Book excerpt: The author's aim in writing this book has been to present in an elementary way the leading facts concerning the organization and activities of national, state, and local government in the United States. He has given rather greater emphasis than is customarily done in textbooks of this character to what may be called the dynamics of government, that is, its actual workings, as contradistinguished from organization. Likewise, the author has highlighted the activities and methods of political parties, party conventions, primaries, the conduct of political campaigns, the regulation of campaign methods, and the like. The increasing importance of citizenship has led the author to devote a chapter to that subject.

Book excerpt: This book offers an overview of the legal, political, and broad intergovernmental environment in which relations between local and state units of government take place, the historical roots of the conflict among them, and an analysis of contemporary problems concerning local authority, local revenues, state interventions and takeovers, and the restructuring of local governments. The author pays special attention to local governmental autonomy and the goals and activities of local officials as they seek to secure resources, fend off regulations and interventions, and fight for survival as independent units. He looks at the intergovernmental struggle from the bottom up, but in the process examines a variety of political activities at the state level and the development and effects of several state policies. Berman finds considerable reason to be concerned about the viability and future of meaningful local government.

Book excerpt: Policymakers and program managers are continually seeking ways to improve accountability in achieving an entity's mission. A key factor in improving accountability in achieving an entity's mission is to implement an effective internal control system. An effective internal control system helps an entity adapt to shifting environments, evolving demands, changing risks, and new priorities. As programs change and entities strive to improve operational processes and implement new technology, management continually evaluates its internal control system so that it is effective and updated when necessary. Section 3512 (c) and (d) of Title 31 of the United States Code (commonly known as the Federal Managers? Financial Integrity Act (FMFIA)) requires the Comptroller General to issue standards for internal control in the federal government.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Book excerpt: This book introduces students to the complex landscape of state-local intergovernmental relations today. Each chapter illustrates conflict and cooperation for policy problems including the response to the COVID-19 pandemic, environmental regulation, marijuana regulation, and government management capacity. The contributors, leading experts in the field, help students enhance their understanding of the importance of state-local relations in the U.S. federal system, argue for better analysis of the consequences of state-local relations for the quality of policy outcomes, and introduce them to public service career opportunities in state and local government.

Book excerpt: Black & white print. American Government 3e aligns with the topics and objectives of many government courses. Faculty involved in the project have endeavored to make government workings, issues, debates, and impacts meaningful and memorable to students while maintaining the conceptual coverage and rigor inherent in the subject. With this objective in mind, the content of this textbook has been developed and arranged to provide a logical progression from the fundamental principles of institutional design at the founding, to avenues of political participation, to thorough coverage of the political structures that constitute American government. The book builds upon what students have already learned and emphasizes connections between topics as well as between theory and applications. The goal of each section is to enable students not just to recognize concepts, but to work with them in ways that will be useful in later courses, future careers, and as engaged citizens. In order to help students understand the ways that government, society, and individuals interconnect, the revision includes more examples and details regarding the lived experiences of diverse groups and communities within the United States. The authors and reviewers sought to strike a balance between confronting the negative and harmful elements of American government, history, and current events, while demonstrating progress in overcoming them. In doing so, the approach seeks to provide instructors with ample opportunities to open discussions, extend and update concepts, and drive deeper engagement.

This book covers not only the basics of preemption but also focuses on such topics as federal mechanisms for agency preemption, implied forms of preemption, and defensive use of federal preemption in civil litigation.

Available in PDF, EPUB and Kindle. Book excerpt: Challenging the myth that the federal government exercises exclusive control over U.S. foreign-policymaking, Michael J. Glennon and Robert D. Sloane propose that we recognize the prominent role that states and cities now play in that realm. Foreign Affairs Federalism provides the first comprehensive study of the constitutional law and practice of federalism in the conduct of U.S. foreign relations. It could hardly be timelier. States and cities recently have limited greenhouse gas emissions, declared nuclear free zones and sanctuaries for undocumented immigrants, established thousands of sister-city relationships, set up informal diplomatic offices abroad, and sanctioned oppressive foreign governments. Exploring the implications of these and other initiatives, this book argues that the national interest cannot be advanced internationally by Washington alone. Glennon and Sloane examine in detail the considerable foreign affairs powers retained by the states under the Constitution and question the need for Congress or the president to step in to provide "one voice" in foreign affairs. They present concrete, realistic ways that the courts can update antiquated federalism precepts and untangle interwoven strands of international law, federal law, and state law. The result is a lucid, incisive, and up-to-date analysis of the rules that empower-and limit-states and cities abroad.

Book excerpt: Excerpt from State and Municipal Government in the United States In spite of the importance and interest of international and national questions of policy and in spite of the rapidly widening sphere of federal legislation and administration the life of an American citizen is affected more often by the agencies of local government than by those of the national government. Under the protection of the Federal Constitution the life and property of the citizen are governed and protected by state, not federal, laws. In his political capacity the citizen takes part in both the federal and the local government in accordance with state regulations. Acting under the state laws are the particular political units in which the citizen may reside - the county, city, or town. To the authorities of these the citizen most fre quently looks for governmental support and regulation. Yet these local bodies are distinctly subordinate to and created by the authority of the state and are supervised and regulated by it. It is the purpose of this book to discuss the organization, the distribution of powers and functions, and the operation of these agencies of local government. Other books have dealt with state government and state administration or with munici pal government and municipal administration, but this book covers both state and municipal government, treating the two as a single manifestation of local government. With this in mind the book has been divided into five parts. In Part I the federal system and the state constitutions as the fundamental basis of local government are discussed. Part II deals with the political system - the electorate in theory and in action, in primaries, in election campaigns, and in its direct action in the use of the initiative, referendum, and recall. Part III deals with state government - the different organs and the functions which these organs perform. State administration, which is rapidly being extended both directly and through the supervisory power of the state, is discussed in its various manifestations.
