional dimension – being Thessalian – was rarely out of sight for long. It manifested itself in stories told, in deities worshipped, in modes of political co-operation, in language, rituals, sites and objects. Chapter by chapter, this book follows the emergence, development and adaptation of Thessalian regional identity from the Archaic period to the early second century BC. In so doing, rather than rejecting ancient stereotypes as a mere inconvenience for the historian, it considers the constant dialogue between Thessalian self-presentation and depictions of the Thessalian character by other Greeks. It also confronts some of the prejudices and assumptions still influencing modern approaches to studying the region. All in all, the reader is invited to see Thessaly not as a region of marginal significance in Greek history, but as occupying a central role in many aspects of ancient cultural and political discourse.

The opportunity has been taken to correct or excise errors, but otherwise nothing has been removed unless superseded by more recent publications.

Most importantly, Erica Daes was the principal drafter of the UN draft declaration on the rights of indigenous peoples, which has become known as the Daes Declaration and which is reproduced in an annex to this book. Texts like inscriptions and letters have gained importance in classical scholarship, but there has been limited analysis of the imaginative and sociological dimensions of the ancient document. Individual chapters investigate the definition of the document in ancient thought, and how modern understandings of documentation may (mis)shape scholarly approaches to documentary sources in antiquity. Contributors reexamine familiar categories of ancient documents through the lenses of perception and function, and reveal where the modern understanding of the document departs from ancient conceptions of documentation. The boundary between literary genres and documentary genres of writing appears more fluid than prior scholarship had allowed. Compared to modern audiences, inhabitants of the Roman Empire used a more diverse range of both non-textual and textual forms of documentation, and they did so with a more active, questioning attitude. The interdisciplinary approach to the "mentality" of documentation in this volume advances beyond standard discussions of form, genre, and style to revisit the document through the eyes of Greco-Roman readers and viewers.

The complementarity of both regimes currently enjoys the status of the new orthodoxy and simultaneously invites critical reflection. This collection of essays accepts the invitation, offering diverse assessments of the merits of taking human rights to the battlefields of the twenty-first century. The book comprises three parts: part I focuses on the paradigmatic (security based "armed conflict" vs. human rights centered "law enforcement" paradigms) and the normative complexities of the interaction between both regimes in the "fight against terror" and in other, allegedly new, types of wars. Part II discusses the interplay between IHRL and IHL in the context of three specific regimes: belligerent occupation; the European Court of Human Rights and the protection of cultural heritage. Part III explores the potential fusion of IHL and IHRL into a new paradigm in two areas: post-bellum accountability and compensation to victims of war crimes.
