Book excerpt: Office of Management and Budget Circular No. A-76 establishes policies relating to the reliance of the Federal Government on the private enterprise system to provide its needed goods and services. This research effort focuses on the key role of the Navy Field Procurement System Contracting Officer in implementing the Circular's principles. This is accomplished by first reviewing policy development and implementation efforts; second, by establishing a framework from which to view the role of the Contracting Officer in the process; and last, by identifying problem areas he faces in carrying out policy directives. Department of Defense implementation via the Commercial Industrial Type Activities (CITA) program is presented. The acquisition and contracting aspects of the program are treated in some detail. Conclusions regarding the effectiveness of the acquisition process in support of program development are presented along with recommendations to assist in implementation efforts. (Author).

Book excerpt: The Office of Management and Budget has recently modified its Circular A-76, which governs the executive policy for the competition of commercial activities. This report provides a brief history of OMB Cir. A-76, a discussion of its place in the legal implementation of the Federal procurement policy, and a review of the main components of the Circular. Important for understanding the Circular is an understanding of the concepts of "commercial activity" and "inherently governmental activity." These two concepts will be emphasized in the discussion. There are several bills pending in the 108th Congress which could affect the implementation of Circular A-76 generally, or as it would apply to a specific Department. These are: H.R. 2691, H.R. 2650 and S. 1363, placing limitations on the Secretary of Interior; H.R. 2658, placing restrictions on the Department of Defense; H.R. 2673, placing restrictions on the Secretary of Agriculture; and H.R. 2989, placing restrictions on the appropriations for the Departments of Transportation and Treasury and independent agencies (OMB is one of these independent agencies).

Book excerpt: This report provides information on the Office of Management and Budget's (OMB) Circular A-76, "Performance of Commercial Activities," and the impact of a related reform initiative, the Federal Activities Inventory Reform Act (FAIR) of 1998, within the Department of Defense. The Circular defines federal policy for determining whether recurring commercial activities should be outsourced to commercial sources, Governmental facilities, or through inter-service support agreements. The FAIR Act creates statutory reporting requirements for federal executive agencies, by requiring Federal executive agencies to identify activities "not inherently governmental" and consider outsourcing through managed competitions. However, FAIR does not require that agencies contract out these activities.
