Available in PDF, EPUB and Kindle. Book excerpt: In 1825, the U.S. Supreme Court stated: “The Courts of no country execute the penal laws of another.” One hundred and fifty one years later, in a very different world, the United States signed prisoner transfer treaties with its neighbours, Canada and Mexico. Today, through additional bilateral treaties and multilateral treaties negotiated under the auspices of the Council of Europe and the Organization of American States, the United States has prisoner transfer treaty relations with 77 countries. This treatise, designed for prosecutors, defense attorneys and academics, describes in detail the legal basis and operation under these treaties from the perspective of the United States by the former Department of Justice official responsible for their initial implementation. Additional titles by Michael Abbell include: • Extradition to and from the United States 2010 • Obtaining Evidence Abroad in Criminal Cases 2010 This is the final Edition, there will be no further updates for this series.

Book excerpt: The fight against today's new forms of criminality, across Europe and beyond, can only succeed if we have the necessary tools, in particular through effective mechanisms dealing with extradition. For over fifty years, the Council of Europe has been developing a set of instruments dealing with extradition, be it in the form of conventions or resolutions and recommendations to member states. This publication presents notes and comments on the Council of Europe's legal instruments on extradition. It includes the current status of the case law of the European Court of Human Rights on extradition matters and on other transnational criminal proceedings. It also brings together the non-binding instruments on extradition adopted by the Council of Europe's Committee of Ministers. Practitioners, policy makers and researchers dealing with extradition matters will find this publication a useful and up-to-date reference document.
Book Synopsis The Disqualification Triad by : Gert Vermeulen
Download or read book The Disqualification Triad written by Gert Vermeulen and published by Maklu. This book was released on 2012 with total page 343 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the past decades, the European Union has made little progress with respect to disqualifications as a sanction mechanism for the violation of laws. The creation of some form of harmonization is necessary, but the complex nature of this specific sanction mechanism has caused policy initiatives to be postponed, time after time. In answer to a call from the European Commission, the contributors in this book have conducted a comparative legal analysis in the EU 27 and looked into the practical experiences with disqualifications from a domestic and a cross border perspective. To that end, academics, policy makers, and practitioners in the Member States have been consulted. Analysis reveals a wide variety in the typology of the disqualifications as a sanction measure, the typology of the persons to whom the disqualifications can be imposed, and the typology of the authorities involved. Furthermore, there are considerable differences with respect to the inclusion of disqualifications in the national criminal records databases. Linked thereto information on foreign disqualifications is scarce and rarely used in practice. To ensure a comprehensive and consistent policy approach, this book has come up with a so called disqualification triad, comprising: (1) unified EU-wide disqualifications, (2) mutual recognition of disqualifications, and (3) EU-wide equivalent effect of disqualifications. The functioning of the disqualification triad has been further elaborated on in three case studies, which are public procurement disqualifications, disqualifications from working with children, and driving disqualifications. In doing so, this book is essential reading for both EU and national policy makers, as well as for researchers and practitioners involved. This book was released on 1987-01-01 with total page 518 pages. Available in PDF, EPUB and Kindle. Book excerpt: Text no. 1: The variety of topics covered & the quality of the contributors make these two volumes a necessary part of any law library in the world. The essays are designed to overlap in the well-tested & established fields & branches of law dealing with contemporary issues which lawyers, diplomats, political scientists, politicians & research scholars are familiar with. The essays fully demonstrate the depth of knowledge of the eminent professors & specialists who have written them. The two volumes of essays are divided into seven parts. Volume One, entitled Contemporary International Law & Human Rights , focuses essentially on subjects relating to International Law & is divided into three sections. Part one of the first volume encompasses Topics in International Law such as Some New Thoughts on the Codification of International Law by his Excellency Judge Roberto Ago; Evidence in the Procedure of the International Court of Justice: The Role of the Court by His Excellency Judge Manfred Lachs; The Validity of International Law: an Empirical Experiment by Professor Georg Schwarzenberger, with a particularly engaging & incisive Introduction to the two volumes of Essays by Professor Ian Brownlie, Q.C. Human rights subjects still hold pride of place in the thinking of many legal experts & scholars & that is clearly reflected here. The title of the second volume is African Law & Comparative Public Law. Part Five of the essays contains topics of interest in the African Legal system which has its roots in the British Common Law System. Constitutional Law is broadly covered in part six which forms a section of its own in Volume Two. Text no. 2: This Festschrift pays tribute to Judge Taslim Olawale Elias, the leading African exponent of International Law to date. The two volumes of essays are divided into seven parts. The first volume focuses essentially on subjects relating to International Law & is divided into three sections. Part one of the first volume encompasses Topics in International Law such as Some New Thoughts on the Codification of International Law by His Excellency Judge Roberto Ago; Evidence in the Procedure of the International Court of Justice: The Role of the Court by His Excellency Jugde Manfred Lachs; The Validity of International Law: an Empirical Experiment by Professor Georg Schwarzenberger, with a particularly engaging & incisive Introduction to the two volumes of Essays by Professor Ian Brownlie, Q.C. Human Rights subjects still hold the pride of place in the thinking of many legal experts & scholars which is clearly reflected here. Part five of the essays contains topics of interest in African Legal system which took its roots from the British Common Law System. Constitutional Law is bloadly covered in part six which forms a section of its own in volume two. Quite apart from the variety of topics covered in this festschrift, the quality of the contributors to it, makes the whole exercise a necessary part of an important collection of any law library in the world. The framework of the essays suggest that they are designed to overlap in the well-tested & established field of law & those branches of law dealing with contemporary issues which lawyers, diplomats, political scientists, politicians & research scholars are familiar with. The richness of the festschrift is matched only by the mutually reinforcing manner in which the presentation was made. The essays fully demonstrate the depth of knowledge of the eminent professors & specialists wh
