Book excerpt: The radical changes taking place in the international scene during the late 1980s have presented the European Communities with important new challenges. The twelve Member States agreed that the only way to respond effectively to this new situation was to speed up the European integration process, and in December 1990 two Intergovernmental Conferences were inaugurated, focusing respectively on the development of an Economic and Monetary Union and a Political Union. It was the difficult task of the Luxembourg and Dutch Presidencies to channel the often very diverging positions of the different actors in the process into one coherent set of amendments to the Treaties forming the European Communities. This publication examines the positions which the different Member States, the Commission and the European Parliament have been defending in the Intergovernmental Conference on Political Union and more particularly with regard to one of the most sensitive topics under discussion, namely the development of a Common Foreign and Security Policy (CFSP). The introduction places the debate on the development of a Political Union and a CFSP in an historical perspective and gives an overview of the progression of the negotiations. The concluding chapter presents a general framework for better understanding of the course and results of the negotiations, and a critical evaluation of the outcome. The annexes reproduce the main proposals on the development of a CFSP submitted to the Conference.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a detailed examination of the complex negotiation processes surrounding intergovernmental conferences in the European Union. Since the Treaty of Amsterdam (1997) and its ‘appendix’, the Treaty of Nice in 2002, any reform of the treaty framework of the European Union seems to be doomed to fail, evidenced by the decline of the Constitutional Treaty and by the current fate of the Lisbon treaty. By presenting an extensive quantitative study of the Intergovernmental Conference of 1996/7 prior to the Treaty of Amsterdam, the authors argue that these negotiations reveal the major challenges of European integration. Drawing on advanced statistical methods, they contend that multi-level negotiations require an appropriate coordination of informal administrative networks and the empowerment of administrative leadership, with these factors significantly shaping the dynamics and outcomes of negotiations. Through these findings, this book lays down the foundation for future evidence-based evaluations of negotiations and implementation studies, and delivers new insights on decision-making within the European Union. European Union Intergovernmental Conferences will be of interest to students and researchers of political science, sociology, administrative science, business and management studies, international law and European law.

It explains why the ten applicant countries wanted to join the EU and how they succeeded after lengthy negotiations. Each chapter is a cutting-edge overview by a leading figure in the field and subjects covered include: * the enlargement-integration debate * the politics of the EU's new member states * the role of the European Convention * the political economy of an enlarged Europe * the challenges of developing common European foreign and security policy * the EU's relations with its neighbours * EU-American relations.

This most distinguished and experienced group of key European opinion-formers offer a sharp critique of existing institutions and a ten-point plan for a fulfilment of the pro-European vision. An institutional structure initially conceived for a community of six must be radically transformed to serve a potential union of some thirty members. The transition to economic and monetary union, the legitimacy crisis of European institutions are among the crucial issues discussed. Jacques Delors assesses the reform proposals in his foreword.

Book excerpt: The debate about the relationship between international and community law usually centres on the question of which of these two 'belongs' to the other, and how 'special' community legal order is in relation to international law. In this volume, a distinguished group of Finnish and British academics and practitioners break new ground by, instead of becoming mired in these questions, clearly examining the international law aspects of the activities of the Community and the Union. In doing so, they have elucidated points of connection and possible points of conflict. The result is a thought-provoking collection of essays which examines community law through the conceptual grid of international law, and thus enriches our understanding of the workings of both.

Book excerpt: The European Union Intergovernmental Conference (IGC) opened on 23 July 2007 and was initiated following a report originally produced by the German Presidency on the "Treaty establishing a Constitution for Europe" (Constitutional Treaty, Cm.6429, ISBN 9780101642927), which in turn led to a "Draft IGC Mandate" setting out a detailed prescription on issues raised by the above report, circulated by the Presidency of the European Council. The report itself recommended a "Reform Treaty" which would amend existing treaties and so required an intergovernmental conference. The European Scrutiny Committee has set out a number of conclusions, including: the Committee questioned the aims of the European Council in engaging with EU citizens on the EU Constitution whilst setting out changes to the constitution in an essentially secretive manner; that the substance of the Reform Treaty is substantially equivalent to the Constitutional Treaty itself; the Committee is concerned about the UK's position under the Charter; that the UK retains opt-outs that were previously arranged under the Constitutional Treaty will still be retained under the Reform Treaty; that the proposals in the Reform Treaty raise a serious difficulty of a constitutional order, appearing to impose a legal duty on national parliaments to the European Union itself, the Committee calls such a legal duty on Parliament, objectionable, and states that as a matter of principle it should be resisted.

Book excerpt: The European Union is a key participant in international organisations with its involvement taking different forms, ranging from full membership to mere observer. Moreover, there is also not only one status of observer, but different ones depending on the constituent charters of the organisations. This book provides a comprehensive overview of the participation of the EU in five international organisations: the UN, the ILO, the WTO, the WHO and the WIPO. It identifies its role and influence in diverse areas of global governance, such as foreign policy, peace, human rights, social rights, trade, health and intellectual property. EU and international experts, diplomats and scholars have contributed to this book to give an overview of the different aspects linked to the participation of the EU in these organisations and to the coordination that takes place internally with its Member States. They also examine the EU's actual influence in the various areas and its contribution to global governance. The combination of these two dimensions allows the work to identify the strengths and weaknesses of the participation of the EU in these five international organisations. The book provides valuable insights for scholars, policymakers and is useful for representatives of other international organisations and civil society actors.

Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2002. This volume aims to provide fresh insight into the complex struggles of the European Union (EU) institutions and the member states over who should negotiate trade issues on Europe's behalf. The book makes effective use of new empirical data on the daily operations of European trade policy based on interviews with high-ranking trade officials. Furthermore, this text is the first institutionalist analysis of the Amsterdam and Nice Intergovernmental Conferences (IGCs) in regards to the Common Commercial Policy (CCP). In sum, it provides the reader with an introduction into the field of international trade regulation from an EU perspective. Presented within the context of the long-standing institutional debate and using case studies on the operation of the CCP in the 1990s, this book facilitates a deeper understanding of the challenges facing Europe in the 21st century.
