Book excerpt: This series brings together the most significant published journal articles in international law as determined by the editors of each volume in the series. The proliferation of law, specialist journals, the increase in international materials and the use of the internet has meant that it is increasingly difficult for students and legal scholars to have access to all the relevant articles. Many valuable older articles are unable to be obtained readily. In addition each volume contains an informative introduction which provides an overview of the subject matter and justification of why the articles were collected. This series contains collections of articles in a manner that is of use for both teaching and research.

Book excerpt: Good Administration and the Council of Europe: Law, Principles, and Effectiveness examines the existence and effectiveness of written and unwritten standards of good administration developed within the framework of the Council of Europe (CoE) and in the case law of the European Court of Human Rights. These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.

Available in PDF, EPUB and Kindle. Book excerpt: The Dead Sea Scrolls were found in Palestine, recovered in Jordan, and largely edited by an international Christian team who prevented public access to unpublished manuscripts. Subsquently, the state of Israel, which had already purchased many of the Scrolls, has assumed responsibility for all of them. Most recently, one scroll editor has claimed copyright on his reconstruction, instigating a lawsuit and introducing serious implications for future Scrolls scholarship. This volume looks at international copyright and property rights as they affect archaeologists, editors and curators, but focuses on the issue of 'authorship' of the Scrolls, both published and unpublished, and the contributors include legal experts as well as many of the major figures in recent controversies, such as Hershel Shanks, John Strugnell, Geza Vermes and Emanuel Tov.

Book excerpt: This important book addresses critical themes in the development of archaeology as a reflexive, self-critical discipline in the modern world. It explores the ethical, political and cultural tensions and responsibilities which need to be addressed by archaeologists when working within networks of global ecologies and communities, examining how authoritarian traditions can exacerbate the divide between expert and public knowledge. Moreover, it analyses how localized acts of archaeology relate to changing conceptions of risk, heritage, culture, identity, and conflict. Bringing insights from Alain Schnapp, Michael Shanks, Isabelle Stengers, Bruno Latour, Ulrich Beck, John Urry and others to cross-disciplinary discussions of these themes, Unquiet Pasts shows how archaeological discourse can contribute towards engaging and understanding current dilemmas. It also shows how archaeology, as a localized and responsibly exercised practice, can play a part in building our commonly shared and experienced world.

Available in PDF, EPUB and Kindle. Book excerpt: Archaeological heritage legislation aims to ensure the best possible protection for the archaeological heritage, yet it remains the case that legislation can remain ineffective through other practical considerations. Some consideration may be legal or procedural, such as difficulties in enforcing legislation or in preventing crimes or damage or archaeological monuments. However other problems may be less obvious and harder to address, and require solutions which go much further than the simple application of the law. The aim of this volume is to address several issues surrounding the management of archaeological heritage comparing and contrasting which laws 'work' and which ones do not, and ignoring other issues which might effectively present the transplantation of an 'ideal system' to another country or political climate. Or the cultural attitudes which might prevent a law working in the legal system for which it was designed. The contributions are from various international jurisdictions and address a variety of subjects - from the protection of archaeological monuments to dealing with and controlling chance finds made by members of the public.

The study approaches this in two ways: The first is by evaluating and analyzing the fundamental theories and practice of heritage with comparison to World Heritage prescribed parameters for effective management, particularly authenticity, and the second is about to rereview the international legislation in the context of authenticity of heritage practice as a part of understanding and developing new parameters for conservation, preservation, and management. Book excerpt: This Handbook provides a cutting edge study of the fast developing field of international law on the protection of cultural heritage by taking stock of the recent developments and of the core concepts and current challenges. The legal protection of cultural heritage has come under renewed focus from the international community and states since the 1990s. This is evidenced by the adoption of a range of international instruments. Countries are also enacting cultural heritage legislation or overhauling existing laws within their own national territory. Contributions address the protection of immovable and movable, tangible and intangible cultural heritage in peacetime and in the event of armed conflict as well as the interaction between specific regimes of cultural heritage protection with other fields of international law, including international criminal law, human rights and humanitarian law, environmental law, international trade, investments, and intellectual property. The last part of the Handbook covers diverse regional systems of heritage protection.
