Book excerpt: Geographical Indications (“GIs”), a type of intellectual property rights, are distinctive signs that identify a product based on the geographical territory or region where the product originates. In practice, GIs are used as marketing tools to promote a particular region or in the consumer market to enhance credibility or grant awareness of a particular product's origin. In recent years, GIs became effective marketing tools in a global economy, especially with respect to wine products. European winemakers classify their wines using appellations of origin, a system that establishes nomenclature according to the geographical location where the grapes of each wine product originate. Accordingly, the European Union advocates strong protection of GIs of wines and denounces wine products labelled with GIs that do not correspond with their geographical origin. Conversely, the United States and other non-European winemakers have stubbornly taken a less rigid posture towards global and national GI protection of wines. In September 2010, the disparity between non-European and European winemakers gained additional attention when Australia ratified an agreement (2008 Wine Trade Agreement Between Australia and the European Communities) that creates stricter legal protection for European wines and prohibits Australian wine products from using semi-generic wine names originating in the European Union, including Champagne. Presently, the United States does not have a wine trade agreement with the European Union that sufficiently protects the semi-generic wine names of foreign wine products from production in the United States. This Note argues that the United States should adopt a heightened system of GI protection for semi-generic wine products to halt the continued dilution of semi-generic wine product names in the international consumer wine market.

Book excerpt: Geographic indications (GIs) stand at the intersection of three hotly debated issues in international law: international trade, intellectual property and agricultural policy. Similar to a trademark (albeit to a limited degree), a GI identifies a good as originating in a particular region, where a given quality of the good is attributable to its place of origin. Well-known GIs include champagne and prosciutto di Parma. Although GIs have a long history, in recent years they have become central to the debate over the expansion of intellectual property rights in the World Trade Organization. The author argues that GIs have gained greater political salience and economic value due to major changes in the global economy.Proponents of GIs also raise more diffuse concerns about authenticity, heritage and locality in a rapidly globalizing world. After explaining the origins of the effort to protect GIs in international law, the author assesses the normative justification for these unusual intellectual property rights. Some GI protection in international law is justifiable. But, the existing level of protection afforded by the World Trade Organization - as well as current demands of the European Union for even greater protection - is unjustified. This position is defended through careful consideration of the major theoretical bases for property and economics rights.This paper explores the historical background of wine geographical indications as derived from select European Union Member States; also the international and domestic regulation of GIs in Europe, the United States of America and, principally, Australia. It is my theory that international pressure on countries such as Australia and, to a lesser degree, the United States of America to recognize well known European wine regions has left numerous gaps to fill in the state of their domestic law. In particular, the conflict between trademarks and the considerable difficulty in administering the GI scheme in Australia. Notwithstanding these matters, however, the use of wine zones and regions, as defined by GIs, is recognised as, amongst other things, an important brand marketing opportunity and, arguably increases the wine exporting opportunities for 'New World Countries'. The degree to which taxation and labelling requirements sets this back, will also be explored. Still, in Australia, however, a wine GI is in fact worth more than just the name on the bottle.

In his atlas of the wine regions of Australia, John Beeston comments upon the rich and contested history of the region: 'Coonawarra is certainly the most famous cabernet sauvignon region in Australia, and some would argue, the most renowned wine region in Australia per se'. A reporter, Penelope Debelle, captures a sense of the legal conflict over the parameters of the boundaries of Coonawarra: 'Behind the name Coonawarra, an inglorious contest is being waged that pits the romance of South Australia's terra rossa cool-climate wine region against the cold commercial reality of the label.'This Chapter tells the story behind the Coonawarra litigation, addressing the parties to the dispute; the legal and historical context of the case; and the immediate impact case, as well as its lingering significance. It considers the 'Coonawarra' case as, very literally, a landmark in Australian jurisprudence in respect of intellectual property. This chapter engages in the methodology of 'legal storytelling'. In the field of new historicism, the use of anecdotes - petite histoire - has been seen as a useful way of challenging grand historical narratives. Joel Fineman has observed that the anecdote is 'the literary form or genre that uniquely refers to the real.' This chapter has three parts. Part 1 outlines the European Community - Australia Wine Agreement 1994, and the operation of the Australian Wine and Brandy Corporation Act 1980 (Cth). Part 2 considers the various stages of the dispute over the Coonawarra region - moving from the decision of the Geographical Indications Committee, to the ruling of the Administrative Appeals Tribunal; and the conclusive decision of the Full Court of the Federal Court of Australia. Part 3 examines the implications of the Coonawarra litigation for other wine regions of Australia - most notably, the King Valley in Victoria; but also the Hunter Valley in the New South Wales; and the Margaret River in Western Australia. The conclusion considers the ramifications of the European Community-Australia Wine Agreement 2007, which has been initialed by both sides.

However, with no emphasis on wine typicality, Australia's legal framework of wine geographical indications is not well placed to promote and protect Australia's wine regions. In this article we explore the framework's genesis as an indication of source rather than a true geographical indication framework that links wine characteristics with place. We analyse case law and subsequent legal reform designed to correlate Australian wine law with international developments, noting that the reform has occurred after almost all of Australia's existing wine geographical names and their boundaries have been determined. We consider whether future geographical names and their boundaries should be determined on a different basis, compare different legal models that will facilitate the promotion of wine typicality and regionality, and suggest legislative changes that might implement a framework that better aligns the law with international consumer expectations for regional wine.
