Available in PDF, EPUB and Kindle. Book excerpt: Nation-Building and Federalism in Nepal primarily deals with the presentation and elucidation of identity-based federalism, a unique concept and a novel form of federalism. The most notable source of first-hand information was garnered through the author's involvement in constitution-making by proxy, as a member of the High-Level State Restructuring Recommendation Commission and as a facilitator of several interaction programmes conducted in dialogue form: that is, dialogues with citizens, stakeholders, members of the Constituent Assembly, office-bearers within political parties (intra-party), and leaders across the parties (inter-party). This book, therefore, discusses these issues and helps provide insights into the politics behind the parties' shifting positions on contentious issues related to the constitution at the time of its making; understand better the conflicting aspirations from and competing perceptions of restructuring the Nepali state among the people from different ethnic backgrounds; and capture the role played by intermediate agencies at a critical time of its constitution-making (2006-2015).

Book excerpt: This book systematically analyzes why constitutions do not survive in Nepal, despite sixty years of constitutional history. The author discusses the epistemology of ethnic federalism in Nepal and examines the challenges of nation building and post-nation constitutionalism. The work addresses the connection between ethnic identity, right to self-determination, constitution making and state restructuring, offering possible ways forward for Nepal. Chapters consider lessons to be drawn from the past and examine reasons for the abolition of monarchy in Nepal. The book highlights the major problems that the first elected Constituent Assembly (CA) faced in promulgating a new constitution, before it was dissolved in 2012. The concept of right to self-determination and its complexities at the domestic level are all explored, along with ways forward to address the problem of constitutionalism, ethnic federalism and democracy. The author offers solutions as to how the second CA could address problems to promulgate a new constitution. The book elaborates on the role that constitutionalism plays in constitution making and the survival of a constitution. Scholars of politics and international studies, policy makers and those with an interest in law and constitution in Asia will all find this work of interest.

Book excerpt: The restructuring of state implies many things to many people but it has been conceptualized differently in the book in the context of the new Nepal. The agenda set by the jan andolan second (2006) has taken Nepali politics much ahead both in quality and from. The old institutions are likely to be replaced by new ones and the meaning of democracy is redefined relating it to the empowerment of people. A few other South Asian scholars have added significance to the book by contribution papers to their specific domestic areas. The tumultuous changes under way in Nepal can thus be seen in larger canvas of South Asia too.

Book excerpt: This publication examines progress on the four main components of fiscal decentralization in Nepal since the country’s shift to a federal structure of governance in 2015. It covers the constitutional and legislative framework, implementation, reform efforts, and recommendations in (i) public expenditure assignment and budgeting, (ii) revenue mobilization, (iii) intergovernmental fiscal transfers, and (iv) subnational borrowing. The report also provides an overview of the institutional arrangements in Nepal for achieving the objectives of fiscal federalism, highlights reforms still needed, and draws lessons for a robust fiscal decentralization framework. It could also be useful to policymakers and stakeholders contemplating a similar state transition in other countries.

Book excerpt: This book draws on experiences in developing countries to bridge the gap between the conventional textbook treatment of fiscal decentralization and the actual practice of subnational government finance. The extensive literature about the theory and practice is surveyed and longstanding problems and new questions are addressed. It focuses on the key choices that must be made in decentralizing, on how economic and political factors shape the choices that countries make, and on how, by paying more attention to the need for a more comprehensive approach and the critical connections between different components of decentralization reform, everyone involved might get more for their money.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers an in-depth analysis of the interrelationship between long-standing caste discrimination in Nepal, its vicious circle of impact upon the Dalit groups and the changes brought by the recent political transformations. It explores the links between identity politics, Dalit struggle and Dalit rights although Dalit identity is contested within the group. The author explores the types of institutional measures that would be required to achieve social justice for Dalit in Nepal and analyses the underlying causes and nature of the deeply entrenched social, economic, education and political inequality manifested in the life cycle of Dalit. The book examines contemporary political transformations, including state restructuring and federalism processes, and explores different models of federalism by a variety of experts in detail; this is done with a view to making specific findings on the required institutional reform measures for the improvement of Dalit inclusion and representation in state mechanisms and policies. This book contributes to the literature on the caste and Dalit discourse by proposing that the hegemonic caste structure is deeply entrenched and needs to be deracinated by asserting unified group politics of recognition in Nepal. Political Transformations in Nepal will be of interest to academics working on South Asian Politics, Identity Politics, and Asian Social Policy.

Book excerpt: This report identifies potential reforms that ADB could support to reduce governance vulnerabilities as Nepal transitions to a new federal system of government. With the adoption of its new constitution on 20 September 2015, Nepal became a federal democratic republic. Since then, the country's transition from a unitary system of government to the new federal system has been ongoing and remains a challenging process. The report examines the evolving institutional arrangements, challenges, and governance risks for the sectors in which ADB operates. It also identifies potential reform measures that ADB could support to help address these governance risks. The report aims to contribute to the preparation of ADB's 2020-2024 country partnership strategy for Nepal.

Book excerpt: In November 2011, the Supreme Court of Nepal ruled in favour of a fourth extension for the promulgation of the constitution. A final deadline of 27 May 2012 was set for the delivery of this mandate. However, once again the task has not been fulfilled and this stalemate will certainly push Nepal into a deeper political crisis. Inter- and intra-party politicking, ideological clashes and the inability to reach a consensus on the state's restructuring process on the basis of ethnic federalism have altogether hampered the major political parties from working together. Although some political headway has been made in the recent months, the transition to a federal democratic republic and the overall peace process in Nepal will remain incomplete if a constitutional crisis persists.

Available in PDF, EPUB and Kindle. Book excerpt: "While there is extensive knowledge about how to design fiscal decentralization policies, considerably less is understood about how a decentralization program should be sequenced and implemented. Countries embarking on decentralization often struggle with decisions about the essential components of decentralization, including the order of an introduction of decentralization policies, the number of years necessary to bring a full program on line, and the components of the transition strategy. The authors argue that the sequencing of decentralization policies is an important determinant of its success. The consequences of a poorly sequenced decentralization program can range from minor delays and complications to ineffectiveness and subsequent failing support of decentralization efforts, macroeconomic instability, and fundamental failure in public sector delivery. At a minimum, the strategy of "making it up as we go" will not lead to the same structure of decentralization as will a planned strategy. The paper raises two questions: First, is there an optimal sequencing for decentralization policies and implementation? The answer is that there is, and that following these sequencing rules can reduce the costs and risks of implementing fiscal decentralization. Second, to what extent do countries follow these optimal sequencing rules? The answer is, in general, they do not. The gap between theory and practice is a result of the complexity of sequencing design, which discourages fiscal planners from implementing the full process. In addition, sequencing requires a sustained discipline and vision for its implementation, as well as overcoming pressures from political actors, especially in developing countries.
